    Dibalik sistem pemilukada secara nasional dan konstitusional, terdapat mekanisme pemilukada secara adat (model noken) yang dilaksanakan masyarakat adat Lanny Jaya Papua. Model pemilihan ini mendapat pengakuan secara implisit dan diakomodasi Hakim Mahkamah Konstitusi berdasarkan putusan Nomor 85/PHPU.D-IX/2011. Dari kajian yuridis normatif, dengan pendekatan penelitian melalui perundang-undangan (Statute Approach), dan pendekatan kasus (Case Approach), ditafsirkan bahwa pengakuan Mahkamah Konstitusi dalam mengakomodasi pemilukada secara adat, berdasarkan interpretasi, dengan pertimbangan yurisprudensi, konstitusi, dan nilai-nilai budaya. Pertimbangan Mahkamah Konstitusi dalam perspektif Teori Hukum Murni (Pure Theory of Law), secara substansial melihat yurisprudensi, Konstitusi, dan nilai-nilai budaya sebagai hubungan secara hirarki antara norma dasar, norma umum dan norma individual. Implikasi sebagai akibat hukum dari putusan Mahkamah Konstitusi adalah pengakuan secara yuridis formal mekanisme secara adat (model noken) ke dalam sistem pemilu di Indonesia

    Pre-trial court is a new institution which was established simultaneously with the creation of Indonesian Criminal Procedure Code (Act No. 8 of 1981). Its authorities include determination of legality of an arrest or a detention; the legality of an investigation termination or a prosecution termination; legality of house entry, search and/or seizure; and restitution and rehabilitation for someone whose criminal case is discontinued at the level of investigation or prosecution. The objectives of this research are :(1) to explain why judges did not grant / reject the criminal pretrial suit submitted by the petitioners to the District Court of Surakarta over a span of two years back; and (2) to provide a guidance on how a pretrial petition shall be organized so that it is granted or accepted. This research used the descriptive analytical research method w th the juridical normative approach. The data of research consisted of primary and secondary es. They were collected through library research and research on law decided by the judges through the judicial process, and they were then analyzed by using the juridical normative/doctrinal model of analysis. The results of research show that (1) in the period of 2011-2012, none of the overall pretrial petitions submitted was granted or accepted by the judges of the District Court of Surakarta due to the non-fulfillment of administrative elements in the judicial process and that of the legal standing of both the petitioners and defendants; and (2) there is a need for analysis of reasoning for the etitioners so that that their pretrial petitions are granted/accepted by fulfilling all of the elements of pretrial litigation procedures

The Commercial Sex Workers Control Model is the first one is by handling through the Rehabilitation Center, the Panti located in Surakarta is the Wanodyatama Surakarta Women's Social Service, the second is by handling through outside the Panti by expanding employment, providing an out-of-school education program , build awareness of commercial sexual exploitation activities with public campaigns, education to prevent commercial sexual exploitation and Trafficking, to combat commercial sexual exploitation by controlling vulnerable licensing with commercial sexual exploitation, giving sanctions to perpetrators in accordance with applicable regulations.     Conversion of land becomes one of the problems that threaten the agricultural sector in Indonesia. Demand for land for human needs will always rise every year rapidly. This is triggered by the development of both the government and the private sector. The conversion of agricultural land has an impact on food self-sufficiency in Indonesia especially in sukoharjo regency, due to reduced food production area so that food in production will decrease causing inability of self-supporting of food to a food requirement of its population. regency of sukoharjo regency as representation from state, obliged to provide for requirement for local society. this is done in the district sukoharjo. The purpose of this study to determine the relationship between land conversion with food self-sufficiency and know the relationship of population acceleration with the acceleration of land conversion using descriptive sociological, nakan primary and secondary data.Tecnique data collection purposive sampling with clustering based on the homogenization of variables, interviews and document studies in quantitative analysis. The research results show that in Sukoharjo regency has not been able to self-sufficiency of food because acceleration of high population in accompanied by acceleration of land conversion rate causing the food production can not cover the food needs of the population. The suggestion that the government should limit the conversion of land by affirming and suppressing the existence of a permit to a development of the needs of the community, and provide support to farmers to increase food production for the future sukoharjo district able to self-sufficiency in food

    The enactment article of 9 point a, law number 10 year 2016 states “Duties and Authority General Election Commissions in the conduct of elections of governors, regents and mayors include: (a) Establishing and arrange General Election Commission rules and technical guidelines for each stage of the election after consultation with the House of Representatives and the Government in the forum of a hearing decision will be binding”, shows the involvement of the executive and the legislative is so central and decisive in authority of the General Election Commissions in drafting and establishing rules and technical guidelines for each stage. Such provisions could potentially threaten the independence of the Commission on Elections as an independent state agency. Research type used for this study is qualitative descriptive. This study uses an content analysis approach, the method of analysis is to explain material juridical legal events are researched and written on the basis of the use of primary data sourced from interviews and secondary data and also the comparative approach is done by using a comparative study of law. As for the results of this research are, results of the research is descriptive law that is the implementation of the independence of the Commission in accordance with act number 10 year 2016, test the independence of the Commission in accordance with act number 10 year 2016 if compared with the Constitution and the results of research conducted with qualitative analysis that models the independence of the Commission in accordance with act number 10 year 2016 and also uses comparative law in other countries

    Mahkamah Konstitusi (MK) mengabulkan permohonan pengujian Undang-Undang Nomor 7 Tahun 2004 Tentang Sumber Daya Air (Undang-Undang Sumber Daya Air) yang diajukan oleh Pengurus Pusat (PP) Muhammadiyah. Pengujian permohonan Undang-Undang Sumber Daya Air merupakan strategi memperjuangkan umat yang lemah (mustad’afin) sesuai prinsip-prinsip dasar Islam. Dengan demikian, argumentasi pengujian ini juga didasarkan pada kemaslahatan ekologi dan alam yang terkandung dalam hukum Islam. Pengujian Undang-Undang Sumber Daya Air dapat pula dilihat sebagai salah satu upaya untuk menguji persamaan antara prinsip-prinsip hukum Islam dan Undang-Undang Dasar 1945. Metode penelitian menggunakan pendekatan socio-Iegal Judicial review, dengan mengkaji putusan dalam permohonan pengajuan Undang-Undang Nomor 7 Tahun 2004 Tentang Sumber Daya Air terhadap Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dengan Nomor Putusan 85/UU -XI/2013. Penelitan tersebut bersifat normatif berdasarkan data primer yaitu putusan 85/UU -XI/2013 serta implementasi UU no 17 Tahun 2019 dengan data kepustakaan dan menggunakan pendekatan perundang-undangan (statute approach). Kesimpulan ini sangat memperjelas sejauh mana konsistensi Muhammadiyah terhadap langkah Judicial Review tentang Undang-Undang Sumber Daya Air yang bertentangan terhadap Undang-Undang Dasar 1945. Hal ini menunjukkan bahwa Muhammadiyah telah membangun jihad konstitusi sebagai ijtihad konkret dalam upaya meluruskan penegakkan hukum lingkungan yang seharusnya negara lakukan sesuai pasal 33 Undang-Undang Dasar 1945

    Eksistensi adopsi di Indonesia sebagai suatu lembaga hukum masih belum ada keseragaman (unifikasi), sehingga masalah adopsi masih merupakan problema bagi masyarakat, terutama dalam masalah yang menyangkut ketentuan hukumnya. Keberagaman tersebut sangat jelas terlihat, ketentuan tentang lembaga adopsi itu sendiri dalam sumber-sumber yang berlaku di Indonesia, baik hukum barat yang bersumber dari Burgerlijk Wetboek (BW), hukum adat yang berlaku di Indonesia, maupun hukum Islam yang merupakan konsekuensi logis dari masyarakat Indonesia yang mayoritas beragama Islam. Tujuan penelitian ini 1) untuk mendeskripsikan adopsi ditinjau dari sistem Hukum Barat, Hukum Adat, Hukum Islam, dan Hukum Nasional di Indonesia. 2) Untuk mengetahui pelaksanaan adopsi di Kabupaten Boyolali dalam rangka mencapai tujuan perlindungan anak telah sesuai dengan peraturan hukum positif Indonesia, dan sesuai dengan hukum adat yang berlaku. 3) untuk menemukan model hukum bagi pelaksanaan adopsi di Kabupaten Boyolali. Hasil penelitian ini adalah pelaksanaan adopsi di Kabupaten Boyolali masih kurang sesuai dengan peraturan hukum nasional di Indonesia, hukum Islam dan hukum adat yang berlaku, di samping juga masih kurang sesuai dengan tujuan pengangkatan anak yaitu untuk menjamin terpenuhinya hak-hak anak agar dapat hidup tumbuh berkembang dan berpartisipasi secara optimal sesuai dengan harkat dan martabat kemanusiaan, serta mendapat perlindungan dari kekerasan dan diskriminasi, demi terwujudnya anak Indonesia yang berkualitas, berakhlak mulia, dan sejahtera. Pengangkatan anak di Kabupaten Boyolali masih kurang dapat diterima menurut asas-asas perlindungan anak. Hal ini dapat dilihat dari proses atau mekanisme pelaksanaan pengangkatan anak (adopsi) di Kabupaten Boyolali yang belum melalui persetujuan atau izin pengangkatan anak dari Dinas Sosial Provinsi Jawa Tengah, yang didahului dengan pertimbangan Tim Pertimbangan Perizinan Pengangkatan Anak (Tim PIPA) Provinsi Jawa Tengah yang terlebih dahulu melakukan kunjungan rumah (home visited) selama tiga kali kunjungan untuk menilai dan memastikan kelayakan Calon Orang Tua Angkat (COTA), sebelum masuk ke proses lebih lanjut di pengadilan untuk mendapatkan putusan/penetapan dari pengadilan, dengan harapan agar tujuan pelaksanaan pengangkatan anak (adopsi) dalam rangka perlindungan anak dapat tercapai. Perlu adanya model hukum baru khususnya pasca adopsi dilakukan, karena sangat dimungkinkan bagi anak yang telah diadopsi kemudian diterlantarkan oleh orang tua angkatnya. pemerintah juga perlu memikirkan adanya keseragaman (unifikasi) ketentuan peraturan perundang-undangan yang mengatur tentang pelaksanaan pengangkatan anak (adopsi) dalam rangka untuk menjamin kepastian hukum

    This study aims to analyze the issue sconcerning the background of the marriage dispensation application in Ex Karesidenan Surakarta, the formulation of the Regulation of Underage Marriage Dispensation and Judge's considerationanalysis in providing marriage dispensation withage, which purposeisuseful to know and understand the importance of underage marriage dispensation. This research uses research method with normative law approach with supplementary data of Judge of Ex Surakarta Residency specially about marriage dispensation, so that its research based on literature review primarily legislation which then combined with using serveifield as complete and accurate because through formal hearings. The results of this study indicate that the judges' considerations in the dispensation determination are classified into two, namely legal considerations and fairness considerations that live in the community. The legal consideration here means that when the judge imputes his determination must be in accordance with the arguments and legal evidencepresented, while the consideration of community just ice because often marriage is considered as an alternative solution for the settlement of social problems.
