    [Excerpt] In establishing their Agreement on Labor Cooperation as a complement to the North American Free Trade Agreement, the governments of Canada, the United States and Mexico accepted the fact that each nation had evolved a different system of labor law and administration. They agreed that those systems should continue to evolve independently within each sovereign jurisdiction. But they also recognized the extremely important fact that these three systems were based on underlying principles which were held in common and which could be articulated. These are the 11 Labor Principles of the NAALC. Each principle defines a sector of labor law, which is given concrete expression by the statutes and jurisprudence of the different jurisdictions. The parties to the NAALC undertake solemn obligations to ensure that their laws in these sectors are effectively enforced. Thus all competitors in the North American Free Trade area will operate under the law in regard to labor matters, administered openly and consistently. Such is a major objective of the NAALC. The objective of this publication by the Commission for Labor Cooperation is to enable the public at large in North America, and not just specialists in comparative labor law, to know simply and clearly what those different labor law regimes are and how they are administered. The NAALC relies primarily on the public to draw attention to any deficiencies which may occur in regard to labor law administration. It is thus imperative that the public have ready access to the content of the laws and how they are meant to apply, organized following the schema of the NAALC

    Enforceability of knock-for-knock indemnities in oilfield service contracts in Thailand

    This research addresses the issue of enforceability of mutual indemnity and hold harmless clauses (MIHH) pertaining to bodily injury and death in oilfield service contracts in Thailand. Thai Unfair Contract Terms Act B.E. 2540 (A.D. 1997) (“TUCTA”) prohibits a contracting party to restrict or exclude liabilities pertaining to bodily injury and death arising from his negligence. This restriction might be thought to have an effect of hampering the risk allocation. Similar restriction contains under the Unfair Contract Terms Act 1977 (“UCTA”). However, by virtue of the Supreme Court decision in Farstad Supply A/S VS Enviroco Ltd [2011] UKSC 16, the MIHH could be enforceable despite the restriction. Nevertheless, the IMHH will be subject to the reasonableness test under UCTA. Thus, it could be argued that in spite of the restriction under TUCTA, the IMHH in standard form oilfield service contracts e.g., LOGIC could still be enforceable in Thailand, subject to certain limitations

    Self-stabilizing tree algorithms

    Designers of distributed algorithms have to contend with the problem of making the algorithms tolerant to several forms of coordination loss, primarily faulty initialization. The processes in a distributed system do not share a global memory and can only get a partial view of the global state. Transient failures in one part of the system may go unnoticed in other parts and thus cause the system to go into an illegal state. If the system were self-stabilizing, however, it is guaranteed that it will return to a legal state after a finite number of state transitions. This thesis presents and proves self-stabilizing algorithms for calculating tree metrics and for achieving mutual exclusion on a tree structured distributed system

    This research report explores how ‘sustainable livelihoods’ have been achieved at a model cooperative using the ‘System of Rice Intensification’ named SIMPATIK. To conduct the research a novel template was developed. The framework was required following a review of sustainable livelihood literature which found deficiencies with the ‘sustainable livelihoods framework’, particularly its treatment of equity, social capital, culture and agro-ecology which disqualified the framework as an appropriate approach for the research. Amekawa’s (2011) ‘Integrated Sustainable Livelihoods Framework’ which synthesises agro-ecology and the sustainable livelihoods framework is then discussed. Further work is then presented on social capital which this paper argues has a critical role in facilitating access to livelihood capitals. A discussion of the significance of culture then follows to underline its importance as a form of livelihood capital. The research then introduces an operational model that is appropriate to the local cultural, institutional and geographical context to demonstrate how livelihood capitals are linked to livelihood outcomes, a model I have labelled the ‘Apt-Integrated Sustainable Livelihoods Framework’. This framework is then informed through field research at the SIMPATIK co-operative. Impact pathways through ‘synergetic forms of social capital’ and the System of Rice Intensification (SRI) are shown indeed to lead to sustainable livelihood outcomes for research participants. The ‘sequencing’ of livelihood capitals is seen to be critical and the research culminates in the development of a ‘SRI Co-operative Template for Sustainable Livelihoods’; a transferable model that shows how SRI can be promoted as a sustainable livelihood strategy

    Silky-feather has been selected and fixed in some breeds due to its unique appearance. This phenotype is caused by a single recessive gene (hookless, h). Here we map the silky-feather locus to chromosome 3 by linkage analysis and subsequently fine-map it to an 18.9 kb interval using the identical by descent (IBD) method. Further analysis reveals that a C to G transversion located upstream of the prenyl (decaprenyl) diphosphate synthase, subunit 2 (PDSS2) gene is causing silky-feather. All silky-feather birds are homozygous for the G allele. The silky-feather mutation significantly decreases the expression of PDSS2 during feather development in vivo. Consistent with the regulatory effect, the C to G transversion is shown to remarkably reduce PDSS2 promoter activity in vitro. We report a new example of feather structure variation associated with a spontaneous mutation and provide new insight into the PDSS2 function
