    Editorial dossiê “Oralidade e garantias processuais penaisâ€: de qual oralidade podemos falar?

    This editorial develops an analysis of the understanding of orality from the fundamental guarantees. The orality is a technique that allows the amplification of the full defense and adversary proceedings. The editorial proposes a critical dialogue with the conformation of orality in the theory of the Brazilian process and its strong connection with the inquisitorial tradition. The debate with the authors of the dossier allows us to discuss other possibilities for understanding orality and experiences in Chilean and Argentine procedural reforms.O presente editorial desenvolve uma análise da compreensão da oralidade a partir das garantias fundamentais, vinculando-a como uma técnica que pode permitir a ampliação do contraditório, da ampla argumentação, da fundamentação da decisão e da imparcialidade do juiz. Buscou-se dialogar criticamente com a conformação da oralidade na teoria do processo brasileira e sua forte vinculação com a tradição inquisitorial.     Health-related quality of life of children born very preterm: a multinational European cohort study

    Purpose This study aims to (1) describe the health-related quality of life (HRQoL) outcomes experienced by children born very preterm (28–31 weeks’ gestation) and extremely preterm (< 28 weeks’ gestation) at five years of age and (2) explore the mediation effects of bronchopulmonary dysplasia (BPD) and severe non-respiratory neonatal morbidity on those outcomes. Methods This investigation was based on data for 3687 children born at < 32 weeks’ gestation that contributed to the EPICE and SHIPS studies conducted in 19 regions across 11 European countries. Descriptive statistics and multi-level ordinary linear squares (OLS) regression were used to explore the association between perinatal and sociodemographic characteristics and PedsQL™ GCS scores. A mediation analysis that applied generalised structural equation modelling explored the association between potential mediators and PedsQL™ GCS scores. Results The multi-level OLS regression (fully adjusted model) revealed that birth at < 26 weeks’ gestation, BPD status and experience of severe non-respiratory morbidity were associated with mean decrements in the total PedsQL™ GCS score of 0.35, 3.71 and 5.87, respectively. The mediation analysis revealed that the indirect effects of BPD and severe non-respiratory morbidity on the total PedsQL™ GCS score translated into decrements of 1.73 and 17.56, respectively, at < 26 weeks’ gestation; 0.99 and 10.95, respectively, at 26–27 weeks’ gestation; and 0.34 and 4.80, respectively, at 28–29 weeks’ gestation (referent: birth at 30–31 weeks’ gestation). Conclusion The findings suggest that HRQoL is particularly impaired by extremely preterm birth and the concomitant complications of preterm birth such as BPD and severe non-respiratory morbidity.This study was supported by a grant from the European Union’s Horizon 2020 Research and Innovation Programme under grant agreement No 633724.     Perfil microbiológico da carne de frangos abatidos artesanalmente e na indústria, comercializados na grande Recife-PE

    Considerando o elevado consumo da carne de frango no contexto nacional e mais especificamente na cidade do Recife, onde o abate clandestino ainda é intenso, objetivou-se delinear o perfil microbiológico da carne de frango disponível no mercado, comparando-se os produtos advindos de abatedouro industrial e artesanal e verificar se os produtos atendiam às especificações dos padrões recomendados pela legislação. Determinou-se o Número Mais Provável (NMP) de coliformes totais e termotolerantes, bem como realizou-se a pesquisa de Salmonella spp. e Aeromonas spp., além da contagem de bactérias aeróbias mesófilas, psicrófilas e Staphylococcus spp.. Foram analisadas 24 amostras, sendo que 12 advindas do processamento de frigoríficos industriais, resfriadas e comercializadas. As outras 12 amostras foram provenientes de abatedouro artesanal e comercializadas sem refrigeração. Nos resultados obtidos, a contagem de Staphylococcus spp., a determinação do NMP de coliformes totais e termotolerantes apresentaram valores acima dos permitidos nas carcaças artesanais, enquanto que, as pesquisas de Salmonella spp. e Aeromonas spp. não apresentaram diferença significativa. Nas carcaças artesanais o número de bactérias mesófilas foi 2,6 vezes maior que nas industriais, enquanto que no número de psicrófilas/pisicotróficas não houve diferença significativa entre as amostras. Algumas amostras não estão dentro dos padrões recomendados pela legislação

    Proposal of a Model for IT Service Continuity Management

    Micro and small companies in the software area now represent more than 90% of organizations in the country and grow 6% annually on average. However, the lack of planning in these companies in business continuity management contributes to their mortality when problems occur, such as disasters and disruption of system services. The implementation of IT Service Continuity Management as a tool for planning would be the solution. This research presents the current level of maturity of these companies in a Micro scenario and Small IT Companies in Paraná, at Londrina and Cascavel region

    Este artigo discute a necessidade de supera??o do modelo processual penal fundamentado na neutraliza??o da v?tima e consequente expropria??o do conflito pelo Estado, como f?rmula ?nica para solu??o do caso penal. Com foco nesse modelo processual, questiona-se se a sua l?gica de fato atende ?s necessidades das v?timas, respeitando seus direitos e garantias fundamentais. Em seguida, indaga-se sobre a necessidade de se discutir, ainda que de forma coadjuvante ao modelo vigente, um novo modelo de solu??o consensual de conflitos penais, marcado pela constru??o de procedimentos dial?gicos e horizontais como forma de resposta ao delito. Para tanto, o presente artigo possui como marco a no??o de justi?a horizontalizada, apontada por Nils Christie, que trabalha a import?ncia de se construir uma justi?a que se atenha ?s especificidades dos personagens centrais do conflito penal ? ofensores e v?timas ? para uma constru??o participada na decis?o do caso penal. Por fim, analisa-se se a Justi?a Restaurativa tem potencial suficiente para conferir a autonomia necess?ria ?s v?timas para que sejam, efetivamente, compreendidas como sujeitos de direitos.This article discusses the need to overcome the criminal procedural model based on the neutralization of the victim and the consequent expropriation of the conflict by the State, as the only formula for solving the criminal case. Focusing on this procedural model, it is questioned whether its logic actually meets the needs of victims, respecting their fundamental rights and guarantees. The next question is about the urge to discuss, even in a way that is compatible with the current model, a new model of consensual solution of criminal conflicts, marked by the construction of dialogical and horizontal procedures as a response to crime. This article is based on the notion of horizontal justice, pointed out by Nils Christie, which demonstrates the importance to build a justice that fits the specificities of the central characters of the criminal conflict ? offenders and victims ? to a participative decision of the criminal case. Finally, it is analyzed if the Restorative Justice has sufficient potential to confer the necessary autonomy to the victims so that they are effectively understood as subject of rights
