    The protection of human trafficking victims by the enforcement bodies in Malaysia

    United States is a self-appointed country which monitors the issue of human trafficking. In 2001, the U.S Department of State introduced the Trafficking in Persons (TIP) report as an effort to eradicate human trafficking. The country oversees 187 state governments on their progress in addressing human trafficking by collecting relevant information from the United Nations High Commissioner for Refugees, the consulates and embassies around the globe, the United Nations Children’s Fund, and media reports. In the period of 2012 until 2017, the TIP reports highlighted that the Malaysian government did not manage to protect the trafficking victims effectively. As a result, Malaysia is not included among the Tier 1 countries and it has to ensure strict compliance with Section 108 of the Trafficking Victims Protection Reauthorization Act. The protection of victims in Malaysia is entrusted to a number of stakeholders, namely five enforcement bodies led by the Royal Malaysian Police. This paper examined the protection provided to the human trafficking victims by these enforcement bodies. The findings revealed that the enforcement bodies comply with the guidelines and legal framework in Malaysia, despite the claim that they provide inadequate protection. As a recommendation, Malaysia may reflect on the efforts undertaken by the Australian government to protect victims in their country. This approach is anticipated to catapult Malaysia into the Tier 1 ranking in TIP by the year 2020

    Challenges encountered by Malaysian prosecutors in human trafficking

    Anti-Trafficking in Persons and Smuggling of Migrants Act 2007 is the federal antitrafficking and anti-smuggling legislation in Malaysia. Ten years after its enactment, fewer cases on human trafficking were identified. Statistics showed that the number of the victim saved and perpetrators prosecuted before the courts have reduced, although some commentators suggested that the original estimates of the cases are higher due to recent modern approaches in slavery. Some scholars claimed that the act by its nature is already a comprehensive set of laws to prevent the crime since its first introduction compared to other Tier 1 countries in Trafficking in Persons (TIP) report such as Australia which has gradually enhanced its legislation. However, the comprehensiveness of the act does not guarantee the prevention of human trafficking due to the ineffectiveness of prosecution officers in prosecuting the perpetrators, thus denying the rights of the victims to be protected as reported in TIP reports from 2010 until 2017. This is a qualitative and legal studies adopting doctrinal and legal research approaches. This paper analyzed the prosecution of human trafficking cases in Malaysia. The findings revealed the obstacles faced by the prosecution officers in carrying their duties against the perpetrators, contributed by enacted legislation, nongovernmental organizations, judiciary officers, and enforcement bodies

    The effectiveness of trafficking in persons report in combatting human trafficking

    The Trafficking in Persons (TIP) Report is the main reference for countries around the world, particularly the United Nation state members, in determining their success in combatting human trafficking issues. The objective of the report is to fulfil three principal goals, namely to protect the trafficking victim, to prevent the crime, and to bring the perpetrator to justice. This report was initiated by the U.S. Department of State in 2001 as one of the efforts to monitor and increase worldwide efforts regarding the issues. As a destination and transit country for human trafficking, the U.S. Department of State has become the self-appointed country monitoring the human trafficking progress of (187) state governments since 2004. The first report for human trafficking that was published in 2001 stated that the related countries will be examined and placed either in Tier 1, Tier 2, or Tier 3 depending on their status. In order to be placed in the Tier 1 level, the government must fully comply with the minimum standards outlined in Section 108 of the Trafficking Victims Protection Act of 2000. If the government does not fully comply with the minimum standards for the elimination of trafficking, but has put significant efforts to comply with the standards, it is then placed in Tier 2. The failure for compliance by any governments would place it in Tier 3. Nevertheless, few issues are detected on the effectiveness of the TIP Report in the assessment of a country’s achievement in combatting the crime. The issues raised include (i) the monitoring body which is led by the U.S. Department of State; (ii) the 3P paradigm outlined by the Protocol to Prevent, Suppress, and Punish Trafficking in Persons Especially Women and Children which is heeded by the U.S. Department of State; and (iii) the assessment stipulated in the TIP Report which focuses too heavily on the protection of victims. To that end, this article studies the effectiveness of the TIP Report in assessing the countries involved, particularly Malaysia. Combining content analysis and semi-structured interview, this article argues that a lot of improvement must be done on the report’s transparency in assessing the countries and thus, proving its effectiveness in combatting the human trafficking issues

    ‘Kain Telepuk’ is the most glorious Malay textile. In the state of Selangor, the Telepuk textile is a rich fabric usually worn by the royalty and nobility members since 300 years ago. The Telepuk textile is widely used during the reign of the High Royal Highness Sultan Sir Hishamuddin Alam Shah Al-haj (1938–1960) and worn by his consort the Royal Highness Tengku Ampuan Jemaah. Telepuk textile is not popular and the choice of ideas to the local fashion designers. Today younger generations, especially Malays are not familiar and unacknowledged about the Telepuk textile as the great Malay traditional textile art form. This research is to identify the floral motif of the Telepuk textile and leaded to a systematic inquiry in documenting the aesthetic values of the Malay treasure of the Malay Selangor heritage textile.     A case of missed thoracic fracture masquerading as intra-abdominal injury

    Altered mental status in the setting of polytrauma poses a challenge to the emergency team managing the patient. The tendency to miss positive findings in these circumstances increases several folds due to multiple factors such as depressed mental status/intoxication, presence of distracting injuries and concurrent life-threatening injuries that require more urgent attention. In view of this, NEXUS (National Emergency X-Radiography Utilization Study) criteria of clearing the cervical spine was adopted and used worldwide. Consensus on clearance of the other parts of spine is still lacking. This case reports highlights the findings in a 18-yrs-old male who presented with altered mental status, facial pain and abrasion, following a motor vehicle accident. Facial bone fracture was diagnosed and he was discharged. Three days later, he came with severe epigastric pain. Tenderness on palpation was noted at the spine and Computed Tomography (CT) scan was done. Multiple thoracic vertebra fractures were seen. As a conclusion, thorough primary and secondary survey should be done in patients who have regained full consciousness prior to discharge in order to avoid overlooking other serious injuries

    Relationship between social media usage and academic achievement among tertiary students in Malaysian public university

    The increasing use of social media among tertiary students is one of the highly growing phenomena in the academia. Various studies show students’ high involvement in using social media network to interact with their peers, lecturers and discussing learningmaterials. Full understanding of the social media and how it is being utilized in education is needed, especially in knowing the relationship between social media used and academic achievement among tertiary students as we know the tertiary students are at large used this technologies. The aims of this study is to examine the relationship between social media used (online peer learning) and academic achievement among tertiary students in one of the Malaysian public university. The study was based on quantitative method with a correlational design using questionnaires that was modified from previous study and validated by a panel of experts. The sampling technique was stratified from 17 faculties and 328 respondents involved in this study. There are positivesignificant low correlation between the variables measured. The highest correlation is between collaboration and academic achievement followed by the correlation between performance expectancy and academic achievement, engagement and academic achievement,social influence and academic achievement, peer feedback and academic achievement, and lastly, self-efficacy and academic achievement. Practical implications and recommendations were given to enhance the engagement of students via online peer learning

    Concept, Design and Implementation of Automatic Waste Management System

    One of the main concerns with our environment has been solid waste management which in addition to disturbing the balance of the environment also has adverse effects on the health of the society. The detection, monitoring and management of wastes is one of the primary problems of the present era. The traditional way of manually monitoring the wastes in waste bins is a complex, cumbersome process and utilizes more human effort, time and cost which is not compatible with the present day technologies in any wa y. This paper proposes an advanced method in which waste management is automated. Radio frequency identification (RFID) is one of the most promising and anticipated technologies in recent years. The system makes use of radio frequency (RF) tags and web sup port. This work presented here certainly provides a novel approach in handling and disposing off the day to day solid wastes in an efficient and easy way. The system consists of four main subsystems namely Smart Trash System (STS), Local Base Station (LBS) , Smart Vehicle System (SVS) and Smart Monitoring and Controlling Hut (SMCH). The proposed system would be able to automate the solid waste monitoring process and management of the overall collection process. The technologies that would be used in the prop osed system are good enough to ensure the practical and perfect for solid waste collection process monitoring and management for green environment

    In pursuit of economically competitive agro-tourism sector: the case of Terengganu homestay, Malaysia

    Agro-tourism is more than just a tourist product. It is a journey to a new sensation or positive behavior concerning the environment, the community and culture. It also one of the diversified sub-sectors that provide opportunities and choices for the rural community, commonly associated with agricultural activities to enhance and maintain their economic sustainability. This research focuses on the quantification of tourism sector income specifically related to agricultural destinations, activities, and products, evaluated in the selected communities that offer tourists visits and stays within the former’s villages or settlements. Income derived from the activities, destinations, and products are to be reported and assessed against initial investment and annual operating costs. This is an area mostly void of literature, especially those within the Malaysian contexts. The research aims at exploring the vitality and robustness of agro-tourism based homestay activities in Terengganu. Three objectives have been developed based on the gaps in existing literature. Firstly, the research is to identify offerings of homestay destinations, activities, and products relevant to agriculture sector within the rural communities of Terengganu. Secondly, the research is to assess the income received from these activities based on communal receipts as well as individually reported revenues. Finally, the research is to recommend strategic and focused areas of improvement to increase and sustain the competitiveness of agro-tourism sector delivered through homestays operation. The methods used in this paper were the semi-structured interview and focus group discussion. 76 respondents participated in the discussion
