    "The theorized impact of land tenure and titling on access to credit has produced mixed results in the empirical literature. Land tenure and titling is hypothesized to increase access to credit because of the enhanced land security provided and the newfound ability to use land as collateral. Using land as collateral and obtaining access to credit are paramount concerns in Uganda and in all of Africa, as greater emphasis is placed on the need to modernize the agricultural system. This paper uses a new approach in evaluating whether land tenure and titling have an impact on access to credit for rural households in Uganda. The new approach includes comparisons across four categories: (1) households who have customary land with versus without a customary certificate, (2) households who have freehold land with versus without a title, (3) households with a title or certificate having freehold versus customary tenure, and (4) households without a title or certificate having freehold versus customary tenure. Each comparison is then evaluated for the impact on access to any form of credit, formal credit, and informal credit. This analysis allows for an in-depth look into which element, tenure or title, is impacting access to credit and to which type of credit, formal or informal. To conduct this analysis, matching techniques are used, including propensity score matching and the Abadie and Imbens matching method. These two methods contain both strengths and weaknesses that allow the results to support to one another. The only significant finding of the matching was a positive impact on access to credit of freehold without title over customary without certificate.     Large-scale Title VII remedies are typical of public law litigation, which differs in kind from the conventional compensatory lawsuit. Title VII remedies are commonly adopted by way of consent decrees. By approving these consent decrees, federal courts take responsibility for extensive institutional reforms while acting independently of the adversary process. Courts have frequently approved consent decrees without fair hearings for those whose interests are at stake. Professor Schwarzschild suggests a systematic procedure for approving Title VII consent decrees. This procedure would not discourage settlements, but would ensure that courts act on the basis of fair hearings, consistently with the quasi-legislative character of public law remedies

    THE EFFECT OF TITLE I OF THE 1949 FEDERAL HOUSING ACT ON NEW YORK CITY COOPERATIVE AND CONDOMINIUM CONVERSION PLANS

    In 1985, three Manhattan housing projects were in litigation to convert the units from rental to condominiums or cooperative ownership. However, each project\u27s redevelopment agreement, consistent with Title I of the 1949 Federal Housing Act, required that no change be made without consent of the City Planning Commission and the Board of Estimates of the City. This Note analyzes whether the conversion of rental units built under Title I to ownership units constitutes a change as interpreted by the New York courts. The interpretation of the term change under the Title I redevelopment agreements will be analyzed from both the City of New York\u27s and the private developer\u27s views. In addition, the legislative purposes behind Title I\u27s enactment will be examined from the perspectives of both the City of New York and the private developer. Finally, the current status of Title I will be discussed. This Note concludes that a change, for purposes of New York City redevelopment agreements drafted pursuant to Title I, refers only to land use and density and does not relate to the form of ownership. Therefore, city approval should not be required for a Title I building to convert to condominium or cooperative status
