    Since federal law first acknowledged the crime of sex trafficking in 2000, the internet has exploded—and sex traffickers have taken note. Traffickers have gained a platform to sell their victims to a much larger audience and with greater ease. Posting victims’ advertisements online allows traffickers to drastically expand their customer base beyond the traditional street corner. Despite congressional attempts to criminalize sex traffickers and their beneficiaries since 2000, the internet persists as an effective conduit for sex traffickers to find customers. In 2018, Congress sought to remedy this by passing legislation that expanded criminal and civil liability to websites that knowingly participate in sex trafficking by hosting sex trafficking advertisements. In part, the Allow States and Victims to Fight Online Sex Trafficking Act (FOSTA) amends a law that was widely understood to provide websites with total immunity from claims arising out of third-party content. Concerned with the potential for criminal prosecutions, internet service providers criticize FOSTA as an infringement on their First Amendment right to free speech. They argue that the law forces them to censor third-party users’ content and that it improperly extends to legal speech. The First Amendment generally does not restrict the content of speech, however, and its protections do not extend to speech that solicits crime. This Note will argue that FOSTA does not violate the First Amendment and is constitutionally sound at its core because sex traffickers’ advertisements solicit crime

    This thesis provides insight on the psychoanalysis of fairy tales, namely the Grimm fairy tale, “The Little Brother and Sister.” The critical analysis defines theories about the human mind popularized by Sigmund Freud and especially Carl Jung. Modern psychologist Paul Moxnes applies Jung’s theories about character archetypes in fairy tales to his modern study about “deep roles” which solidifies the important relationship between human psychology, fairy tales, and fairy tale retellings. With a deeper understanding of the psychological implications of character archetypes, the creative retelling portion of this thesis rewrites the old version of the brother and sister characters from “The Little Brother and Sister” into characters that demonstrate agency and self-empowerment in a graphic novel retelling titled Wylder and Wynona

    The purpose of this article is to provide an overview of the Department of Veterans Affairs Accountability and Whistleblower Protection Act of 2017 (S.1094). Specifically, this paper explores the law’s journey throughout the American governance system, including the legislative, judicial, and executive branches. This is supplemented by an examination of the core political theories on the bureaucratic institutions that define the policymaking process. The paper analyzes the most complex aspects of the lawmaking process in the context of S. 1094, including the barriers to implementation and claims to its constitutional basis. The objective of this article is to examine the development of this particular law from the perspective of these various institutions of the political system in addition to an evaluation of the way it accomplishes the goals at the heart of this piece of legislation. This analysis is complemented by exploring the role of interest groups, political parties, and unorthodox lawmaking practices

    Habitat Use of Wintering Henslow\u27s Sparrows (Centronyx henslowii) in Power Line Right-of-Ways

    Habitat loss and degradation are the leading causes of grassland bird declines worldwide. The Henslow’s Sparrow (Centronyx henslowii; hereafter HESP) is a grassland bird species of conservation concern that has historically relied on the herbaceous ground-layer of longleaf pine savannas and similar habitats in the southeastern U.S. for food and shelter in the winter. However, due to human development, alterations of habitat, and fire suppression, only fragments of these habitats remain. Over the last decade, surveys have annually documented HESPs using power line right-of-ways (hereafter, ROWs) at several sites in the coastal plain of Georgia as alternative habitat for overwintering. These ROWs share similar vegetative characteristics to pine savannas because they are managed to have low tree cover and because they have a graminoid-dominated ground-layer. However, which micro-habitat characteristics HESPs select, and how much space they use within ROWs has not yet been studied. During the winters of 2019 to 2021, I captured HESPs at three Wildlife Management Areas and attached radio-transmitters to track their habitat selection and evaluate space use within ROWs. I conducted vegetation surveys in used and available habitat in the ROWs to assess which vegetation characteristics (e.g., height, density, composition) HESPs select. I used principal component analysis to reduce the number of vegetation variables and look for correlations among variables. I then used conditional logistic regression and model selection to identify top predictors of HESP habitat use. Statistical analyses showed that HESPs select areas within a ROW with a greater number of forb species, a small percentage of woody vegetation for escape refugia, and high vegetation density at the ground level. HESPs used less space (using 0.14 ha on average) than in longleaf pine savanna habitats, based on comparison with the literature. Based on these findings, I recommend habitat management practices that promote forb diversity, increase food resources, and maintain habitat structure. This study shows that ROWs can be important areas for conservation of overwintering HESPs. With continued management, ROWs can support overwintering grassland birds and could potentially act as corridors between longleaf pine restoration sites

    Students attending under-resourced public schools are held to the same statewide standards as their peers in wealthier districts, but are attempting to learn under conditions of neglect. In most states, students lacking qualified teachers, safe classrooms, textbooks, and other learning resources have no power to change their learning environments. Due to the lack of a federal constitutional right to education, efforts to improve school conditions by invoking general state protections have had mixed success in enhancing the quality of education in the United States. In California in 2004, however, the Williams v. State student class action lawsuit set some of the first concrete requirements for public school conditions and created a comprehensive monitoring mechanism to involve students and parents in school oversight. The Williams complaint model should be modernized and adopted by other states to restore agency to students, empower teachers to engage in school reform, and ensure efficient use of state resources in addressing individual school site problems. Furthermore, establishing legal requirements for students’ “minimal education needs” can delineate clear instances for court intervention in local policy, and set the groundwork for more ambitious education equity lawsuits in the future

    Valuation of aircraft noise by time of day: a comparison of two approaches

    This paper reports an innovative application of stated preference techniques to derive values of aircraft noise by time of day and day of week. Revealed preference techniques cannot provide such segmentations which would clearly be of use in policy development especially relating to airport operations. Given the lack of research on this issue the work reported here is highly experimental. Two stated preference experiments were designed. The first focussed on a single time period whilst the second asked respondents to trade between time periods. Both approaches yielded results that are plausible and mutually consistent in terms of relative values by time period. We conclude that stated preference techniques are particularly useful in this context where the use of aggregated values may lead to non-optimal policy decisions
