    The Attrition of Rights Under Parole

    We conduct a detailed doctrinal and empirical study of the adverse effects of parole on the constitutional rights of both individual parolees and the communities in which they live. We show that parolees’ Fourth, Fifth and Sixth Amendment rights have been eroded by a multitude of punitive conditions endorsed by the courts. Punitive parole conditions actually increase parolees’ vulnerability to criminal elements, and thus likely worsen recidivism. Simultaneously, the parole system mitigates the rights of non-parolees: family, co-tenants, and communities more broadly. We show that police target parolee-dense neighborhoods for additional Terry stops, even when income, race, population and single-family status are accounted for. Furthermore, police take advantage of the permissive parole search jurisprudence, conducting more searches and arrests of both parolees and their non-parolee neighbors. Combined, this analysis shows that parole institutionalizes individuals and marginalizes communities

    A DIGITAL ENGINEERING CASE STUDY OF AN UNMANNED UNDERWATER VEHICLE

    Team Icarus created a digital engineering case study based on an unmanned underwater vehicle (UUV) to provide a robust view of developing an architecture using Cameo Systems Modeler by executing the MagicGrid architecture development methodology. The case study includes connecting this architecture model to directly drive several engineering analysis tools (Excel, MATLAB/Simulink, a Computer Aided Design tool) through middle-ware software (ModelCenter MBSE). The design was refined through a design of experiments and is visualized through software tools (ModelCenter Explore). This case study is provided to Naval Surface Warfare Center–Port Hueneme Division (NSWC PHD) to be a supplement to the training of systems engineers and systems logisticians to fill in the gaps of existing trainings.     Is it possible to assign physical meaning to field theory with higher derivatives?

    To overcome the difficulties with the energy indefiniteness in field theories with higher derivatives, it is supposed to use the mechanical analogy, the Timoshenko theory of the transverse flexural vibrations of beams or rods well known in mechanical engineering. It enables one to introduce the notion of a "mechanical" energy in such field models that is wittingly positive definite. This approach can be applied at least to the higher derivative models which effectively describe the extended localized solutions in usual first order field theories (vortex solutions in Higgs models and so on).     Standardized Direct Observation Assessment Tool: Using a Training Video.

    BACKGROUND: We developed a DVD training tool to educate physicians evaluating emergency residents on accurate Standardized Direct Observation Assessment Tool (SDOT) application. OBJECTIVE: Our goal was to assess whether this training video improved attendings\u27 and senior residents\u27 SDOT use. METHODS: Participants voluntarily completed SDOT evaluations based on a scripted test video. A DVD with positive and negative scenarios of proper SDOT use was viewed. It included education on appropriate recording of 26 behaviors. The test scenario was viewed again and follow-up SDOTs submitted. Performances by attendings and residents on the pre- and post-test SDOTs were compared. RESULTS: Twenty-six attendings and 26 senior residents participated. Prior SDOT experience was noted for 8 attendings and 11 residents. For 20 anchors, participants recorded observed behaviors with statistically significant difference on one each of the pretest (no. 20; p = 0.034) and post-test (no. 14; p = 0.041) SDOTs. On global competency assessments, pretest medical knowledge (p = 0.016) differed significantly between groups. The training intervention changed one anchor (no. 5; p = 0.035) and one global assessment (systems-based practice; p = 0.031) more negatively for residents. Recording SDOTs with exact agreement occurred 48.73% for attendings pretest and 54.41% post-test; resident scores were 45.86% and 49.55%, respectively. DVD exposure slightly raised attending scores (p = 0.289) and significantly lowered resident scores (p = 0.046). CONCLUSIONS: Exposure to an independently developed SDOT training video tended to raise attending scores, though without significance, while at the same time lowered senior resident scores statistically significantly. Emergency attendings\u27 and senior residents\u27 SDOT scoring rarely differed with significance; about half of anchor behaviors were recorded with exact agreement. This suggests senior residents, with appropriate education, may participate in SDOT assessment

    The colour-magnitude relation of Elliptical and Lenticular galaxies in the ESO Distant Cluster Survey

    We study the colour-magnitude relation (CMR) for a sample of 172 morphologically-classified E/S0 cluster galaxies from the ESO Distant Cluster Survey (EDisCS) at 0.4<z<0.8. The intrinsic colour scatter about the CMR is very small (0.076) in rest-frame U-V. Only 7% of the galaxies are significantly bluer than the CMR. The scarcity of blue S0s indicates that, if they are the descendants of spirals, these were already red when they became S0s. We observe no dependence of the CMR scatter with redshift or cluster velocity dispersion. This implies that by the time cluster E/S0s achieve their morphology, the vast majority have already joined the red sequence. We estimate the galaxy formation redshift z_F for each cluster and find that it does not depend on the cluster velocity dispersion. However, z_F increases weakly with cluster redshift. This trend becomes clearer when including higher-z clusters from the literature, suggesting that, at any given z, in order to have a population of fully-formed E and S0s they needed to have formed most of their stars 2-4 Gyr prior to observation. In other words, the galaxies that already have early-type (ET) morphologies also have reasonably-old stellar populations. This is partly a manifestation of the "progenitor bias", but also a consequence of the fact that the vast majority of the ETs in clusters (in particular the massive ones) were already red by the time they achieved their morphology. E and S0 galaxies exhibit very similar colour scatter, implying similar stellar population ages. We also find that fainter ETs finished forming their stars later, consistent with the cluster red sequence being built over time and the brightest galaxies reaching the red sequence earlier than fainter ones. Finally, we find that the ET cluster galaxies must have had their star formation truncated over an extended period of at least 1 Gyr.     Intakes of long-chain n–3 polyunsaturated fatty acids and fish in relation to measurements of subclinical atherosclerosis

    BACKGROUND: Data on the relations of different types of fish meals and long-chain n-3 polyunsaturated fatty acids (PUFAs) to measures of atherosclerosis are sparse. OBJECTIVE: We examined intakes of long-chain n-3 PUFAs and fish in relation to clinical measures of subclinical atherosclerosis. DESIGN: A cross-sectional study was conducted in a multiethnic group of 5,488 adults aged 45-84 y and free of clinical cardiovascular disease. Diet was assessed by using self-administered food-frequency questionnaires. Subclinical atherosclerosis was determined by measurements of common carotid intima-media thickness (cCIMT, >80th percentile), internal CIMT (iCIMT, >80th percentile), coronary artery calcium score (CAC score, >0), or ankle-brachial index (ABI, <0.90). RESULTS: After adjustment for potential confounders, intakes of long-chain n-3 PUFAs and nonfried (broiled, steamed, baked, or raw) fish were inversely related to subclinical atherosclerosis determined by cCIMT but not by iCIMT, CAC score, or ABI. The multivariate odds ratio comparing the highest to the lowest quartile of dietary exposures in relation to subclinical atherosclerosis determined by cCIMT was 0.69 (95% CI: 0.55, 0.86; P for trend < 0.01) for n-3 PUFA intake; 0.80 (95% CI: 0.64, 1.01; P = 0.054) for nonfried fish consumption; and 0.90 (95% CI: 0.73, 1.11; P = 0.38) for fried fish consumption. CONCLUSIONS: This study indicates that the dietary intake of long-chain n-3 PUFAs or nonfried fish is associated with a lower prevalence of subclinical atherosclerosis classified by cCIMT, although significant changes in iCIMT, CAC score, and ABI were not observed. Our findings also suggest that the association of fish and atherosclerosis may vary depending on the type of fish meal consumed and the measures of atherosclerosis
