Direitos humanos e emancipação: uma aproximação da ontologia lukacsiana

Programa de Pós-Graduação em DireitoEsta tese trabalho tem como objeto de análise os desdobramentos da ontologia marxista de Georg Lukács no campo do direito, em especial, dos direitos humanos. O trabalho se explicita como fundamento do desenvolvimento do ser social. A base ontológico-genética do trabalho possibilita o surgimento dos distintos complexos da totalidade social, que se desenvolvem de forma tendencial por meio da contínua expansão das forças produtivas, recuo das barreiras naturais e aumento da sociabilidade do ser social. A estrutura econômica se constitui no momento predominante do desenvolvimento dos demais complexos sociais, sem estabelecer relações hierárquicas. O complexo jurídico como regulação social tem sua gênese nos efeitos do desenvolvimento da base econômica, em especial decorrente da divisão da sociedade em classes antagônicas. A divisão social do trabalho vai possibilitar o surgimento de um grupo especial cujo mandato social é o exercício da jurisdição. O complexo jurídico exerce a função ideológica específica de orientar a práxis dos indivíduos por meio de preceitos abstratos coativamente sancionados pelo Estado. A estrutura jurídica não é indiferente às contradições decorrentes da base econômica. As contradições de classe fundamentam a necessidade da dominação de classe concretizar-se através de diferentes compromissos com as outras classes sociais. O complexo jurídico é capaz de realizar a mediação entre as distintas classes sociais, mantendo velada a dominação de determinada classe específica. Os direitos humanos têm sua gênese histórica articulada com a ascensão da revolução burguesa, que ao mesmo tempo foi expressão do desenvolvimento da generidade humana e contraditoriamente subordina esta generidade à particularidade da ordem burguesa. Para que os direitos humanos venham a corresponder ao desenvolvimento da essência do ser social é necessário superar o ciclo vicioso das particularidades, transformando a estrutura econômica de tal maneira que possibilite a extinção das classes sociais e com elas o fim da pré-história da humanidade.This thesis has as object of analysis the unfolding of Georg Lukacs' marxist ontology in the field of law, especially in the human rights. The labour explicit itself as a foundation of social being#s evolution. The ontological-genetic base of labour enables the advent of the distinct complex of social totality, which develops in a tendentiously form by the continuous expansion of productive forces, retraction of the natural barriers and increase of social being#s socialization. The economic structure, constitute itself, in a predominant moment of the development of other complex social, without establishing hierarchical relationships. The legal complex as a social regulation has it genesis in the social effects of the development of economic base, in particular from the division of society into antagonistic classes. The social division of labour has allowed the emergence of a special group whose social mandate is the exercise of jurisdiction. The legal complex acts as specific ideological function to orientate the practice of the individuals through abstract precepts sanctioned by the State with coercion. The legal structure is not indifferent to contradictions arising from the economic base. The class contradictions underlying the necessity of class' domination materialize itself, through various compromises with the other social classes. The legal complex is capable of performing the mediation between different social classes, maintaining veiled the domination of certain specific class. The human rights have their historical genesis combined with the rise of the bourgeois revolution that was, at the same time, expression of the evolution of human generality and, paradoxically, subordinate this generality to a particularity of the bourgeois order. For the human rights will correspond to the evolution of the essence of social being is necessary to overcome the vicious cycle of particularities, transforming the economic structure in such a way that allow the extinction of social classes and with them, the end of the prehistory of humanity
ISO 14001 and international trade
The purpose of this paper is to study potential association between international trade and ISO 14001 certification. The study is based upon a search conducted by International Organization for Standardization (ISO) performed in 2013, which includes responses from 110 countries in 11 languages. At this time, among all topics from the research, the variables studied were motivations for implementation and the benefits achieved. These data were crossed with features of international business trade to identify its real outcome. The null hypothesis to be tested is that there was no correlation or association between international trade and the studied variables. Results show that there were 16 weak correlations between motivations to implement ISO 14001 and international trade. The survey result shows that there are weak correlations among countries international trade and motives to get certification. Because the degrees of correlation are low, there is reason to further studies, what could probably include multivariate techniques. Anyway, the study suggests that some of the expected results and benefits for the business were not achieved or were achieved at degrees lower than expected in countries where trade is higher. A Blockchain System for Mobile Health Applications and Services
Com o aparecimento das tecnologias blockchain, o crescimento e adaptação de características criptográficas levaram à exploração de novos usos em novas áreas, como a computação
móvel para a saúde (m-Health). Atualmente, estas tecnologias são implementadas primáriamente como mecanismos para manter os registos de saúde eletrónicos seguros. No entanto,
novos estudos têm provado que estas apresentam-se como uma ferramenta poderosa para promover o controlo da informação de saúde pelos próprios pacientes e possibilita a existência
de um historial médico sem alterações errôneas, para além da responsabilização dos profissionais de saúde. Nos últimos anos, verificou-se um rápido crescimento da área da m-Health,
sustentada numa arquitetura orientada a serviços, levando a que a adaptação de mecanismos
de blockchain em aplicações de saúde gerasse a possibilidade da existência de um serviço mais
descentralizado, pessoal e disponível. A ideia de adaptar tecnologia blockchain na área da
prestação de serviços de saúde apresenta inicialmente alguns pontos críticos, como por exemplo como é que é assegurada a segurança e a privacidade da informação de saúde guardada na
blockchain. Normalmente, num sistema completamente descentralizado, a informação tem de
estar completamente disponível a atores externos e tem de ser guardada de forma distribuída.
Embora o armazenamento da informação de forma distribuída não apresente dificuldades, a
particulariedade do tipo de informação que é guardada na blockchain e de que maneira esta
é mantida privada e segura são questões problemáticas já conhecidas. Um breve estudo desta
tecnologia é suficiente para concluir que não é adequado um registo médico de um paciente ser
guardado na blockchain, uma vez que, devido ao tamanho do registo, iria gerar problemas de
escalabilidade com o aumento do número de pacientes. Perante esta situação, o desempenho
da blockchain iria diminuir e seria necessária uma quantidade demasiado elevada de poder computacional para a realização de tarefas básicas, gerando ainda um aumento nos requisitos de
armazenamento e de transmissão em rede. Embora a blockchain não tenha capacidade para
guardar a informação completa de um paciente, as suas características permitem que seja utilizada para guardar outros dados relacionados com a privacidade da informação da saúde. Deste
modo, é precisamente no registo e controlo de acesso à informação de saúde que a tecnologia
blockchain promete inovar. Ao registar todos os acessos à informação de saúde de um paciente,
é possível criar um registo com a identificação e a autentificação de todos os utilizadores do
sistema que requereram o acesso a determinada informação de saúde. Portanto, um registo de
acesso consegue ser criado com uma pequena quantidade de informação, como um timestamp,
com a identificação do utilizador que está a aceder aos dados e com a identificação do utilizador
cujos dados estão a ser acedidos. Uma das grandes vantagens de registar a informação dos acessos numa blockchain é o facto de os registos serem distribuídos por várias localizações, sendo
estas imutáveis e tolerantes a falhas e públicos. Deste modo, verifica-se que os problemas de
escalabilidade, associados ao tamanho reduzido do registo, que surgem ao guardar informação
na blockchain discutidos previamente conseguem ter um impacto mais reduzido.
Contudo, apesar das vantagens desta tecnologia, alguns dos aspetos da sua integração desta em
m-Health não são compatíveis com a natureza da informação de saúde de um paciente. Para
acomodar tecnologia blockchain na área da saúde, é necessário que o sistema seja construído
com várias restrições em mente. Uma destas restrições é o facto de que a informação presente na blockchain é normalmente pública, o que entra em conflito com o direito à privacidade dos
pacientes e leva à necessidade de encriptar a informação. Outra restrição é o facto de como
identificar um utilizador num registo de acesso, uma vez que normalmente a informação dos
utilizadores é anónima.
O objetivo desta dissertação é estudar como a tecnologia blockchain consegue ser conjugada
com a informação de saúde recolhida ou processada por aplicações móveis. Com a finalidade de
alcançar esse objetivo, foi desenvolvido um protótipo de uma solução baseada em blockchain
para controlar acesso à informação de saúde. Este protótipo para além de oferecer uma segurança melhorada da informação, devido à implementação de mecanismos de criptografia,
oferece um historial médico imutável ao armazenar informação de eventos de saúde numa
blockchain. A esta construção foi ainda adicionado um sistema de armazenamento de dados
anónimos baseado numa arquitetura de data lake. Posteriormente, este protótipo foi integrado
num ambiente de teste, que consistiu em várias aplicações móveis, com o objetivo de testar
detalhadamente a viabilidade e desempenho de propostas similares.With the advent of blockchain, the growth and adaptation of cryptographic features and capabilities were quickly extended to new and under-explored areas, such as healthcare. Currently, blockchain is being implemented mainly as a mechanism to secure Electronic Health
Record (EHR)s. However, new studies have shown that this technology can be a powerful tool
in empowering patients to control their own health data, as well as for enabling a fool-proof
health data history and establishing medical responsibility. With the advent of mobile health
(m-Health) sustained on service-oriented architectures, the adaptation of blockchain mechanisms into m-Health applications creates the possibility for a more decentralized and available
healthcare service. The idea of adapting blockchain technology into healthcare initially presents
several critical points where special consideration is required, such as how privacy and security
of healthcare information can be assured if information is stored into a blockchain. Usually, for
a completely decentralized system, the information has to be available to everyone and is to
be stored in a distributed manner. While the storage of the information being distributed is not
difficult, what kind of information should be stored into the blockchain as well as how this information can be kept private and secure present issues. A brief study of blockchain technology
is enough to conclude that a full patient record is not fit to be stored into a blockchain, because the size of the record would create scalability problems as the number of patient records
increases. This diminishes the performance of the blockchain to where the amount of computational power needed to perform basic tasks would rise considerably, as well as the storage
and network requirements needed to permanently store the information and to replicate the
information throughout the whole network, respectively. However, other uses for blockchain
technology arise once the nature of the health information is analyzed thoroughly.
Because of the highly personal and private aspect of health information belonging to a patient,
the security of how that information is stored, transmitted and accessed becomes a main focus of
health systems. It is precisely in access recording and management of healthcare information
that blockchain shows promise in implementation. By recording all accesses to a the health
information of a patient, it is possible to create a log of every user in a system that has had
access to some information. By having a system that identifies and authenticates all users, every
access to health data can be recorded as having been done by an identified user. An access
record can be made with a small amount of information, such as a timestamp, an accessing
user identifier and an identifier of the user whose data is being accessed. Because an access
record can be accomplished with only this amount of information, the scalability issues that
where discussed earlier regarding storing information into a blockchain can be mitigated. In
terms of advantages, recording access information into a blockchain results in the access records
being distributed across several locations, immutable, fault-tolerant and public. However, some
aspects of the integration of blockchain into healthcare result in incompatibilities of the nature
of health information and of blockchain. To accommodate health information and blockchain,
the surrounding system must be constructed with several limitations in mind. One of which is
the public nature of blockchain not being in line with the private nature of health information
and therefore the information must be encrypted, or how a user can be identified in an access
record if usually information in a blockchain is anonymous. This work proposes a system that successfully integrates blockchain into an m-Health testbed,
outlining how both areas have evolved and their main challenges. The proposed system offers
enhanced information security both in transmission, storage and access, by integrating several
cryptographic mechanisms. Furthermore it is integrated with a blockchain access system and a
high volume anonymous information storage mechanism based on a data lake database architecture. This system is integrated into a testbed that allows for a more detailed discussion on
viability and performance of similar concepts

Recuperação espontânea da linguagem verbal após acidente cerebrovascular isquêmico
OBJECTIVE: To analyze the spontaneous recovery of the verbal language on patients who have had an ischemic stroke. METHOD: Retrospective analysis of 513 medical records. We characterize referring aspects for data identification, language deficit, spontaneous recovery and speech therapy. RESULTS: The average age was 62.2 years old (SD= ±12.3), the average time of academic experience was 4.5 years (SD=±3.9), 245 (47.7%) patients presented language disturbance, 166 (54.0%) presented spontaneous recovery, from which 145 (47.2%) had expression deficit (p=0.001); 12 (3.9%) had comprehension deficit and 9 (2.9%) had both expression and comprehension deficit. Speech therapy was carried with 15 patients (4.8%) (p=0.001). CONCLUSION: The verbal language spontaneous recovery occurred in most of the patients being taken care of at the stroke out clinic, and expression disturbance was the most identified alteration. As expected, the left hemisphere was associated with the deficit and smoking and pregressive stroke were the language alteration primary associated factors.OBJETIVO: Analisar a recuperação espontânea da linguagem verbal em pacientes que sofreram acidente cerebrovascular isquêmico (AVCI). MÉTODO: Análise retrospectiva de 513 prontuários. Caracterizamos aspectos referentes aos dados de identificação, déficit de linguagem, recuperação espontânea, realização de tratamento fonoaudiológico. RESULTADOS: A média de idade foi 62,2 anos (DP=±12,3), o nível de escolaridade teve média de 4,5 anos (DP=±3,9), 245 (47,7%) pacientes apresentaram alteração de linguagem, 166 (54,0%) apresentaram recuperação espontânea sendo 145 (47,2%) do déficit de expressão (p=0,001), 12 (3,9%) de compreensão e 9 (2,9%) misto. A realização de tratamento fonoaudiológico foi encontrada em 15 (4,8%) (p=0,001). CONCLUSÃO: A recuperação espontânea da linguagem verbal ocorreu na maioria dos pacientes atendidos no ambulatório de AVCI e a alteração mais encontrada foi de expressão. Perfil do paciente com câncer gástrico do Instituto Nacional do Câncer
Objective: Search and analyze the profile of patients with gastric cancer enrolled in the National Cancer Institute, José de Alencar Gomes da Silva (INCA), and the most prevalent nursing diagnoses.Methodology: A sectional study developed at the Cancer Hospital I - INCA, approved by CEP-INCA, with a sample of secondary data from 649 patients admitted from October 1, 2015 to April 18, 2018. Data were analyzed by R® software - version 3.4 .4. In the Chi-square, Kruskal-Wallis and Wilcoxon tests. The level of significance of 5% was adopted.Results: The average age was 62.74 years, ranging from 21 years to 96 years. 35.29% of patients had advanced disease. Low adenocarcinoma was the most prevalent (42.52%). Signal ring cells were present in 32.05% of the patients. The diffuse type was highlighted (17.72%). There was predominance of involvement of the middle third of the stomach (29.74%). Hypothesis tests have shown that the staging versus death and color versus death variables maintain a relationship of dependence. The variables age versus death and age versus the presence of the Sinete ring present a distinct distribution among them, which means that the first variable can influence the second. The most prevalent nursing diagnoses were present in 100% of the sample and were in congruence with the profile of the clientele identified.Conclusion: The epidemiological profile of a population is of great value to guide the health policies of a country, to the internal institutional planning and to guide the assistance actions of the multiprofessional teams.Objetivo: Levantar y analizar el perfil de los pacientes con cáncer gástrico matriculados en el Instituto Nacional del Cáncer José de Alencar Gomes da Silva (INCA), y los diagnósticos de Enfermería más prevalentes.Metodología: Estudio seccional desarrollado en el Hospital de Cáncer I - INCA aprobado por el CEP-INCA, con muestra de datos secundarios de 649 pacientes admitidos entre el 1 de octubre de 2015 al 18 de abril de 2018. Los datos fueron analizados por el software R® - versión 3.4.4. En las pruebas Chi-cuadrado, Kruskal-Wallis y Wilcoxon. Se adoptó el nivel de significancia del 5%.Resultados: El promedio de edad fue de 62.74 años, variando de 21 años hasta 96 años. 35.29% de los pacientes presentaban enfermedad avanzada. El adenocarcinoma poco diferenciado fue el más prevalente (42.52%). Había células en anillo de sello en el 32.05% de los pacientes. Se destacó el tipo difuso (17.72%). Hubo predominio del compromiso del tercio medio del estómago (29.74%). Las pruebas de hipótesis demostraron que las variables de estadificación frente a la muerte y el color frente a la defunción mantienen una relación de dependencia. Las variables edad versus óbito y edad versus presencia de anillo de Sinete tienen distribución diferente entre sí, lo que significa que la primera variable puede influenciar la segunda. Los diagnósticos de enfermería más prevalentes estuvieron presentes en el 100% de la muestra y se encontraban en congruencia con el perfil de la clientela identificada.Conclusión: El perfil epidemiológico de una población es de gran valor para orientar las políticas de salud de un país, para la planificación interna institucional y para orientar las acciones asistenciales de los equipos multiprofesionales.Objetivo: Levantar e analisar o perfil dos pacientes com câncer gástrico matriculados no Instituto Nacional de Câncer José de Alencar Gomes da Silva (INCA), e os diagnósticos de Enfermagem mais prevalentes.Metodologia: Estudo seccional desenvolvido no Hospital de Câncer I – INCA aprovado pelo CEP-INCA, com amostra de dados secundários de 649 pacientes admitidos entre 01 de outubro de 2015 à 18 de abril de 2018. Os dados foram analisados pelo software R® – versão 3.4.4. Nos testes Qui-quadrado, Kruskal-Wallis e Wilcoxon. Foi adotado o nível de significância de 5%.Resultados: A média de idade foi de 62.74 anos, variando de 21 anos até 96 anos. 35.29% dos pacientes apresentavam doença avançada. O adenocarcinoma pouco diferenciado foi o mais prevalente (42.52%). Havia células em anel de sinete em 32.05% dos pacientes. Destacou-se o tipo difuso (17.72%). Houve predomínio do comprometimento do terço médio do estômago (29.74%). Os testes de hipóteses demostraram que as variáveis estadiamento versus óbito e cor versus óbito mantêm uma relação de dependência. As variáveis idade versus óbito e idade versus presença de anel de Sinete tem distribuição diferentes entre si, o que significa que a primeira variável pode influenciar a segunda. Os diagnósticos de enfermagem mais prevalentes estiveram presentes em 100% da amostra e encontravam-se em congruência com o perfil da clientela identificada.Conclusão: O perfil epidemiológico de uma população é de grande valia para orientar as políticas de saúde de um país, para o planejamento interno institucional e para nortear as ações assistenciais das equipes multiprofissionais
Measurement properties
OBJECTIVE: The Assessments of SpondyloArthritis international Society Health Index (ASAS HI), estimates the impact of Spondyloarthritis (SpA) on global functioning and health. This article assesses the construct validity, reliability and responsiveness of the Portuguese version of the ASAS HI. PATIENTS AND METHODS: Patients fulfilling ASAS classification criteria for axial (axSpA) or peripheral SpA (pSpA) were included. Construct validity was assessed through Spearman's correlation analysis with other health outcomes. Discriminant validity was tested comparing the ASAS HI across disease activity and functional states using the Kruskal-Wallis test. Internal consistency was assessed by Cronbach's α, and test-retest reliability by intraclass correlation coefficients (ICC). Responsiveness was evaluated by the standardized response mean (SRM) in patients with active disease who required therapy escalation. RESULTS: Among the 91 patients included, 67% were male, mean (SD) age 47.2 (12.9) years, 63 patients with axSpA and 28 patients with pSpA. The hypothesis defined a priori to test construct validity were confirmed. The ASAS HI showed ability to discriminate between patients with different disease activity and functional states (p<0.001). Internal consistency (Cronbach's α: 0.88) and test-retest reliability [ICC=0.76 (95%CI 0.09-0.91)] were good. Responsiveness was moderate (SRM=-0.53). The smallest detectable change was 3.0. CONCLUSIONS: The Portuguese version of the ASAS HI is a comprehensible questionnaire that is valid, reliable and responsive. It can be used to assess the impact of SpA and its treatment on functioning and health, in clinical practice and for research purposes.publishersversionpublishe
Fatores preditivos para espasticidade após acidente vascular cerebral
Spasticity is a determining for functional loss following ischemic stroke. OBJECTIVE: To detect possible predictive factors for its occurrence. METHOD: Demographic, clinical and tomographic data on 146 stroke patients were analyzed. RESULTS: Spasticity was noted more frequently among patients who underwent physiotherapy (p<0.0001; OR=19.4; 95% CI: 4.4-84.5), those who underwent such treatment for long periods (p=0.028; OR=4.80; 95% CI: 1.1-8.3) and those with manual work (p=0.041; OR=2.2; 95% CI: 1.02-4.6), lower income (p=0.038), pain complaints (p<0.0001; OR=107.0; 95% CI: 13.5-847.3), appearance of pain at the same time as spasticity (p<0.0001), previous vascular disease (p=0.001; OR=4.2; 95% CI: 1.7-10.3), muscle weakness (p<0.0001; OR=91.9; 95% CI: 12.0-699.4), extensive lesions as seen on tomography (p=0.01) and lesions affecting more than one cerebral lobe (p=0.018). Manual work had a relative risk of 2.9; previous stroke 3.9, and extensive lesion 3.6. CONCLUSION: Spasticity affected 25% of the patients, and was associated with: manual work, previous stroke, extensive lesions, decrease in individual income, underwent physiotherapy, underwent physiotherapy for longer period, pain complaints, the pain started simultaneously with the spasticity, presented changes in strength.A espasticidade é fator determinante para perda funcional após o acidente vascular cerebral isquêmico (AVCI). OBJETIVO: Detectar possíveis fatores preditivos para a ocorrência da espasticidade. MÉTODO: Foram analisados dados demográficos, clínicos e tomográficos de 146 pacientes pós-AVCI. RESULTADOS: Na análise univariada a espasticidade foi notada com maior freqüência em pacientes que realizaram fisioterapia (p<0,0001; OR=19,4; 95% CI: 4,4-84,5), com maior tempo de duração desse tratamento (p=0,028; OR=4,80; 95% CI: 1,1-8,3) e que realizavam trabalho braçal (p=0,041; OR=2,2; 95% CI: 1,02-4,6), renda menor (p=0,038), referência de dor (p<0,0001; OR=107,0; 95% CI: 13,5-847,3) e seu aparecimento simultâneo à espasticidade (p<0,0001), acidente vascular cerebral (AVC) pregresso (p=0,001; OR=4,2; 95% CI: 1,7-10,3), fraqueza muscular (p<0,0001; OR=91,9; 95% CI: 12,0-699,4), lesão tomográfica extensa (p=0,01) e lesão afetando mais de um lobo cerebral (p=0,018). Na análise de regressão multivariada a atividade braçal apresentou risco relativo de 2,9; acidente vascular cerebral prévio com risco relativo de 3,9 e lesão tomográfica extensa risco relativo de 3,6.
