    The Crime of Sedition: At the Crossroads of Reform and Resurgence

    The offense of “sedition” — often characterized as criminalizing the incitement of rebellion against the government — is an archaic crime that is frequently used to target political speech. Introduced in the sixteenth century in England specifically to suppress dissent, sedition laws spread through the British colonies. These laws still persist in some legal systems, and while there are reforms underway in some of those jurisdictions, in a few outliers, the offense continues to be prosecuted — and in some there has been a resurgence in cases. Sedition laws have been criticized by the United Nations (“U.N.”), human rights experts, courts, legislatures, advocates, and others for being a weapon used by governments to violate the right to freedom of expression. Moreover, the significant criminal penalties that usually accompany sedition laws have a chilling effect on political debate and can undermine democratic processes. This report examines the movement to repeal or reform sedition laws, the reasons for these efforts, and abuses that take place where the charge of sedition continues to be used. It proceeds in three parts: first, a brief overview of sedition laws and the criticisms they have faced at the international and regional levels; second, an update on the substantial progress Commonwealth States have made to reform these laws; and third, an overview of several examples of States where prosecutors have weaponized sedition laws to stifle dissent, including examples arising from TrialWatch’s monitoring experience

    Dominant ethnicity: from minority to majority

    This article argues that the world is in the midst of a long-term transition from dominant minority to dominant majority ethnicity. Whereas minority domination was common in premodern societies, modernity (with its accent on democracy and popular sovereignty) has engendered a shift to dominant majority ethnicity. The article begins with conceptual clarifications. The second section provides a broad overview of the general patterns of ethnic dominance that derive from the logic of modern nationalism and democratisation. The third section discusses remnants of dominant minorities in the modern era and suggests that their survival hinges on peculiar historical and social circumstances coupled with resistance to democratisation. The fourth section shifts the focus to dominant majorities in the modern era and their relationship to national identities. The article ends with a discussion of the fortunes of dominant ethnicity in the West

    Political strategies of external support for democratization

    Political strategies of external support to democratization are contrasted and critically examined in respect of the United States and European Union. The analysis begins by defining its terms of reference and addresses the question of what it means to have a strategy. The account briefly notes the goals lying behind democratization support and their relationship with the wider foreign policy process, before considering what a successful strategy would look like and how that relates to the selection of candidates. The literature's attempts to identify strategy and its recommendations for better strategies are compared and assessed. Overall, the article argues that the question of political strategies of external support for democratization raises several distinct but related issues including the who?, what?, why?, and how? On one level, strategic choices can be expected to echo the comparative advantage of the "supporter." On a different level, the strategies cannot be divorced from the larger foreign policy framework. While it is correct to say that any sound strategy for support should be grounded in a theoretical understanding of democratization, the literature on strategies reveals something even more fundamental: divergent views about the nature of politics itself. The recommendations there certainly pinpoint weaknesses in the actual strategies of the United States and Europe but they have their own limitations too. In particular, in a world of increasing multi-level governance strategies for supporting democratization should go beyond preoccupation with just an "outside-in" approach

    The meaning of complementary therapy from the perspective of Thai women with breast cancer

    A qualitative study based on Heideggerian phenomenology was conducted with 17 Thai women who had survived breast cancer and had utilized at least one type of complementary therapy. The study explored the meaning of such therapy and the data were collected by an in-depth interview, a demographic data-recording form, and a reflective journal. The data were analyzed by using an interpretative process that was described by Cohen, Kahn, and Steeves. Six themes were generated in relation to the meaning of complementary therapy as perceived by the participants: cancer-controlling treatment; mental strengthening; mind and body therapy; self-determination; natural therapy; and conventional therapy integration. The knowledge gained from this study will help health-care providers better understand the role that complementary therapies play in the lives of women whose lives are threatened by cancer.     Conducting retrospective impact analysis to inform a medical research charity’s funding strategies: The case of Asthma UK

Complexity increases when assessing the diverse funding streams of funders such as Asthma UK, a charitable patient organisation supporting medical research to benefit people with asthma. This paper aims to describe the various impacts identified from a range of Asthma UK research, and explore how Asthma UK utilised the characteristics of successful funding approaches to inform future research strategies. METHODS: We adapted the Payback Framework, using it both in a survey and to help structure interviews, documentary analysis, and case studies. We sent surveys to 153 lead researchers of projects, plus 10 past research fellows, and also conducted 14 detailed case studies. These covered nine projects and two fellowships, in addition to the innovative case studies on the professorial chairs (funded since 1988) and the MRC-Asthma UK Centre in Allergic Mechanisms of Asthma (the ‘Centre’) which together facilitated a comprehensive analysis of the whole funding portfolio. We organised each case study to capture whatever academic and wider societal impacts (or payback) might have arisen given the diverse timescales, size of funding involved, and extent to which Asthma UK funding contributed to the impacts. RESULTS: Projects recorded an average of four peer-reviewed journal articles. Together the chairs reported over 500 papers. All streams of funding attracted follow-on funding. Each of the various categories of societal impacts arose from only a minority of individual projects and fellowships. Some of the research portfolio is influencing asthma-related clinical guidelines, and some contributing to product development. The latter includes potentially major breakthroughs in asthma therapies (in immunotherapy, and new inhaled drugs) trialled by university spin-out companies. Such research-informed guidelines and medicines can, in turn, contribute to health improvements. The role of the chairs and the pioneering collaborative Centre is shown as being particularly important. CONCLUSIONS: We systematically demonstrate that all types of Asthma UK’s research funding assessed are making impacts at different levels, but the main societal impacts from projects and fellowships come from a minority of those funded. Asthma UK used the study’s findings, especially in relation to the Centre, to inform research funding strategies to promote the achievement of impact.This study was funded by Asthma UK

    Using Land-Based Surveys to Assess Sea Duck Abundance and Behavior in Nearshore Waters of Southern New England, USA

    Nearshore waters provide very important habitat for sea ducks (Tribe Mergini) during migration and winter, but gathering information on sea duck use of shallow nearshore waters is challenging because traditional aerial and boat-based surveys are expensive, are usually conducted infrequently, and are often not feasible near the coast. The objective of this study was to use land-based surveys to characterize spatiotemporal variation in the abundance and behavior (e.g., foraging, flying) of Common Eider (Somateria mollissima) and scoters (Melanitta spp.) in nearshore waters of southern New England. Surveys (60–120 min per survey, n = 1,044 surveys) were conducted throughout the day from February 2009 to July 2010 to assess diurnal and seasonal variation in sea duck behavior and spatial distribution at nine sites in southern Rhode Island. The density of sea ducks resting or foraging on the water exhibited little diurnal variation, whereas flight activity dramatically increased nearer to sunrise. Sea duck densities and passage rates (individuals/km2/hr) peaked during migration periods from October through November and February through April, although there were important seasonal differences between sites. For example, the highest densities of Common Eider during fall were in a protected estuary, whereas abundance of scoters during fall was greater at a coastal headland. The relative activity of Common Eider on the water and in flight was similar among sites, whereas scoters exhibited highly variable activity among sites, particularly during winter and spring. The spatiotemporal patterns in abundance and behavior of sea ducks in nearshore waters that we detected using land-based surveys provides essential, complementary information to that available from other types of waterfowl and seabird surveys in southern New England

    Scaling Up ART Adherence Clubs in the Public Sector Health System in the Western Cape, South Africa: a Study of the Institutionalisation of a Pilot Innovation

    In 2011, a decision was made to scale up a pilot innovation involving ‘adherence clubs’ as a form of differentiated care for HIV positive people in the public sector antiretroviral therapy programme in the Western Cape Province of South Africa. In 2016 we were involved in the qualitative aspect of an evaluation of the adherence club model, the overall objective of which was to assess the health outcomes for patients accessing clubs through epidemiological analysis, and to conduct a health systems analysis to evaluate how the model of care performed at scale. In this paper we adopt a complex adaptive systems lens to analyse planned organisational change through intervention in a state health system. We explore the challenges associated with taking to scale a pilot that began as a relatively simple innovation by a non-governmental organisation

    Predicting implementation from organizational readiness for change: a study protocol

    <p>Abstract</p> <p>Background</p> <p>There is widespread interest in measuring organizational readiness to implement evidence-based practices in clinical care. However, there are a number of challenges to validating organizational measures, including inferential bias arising from the halo effect and method bias - two threats to validity that, while well-documented by organizational scholars, are often ignored in health services research. We describe a protocol to comprehensively assess the psychometric properties of a previously developed survey, the Organizational Readiness to Change Assessment.</p> <p>Objectives</p> <p>Our objective is to conduct a comprehensive assessment of the psychometric properties of the Organizational Readiness to Change Assessment incorporating methods specifically to address threats from halo effect and method bias.</p> <p>Methods and Design</p> <p>We will conduct three sets of analyses using longitudinal, secondary data from four partner projects, each testing interventions to improve the implementation of an evidence-based clinical practice. Partner projects field the Organizational Readiness to Change Assessment at baseline (n = 208 respondents; 53 facilities), and prospectively assesses the degree to which the evidence-based practice is implemented. We will conduct predictive and concurrent validities using hierarchical linear modeling and multivariate regression, respectively. For predictive validity, the outcome is the change from baseline to follow-up in the use of the evidence-based practice. We will use intra-class correlations derived from hierarchical linear models to assess inter-rater reliability. Two partner projects will also field measures of job satisfaction for convergent and discriminant validity analyses, and will field Organizational Readiness to Change Assessment measures at follow-up for concurrent validity (n = 158 respondents; 33 facilities). Convergent and discriminant validities will test associations between organizational readiness and different aspects of job satisfaction: satisfaction with leadership, which should be highly correlated with readiness, versus satisfaction with salary, which should be less correlated with readiness. Content validity will be assessed using an expert panel and modified Delphi technique.</p> <p>Discussion</p> <p>We propose a comprehensive protocol for validating a survey instrument for assessing organizational readiness to change that specifically addresses key threats of bias related to halo effect, method bias and questions of construct validity that often go unexplored in research using measures of organizational constructs.</p
