    Rethinking sociotechnical transitions and green entrepreneurship : the potential for transformative change in the green building sector

    This paper explores the development of green entrepreneurship and its potential role in transformative change towards a green economy. It achieves this through a study of the green building sector in England and Wales, based on qualitative empirical data from fifty-five semistructured interviews with businesses in the green building sector and with support organisations, including banks, financial sources, and business advice and support. The paper both critiques and synthesises two bodies of literature-entrepreneurial research and sociotechnical transitions theories, specifically the multilevel perspective (MLP)-to better understand the role of green entrepreneurs in facilitating a shift towards a green economy. This analysis embeds green entrepreneurs in a wider system of actors, rather than reifying the lone entrepreneurial hero, in order to explore how green entrepreneurs facilitate sustainability transitions. The paper challenges the notion that green entrepreneurs are an unproblematic category. We discovered that individuals move between 'green' and 'conventional' business, evolving over time, such that this is a fluid and blurred, rather than static, state. Moreover, while the green economy and the green building sector are often referred to as coherent sectors, with agreed and consistent practices, our evidence suggests that they are far from agreed, that business models vary, and that there are significant contradictions within so-called green building practices. The paper contributes to the development of sociotechnical transitions theory and suggests that the MLP needs to incorporate complexity and multiplicity within niches, that niches may be inherently co nflictual rather than consensual, and that the concept of 'protection' for niches is problematic. © 2014 Pion and its Licensors

    Food for Thought: Genetically Modified Seeds as De Facto Standard Essential Patents

    For several years, courts have been improperly calculating damages in cases involving the unlicensed use of genetically-modified (GM) seed technology. In particular, when courts determine patent damages based on the hypothetical negotiation method, they err in exaggerating these damages to a point where no rational negotiator would agree. In response, we propose a limited affirmative defense of an implied license due to the patent’s status as a de facto standard essential patent. To be classified as a de facto standard essential patent, the farmer must prove three elements that reflect the peculiarities of GM seeds used in farming: (1) dominance, (2) impracticability, and (3) necessary to fulfill a basic need. Based on the approaches used by courts and standard setting organizations in licensing standard essential patents in technological fields such as cell phones and software, designation of some GM seeds as standard essential patents allows the courts to imply a license from patentees to farmers on reasonable and non-discriminatory (RAND) terms. Doing so shifts the case from a tort-based patent infringement suit to a breach of contract dispute and alters the damages regime from one based in compensation, deterrence, and punishment (a tort approach) to one based solely in compensation (a contractual approach). As a result of this novel proposal, the damages calculations in these suits return to economic reality

    Integrating a larger set of instruments into Rural Development Programmes implied an increasing focus on monitoring and evaluation. Against the highly diversified experience with regard to implementation of policy instruments the Common Monitoring and Evaluation Framework has been set up by the EU Commission as a strategic and streamlined method of evaluating programmes’ impacts. Its indicator-based approach mainly reflects the concept of a linear, measure-based intervention logic that falls short of the true nature of RDP operation and impact capacity on rural changes. Besides the different phases of the policy process, i.e. policy design, delivery and evaluation, the regional context with its specific set of challenges and opportunities seems critical to the understanding and improvement of programme performance. In particular the role of local actors can hardly be grasped by quantitative indicators alone, but has to be addressed by assessing processes of social innovation. This shift in the evaluation focus underpins the need to take account of regional implementation specificities and processes of social innovation as decisive elements for programme performance.

    Moving Forward on Racial Justice Philanthropy

    This is the fifth volume of the Critical Issues Forum series, which aims to deepen the discourse around important progressive racial justice issues within philanthropy. As PRE celebrated our 10th anniversary last year and engaged allies within the nonprofit and philanthropic sectors to mark the occasion with us, we heard "Have you seen any progress?" repeatedly and knew it was important to take stock of what many of us have been collectively aiming to move for decades. Through focus groups, webinars and direct interviews, our team has sought to get a strong sense of both funders' and activists' perspectives on progress particularly over the past two decades. We have heard real frustration, especially as the needs are so critical and the level of urgency among activists and communities is so high. However, in spite of these very real concerns, we have also seen clear commitment and depth of understanding in other quarters. We are pleased that through funder case studies and activist essays about structural racism analysis, intersectionality and media justice, we're able to share real progress, even as each piece recognizes there is still much more to be done
