The human right to water - normative foundations and ethical implications
La preÌsente contribution examine les fondements normatifs ainsi que les implications eÌthiques du droit aÌ lâeau, tel quâil fut reconnu en 2002 par le comiteÌ onusien des droits eÌconomiques, sociaux et culturels. Il sera deÌfendu que le droit aÌ lâeau potable peut eÌtre justifieÌ en tant que droit moral fondamental, de par son caracteÌre indispensable en vue de la garantie des conditions basiques de survie. Cet eÌtat de fait, cependant, sâaveÌre moins eÌvident au vue dâun droit aÌ lâeau dâusage non-domestique. Ici, la discussion se rapproche des deÌbats accompagnant le concept beaucoup plus complexe des droits sociaux et eÌconomiques. Par rapport aÌ ce groupe de droits, la question de lâallocation est des plus controverseÌes: aÌ qui incombe-t-il de garantir leur respect? Dans le but dâeÌviter cette probleÌmatique dâallocation, le preÌsent essai souleÌvera la question de savoir, si la limitation de lâacceÌs aÌ lâeau peut eÌtre conçue comme une violation dâautres droits moraux: bien quâil y ait des cas ouÌ des entreprises transnationales deÌploient des activiteÌs nuisibles aÌ lâeÌgard des populations pauvres en polluant sciemment leurs ressources en eau ou en initiant et en exeÌcutant des strateÌgies de privatisation les privant de leurs droits, la crise globale de lâeau ne saura eÌtre rattacheÌe uniquement aux effets de la mondialisation. PlutoÌt, lâon reconnaiÌtra la neÌcessiteÌ dâefforts positifs et soutenus de la part des pays deÌveloppeÌs en vue de la reÌalisation dâun approvisionnement suffisant en eau pour tous.This paper looks into the normative foundations and the ethical implications of a human right to water, endorsed as recently as 2002 by the UN Committee on Human Rights. The paper argues that a human right to drinking water is justifiable as fundamental moral right guaranteeing basic conditions for mere survival. This is less clear in the case of a right to productive water, which verges on a much broader concept of social and economic rights. There are ongoing controversies about the allocation problem of these rights: Who has to deliver on them? To avoid the allocation problem, the paper will examine whether lack of access to water can be deemed a violation of other moral rights. But although there are cases where transnational corporations harm the poor by polluting their water resources or by sustaining or initiating harmful forms of privatisation, the water crisis cannot be solely traced back to a problem of harmful forms of globalisation alone. There is, thus, need for positive efforts from the developed countries to make safe water for all a reality

En Novembre 2015, Ă Therwil (BL), deux frĂšres ĂągĂ©s de 14 et 15 ans dĂ©cident de ne plus serrer la main Ă leur enseignante pour motif religieux. Alors que lâĂ©cole a trouvĂ© Ă lâinterne une entente provisoire, le « cas Therwil » est dĂ©battu intensĂ©ment dans les mĂ©dias et dans la politique lorsquâil devient public, en avril 2016. Cette contribution sâempare de la question dâĂ©thique professionnelle qui se trouve Ă la base de ce cas. Ce faisant, le rĂŽle des mĂ©dias est Ă©galement discutĂ©.In November 2015, two brothers (at that time 14 and 15 years old), decided to stop shaking hands with their female teacher for religious reasons. The school found a provisional solution. In April 2016, the âTherwil caseâ was made public triggering heated debates in media and politics. This contribution discusses the underlying question concerning professional ethos as well as the role of the media.Im November 2015 entschieden zwei BrĂŒder aus Therwil (BL), ihrer Lehrerin aus religiösen GrĂŒnden nicht mehr die Hand zu reichen. WĂ€hrend die Schule zuerst intern eine provisorische Lösung gefunden hatte, wurde der Fall im April 2016 publik und sowohl in den Medien als auch in der Politik intensiv diskutiert. Dieser Beitrag möchte die ursprĂŒnglich hinter dem Fall stehende interessante berufsethische Frage aufgreifen und analysieren. Dabei soll auch die Rolle der Medien diskutiert werden
La notion de "religion(s)" dans le Lehrplan 21: réflexions sur les sciences des religions et conclusions pour la didactique de la branche
En octobre 2014, la Suisse alĂ©manique adopte un plan dâĂ©tudes harmonisĂ© pour lâĂ©cole obligatoire. Notre contribution se propose de questionner la dĂ©finition et la localisation de la « religion » dans ce plan dâĂ©tudes, de la discuter dans une perspective des sciences des religions et de tirer des conclusions pour la didactique de la branche.In October 2014, a new harmonized syllabus has been published for the German speaking Swiss school system. This contribution questions the definition and location of âreligionâ, discusses it in the light of a study of religions approach and draws conclusions for subject- specific didactics.Im Oktober 2014 wurde der harmonisierte Lehrplan fĂŒr die obligatorische Volksschule der Deutschschweiz freigegeben. Der Beitrag fragt nach der Bestimmung und der Verortung von âReligionâ im Lehrplan, diskutiert diese aus einer religionswissenschaftlichen und religionskundlichen Sicht und zieht Folgerungen fĂŒr die Fachdidaktik

The Copying and Collection of Music in the TrouvĂšre Chansonnier F-Pn fr. 24406
F-Pn fr. 24406 is a codex of 155 folios containing, along with two Old-French prose works and a series of religious lyrics, 301 vernacular songs, all but one with notation. Despite its rich contents, fr. 24406 rarely receives mention in lists of the most important trouveÌre chansonniers. The majority of its contents are held in common with several of the other twenty chansonniers with notation. Editors consistently prefer other manuscriptsâ musical and textual readings to those of fr. 24406, because of the uniqueness of its readings and its supposed inaccuracy. In this thesis, I argue that modern editorial principles have biased scholarship against perceiving what fr. 24406 has to offer and that both its history and its contents are to be valued. Its music scribes, by their very individuality and even their mistakes, reveal much about the notated transmission of the songs, about the previous existence of now-lost sources, and about the craftsmanship displayed by notators of vernacular monophony. I propose to view what has been seen as sloppiness in fr. 24406 as its flexibility. The medieval songbook, sometimes seen as an obstacle to scholarly access to authored originals or to medieval performances, is treated as in itself a worthy work of art.
The thesis traces the themes of flexibility and scribal intelligence through the history of fr. 24406. My point of reference is the moment of copying and thus the thesis divides naturally into three parts: before, during and after copying. I begin after, with the combination shelf-markâs two component manuscripts. The question of their relationship offers an occasion to trace the bookâs usage since its compilation and changing scholarly opinions since its first notice. The task of manuscript description is thus largely accomplished through the lens of secondary scholarship. For the manuscriptâs prehistory, I mine codicological evidence and apply musical comparison to demonstrate the existence of multiple lost, notated exemplars for fr. 24406. The final part of the thesis is then devoted to describing the notators against this backdrop. Comparison of notational techniques between sources lets us pinpoint the decisions of fr. 24406âs notators and describe their adaptability, their intelligence, and their craft.This PhD was funded by the Cambridge International Trus
