    Plain Reading, Subtle Meaning: Rethinking the IOIA and the Immunity of International Organizations

    Immunity is freedom from liability, and as such, it can quite literally provide a “get out of jail free” card. In the United States, international organizations face uncertainty about the scope of their immunity, which is provided by the International Organizations Immunities Act (IOIA). The D.C. Circuit has found that international organizations enjoy absolute immunity under the IOIA. Conversely, the Third Circuit recently held that international organizations are only entitled to restrictive immunity, which limits immunity to claims involving an organization’s public acts and does not exempt them from suits based on their commercial or private conduct. This Note contends that a plain reading of the IOIA, combined with a full understanding of the history and legislative purpose behind the immunity of international organizations, presents a third interpretation. It concludes that the IOIA requires judicial deference to immunity determinations by the executive branch, which provides the flexibility necessary to allow international organizations to operate without undue interference

    COSTMODL: An automated software development cost estimation tool

    The cost of developing computer software continues to consume an increasing portion of many organizations' total budgets, both in the public and private sector. As this trend develops, the capability to produce reliable estimates of the effort and schedule required to develop a candidate software product takes on increasing importance. The COSTMODL program was developed to provide an in-house capability to perform development cost estimates for NASA software projects. COSTMODL is an automated software development cost estimation tool which incorporates five cost estimation algorithms including the latest models for the Ada language and incrementally developed products. The principal characteristic which sets COSTMODL apart from other software cost estimation programs is its capacity to be completely customized to a particular environment. The estimation equations can be recalibrated to reflect the programmer productivity characteristics demonstrated by the user's organization, and the set of significant factors which effect software development costs can be customized to reflect any unique properties of the user's development environment. Careful use of a capability such as COSTMODL can significantly reduce the risk of cost overruns and failed projects

    A New Theory of Economic Systems and Its Application to Economic Policy Studies

    The basics of a new theory of economic systems are proposed in this article as a fundamental synthetic field of economics. This theory proposes to unify a description of economic phenomena usually studied by different areas of economics: economic agents, i.e., legal and physical entities, formal and informal institutions, economic processes, and projects. A basic classification of economic systems is developed, their key functions are defined, and the need for power parity of the basic types of economic systems is proved. The results obtained are used to classify the types of national economic policy and elaborate measures aimed at preventing crisis phenomena and building a well-balanced economy.

    DIFFUSION OF BT COTTON AND INSECTICIDE USE

    This study estimated a dynamic logistic model to explain the diffusion Bt cotton in the United States. Regional differences in the speed and extent of Bt cotton adoption were explained by differences in availability of Bt seed adapted to local conditions, potential seed supplier profits, and economic variables affecting grower gains from adoption. The study also estimated the impact of Bt cotton on insecticide use, controlling for differences in pest infestations and prices and correcting for the endogeneity of the Bt adoption decision. Bt cotton significantly reduced insecticide applications to control target pests cotton bollworm, tobacco budworm, and pink bollworm. Bt cotton has led to an overall reduction in these applications per total US cotton acres, ranging from 0.5 in 1996 to 1.8 in 2003.     The Use of Loglinear Models for Assessing Differential Item Functioning Across Manifest and Latent Examinee Groups

    Loglinear latent class models are used to detect differential item functioning (DIF). These models are formulated in such a manner that the attribute to be assessed may be continuous, as in a Rasch model, or categorical, as in Latent Class Mastery models. Further, an item may exhibit DIF with respect to a manifest grouping variable, a latent grouping variable, or both. Likelihood-ratio tests for assessing the presence of various types of DIF are described, and these methods are illustrated through the analysis of a "real world" data set
