    Objective. The majority of the services offered by public libraries are involved in copyright. This work has the aim to find out, based on the content analysis of the services charts, whether the existing relationships between the services offered and the copyright involved are properly identified and whether this is adequately communicated to the users as required by the quality management regulation. Design/Methodology/Approach. It is based on the location of the services charts of the Spanish public libraries. A sample is selected for the qualitative analysis including a wide variety of libraries. Out of these, as a first approach to the study of the subject, only the services and information of general nature are analysed. The following aspects are also checked: the existence of references to the regulations on copyright; the mechanisms available for the citizen to communicate with the library and participate in its management; and the services offered and the legal consequences for the citizen, what should be reflected on the content of the services charts. Results/Discussion. The results bring to light the fact that the references to copyrights in the services charts of the Spanish public libraries are scarce, either regulations or matters of general nature or specific regarding their application to the services provided to users. Conclusions. This work exposes that the services offered by public libraries have numerous copyright implications but that these do not seem to be properly identified for their inclusion in the services charts. The conclusions specify what sort of information is gathered in this respect and which way. Originality/Value. The majority of the services offered by public libraries are involved in copyright. However, this is an insufficiently studied field. In addition, these implications have increased in number and complexity with the development of the digital environment. On the other hand, the application of the quality management and the rules derived from this compels the public libraries to elaborate quality tools with the purpose of facilitating the communication between the institution and the citizens, in particular, the services charts. Thus, a study of this nature is of interest

    Los problemas que el gran desarrollo de la información digital e Internet están provocando al derecho de autor se están intentando solucionar a través de tres vías: legislativa, tecnológica y contractual. La protección proporcionada a las obras con derecho de autor mediante medidas tecnológicas complementa a las condiciones de uso establecidas en las licencias y, además, ambos tipos de protección están respaldados por las nuevas leyes surgidas para adaptarse al nuevo contexto tecnológico. Como resultado de esta triple protección se están poniendo en grave peligro las excepciones y limitaciones a los derechos de autor reconocidas por las leyes de derecho de autor para beneficiar a las bibliotecas, sus usuarios y los ciudadanos en general, dando lugar a una fuerte y peligrosa privatización del acceso a la información

Con este trabajo se pretende comprobar, a partir del análisis del contenido de las cartas de servicios, si reflejan los derechos de autor que pueden afectar a los servicios ofrecidos y si informan de ello a sus usuarios, como exige la normativa sobre gestión de la calidad.Diseño/Metodología/Enfoque. Se parte de la localización de las cartas de servicios de las bibliotecas públicas españolas y se selecciona una muestra para el análisis cualitativo que incluye una amplia variedad de bibliotecas; de ellas, como primera aproximación al estudio del tema, se analizan los servicios y la información de tipo general. También, se comprueban los siguientes aspectos: la existencia de referencias a la normativa sobre derechos de autor; los mecanismos a disposición del ciudadano para comunicarse con la biblioteca y participar en su gestión; y las implicaciones legales para el ciudadano de los servicios ofrecidos, lo cual debería tener su reflejo en el contenido de las cartas de servicios.Resultados/Discusión. Los resultados ponen de manifiesto que en las cartas de servicios de las bibliotecas públicas españolas son muy escasas las referencias a los derechos de autor, ya sea la legislación o las cuestiones de carácter general o específico de su aplicación a los servicios prestados a sus usuarios.Conclusiones. Este trabajo pone de manifiesto que los servicios que ofrecen las bibliotecas públicas tienen numerosas implicaciones para los derechos de autor, pero no parecen haber sido debidamente identificados para ser incluidos en las cartas de servicios. En las conclusiones se especifica qué tipo de información se recoge al respecto y de qué modo.Originalidad/Valor. La mayor parte de los servicios que ofrecen las bibliotecas públicas tienen implicaciones para los derechos de autor, y sin embargo es un tema poco estudiado, además estas implicaciones se han visto afectadas por el desarrollo del entorno digital. Por otra parte, la aplicación de la gestión de la calidad y las normas que derivan de ella obligan a que las bibliotecas públicas elaboren instrumentos de calidad cuyo objetivo sea facilitar la comunicación de la institución con el ciudadano, en concreto, las cartas de servicios.     Protecting Copyright in the Digital Era in China: A Critical Analysis of the Relevant Law and Practice from a Comparative Perspective

    China, as the birthplace of several great inventions, is no stranger to creativity, and, indeed, innovation. That said, while the notion of copyright has for a long time been recognised as being essential to the protection of Chinese inventions, it is perhaps regrettable that the existing system of copyright protection in that country remains largely inefficacious, at least when compared to western countries, in terms of addressing the key challenges and complexities posed by the rapid developments that characterise the digital age. It is against this backdrop that this thesis has been conceptualised; the overarching aim, in this regard, being to assess the development and nature of copyright protection in China, from a comparative perspective, in an effort to unearth the challenges that arise in the digital age, and to proffer suggestions for reform in this regard. More specifically, through the adoption of the doctrinal, historical and comparative methodologies, this thesis examines the historical evolution of copyright protection in China, and argues that while there has been some progress in recent years in terms of copyright protection that commensurate with China's economic development and international obligations, a number of outstanding issues remain unresolved, especially with regard to striking the right balance between competing interests. The thesis also evaluates the role of emerging technologies, such as peer-to-peer technology, and argues that China has struggled to address many of these challenges associated therewith, notwithstanding the progressive approaches countenanced by other jurisdictions. The thesis argues that one of the main challenges that account for the existing inadequacy that characterises China's system of copyright protection is the country's very history and culture, which do not ascribe a high degree of primacy to the exclusive rights of copyright owners. History and culture, among other, mostly legal, factors, might also account for the currently high levels of uncertainty that characterise the construction of secondary liability in relation to ISPs in China. Apart from assessing the uncertainties associated with secondary liability, however, the thesis will also examine the complexities and challenges that surround the use of emerging technologies, such as technological protection measures, that aim to protect copyright in the digital era, and argues that while these challenges are real, they are not at all insurmountable. Against this backdrop, pragmatic solutions, drawing largely from other jurisdictions, are provided throughout this thesis

These offences also come with procedural issues of enforcement of the existing legislations and continue to subject nations with problems unprecedented to its sovereignty and jurisdictions. This research is a critical study on the legal aspects of cybercrime in Nigeria, which examines how laws and regulations are made and applied in a well-established system to effectively answer questions raised by shortcomings on the implementation of cybercrime legislations, and critically reviews various laws in Nigeria relating or closely related to cybercrime. This research will provide insight into current global cybercrime legislations and the shortfalls to their procedural enforcement; and further bares the cybercrime issues in Nigeria while analysing and proffering a critique to the provisions as provided in the recently enacted Nigerian Cybercrime (Prohibition and Prevention) Act 2015, in contradistinction to the existing legal framework in the United Kingdom and the other regional enactments like the Council of Europe Convention on Cybercrime, African Union Convention on Cybersecurity and Personal Data Protection 2014, and the ECOWAS Directive on Cybercrime 2011

    Ebooks : challenges and effects on the book chain

    Ebooks have the potential to change the way we read but the ebook industry is not growing as it could be because it is faced with a number of challenges. The British fiction book market struggles as it grows with no clear idea of how each of the book chain areas is challenged by the effect of them. There is the need to identify these effects and challenges faced by the book chain both in the individual areas and the book chain as whole. By identifying these effects and challenges, the British ebook community can address them and grow with the knowledge and assurance that they are working together towards a successful book future. This thesis aimed to investigate what these challenges and effects were and the differences between the ebook and pbook chains. Three specific stakeholders from the book chain were investigated: publishers, libraries and ebook users. The research methods used to obtain information included interviews with publishers both in America and Britain, a telephone questionnaire of all British public library authorities and an online questionnaire available to an international audience of ebook users. The research found that the pbook and ebook chains were different and included different stakeholders. It also found that the publishing processes between pbooks and ebooks had numerous similarities and differences. The effects and challenges for all stakeholders were discussed in relation to the five key areas that had become apparent from the original research and literature; rights, cost, formats, perceptions and knowledge. The fiction ebook market will continue its slow growth until the time that either some of these challenges can be rectified or they become so problematic that the ebook fiction market fails completely.EThOS - Electronic Theses Online ServiceGBUnited Kingdo
