    Part I of this Note will briefly outline Community policy on product liability as detailed by the Product Liability Directive, then review the development of product liability law in various Member States of the European Community. Part II will analyze how the concept of state-of-the-art highlighted tensions between a strict liability regime and a negligence regime in U.S. product liability. It will then review similar discord in the European Community caused by the development risk defense. Finally, Part III of this Note will argue that in contrast to the United States, the European Community has thus far chosen to stay true to the strict product liability label in its implementation of the development risk defense

    U.S. Software Protection: Problems of Trade Secret Estoppel under International and Brazilian Technology Transfer Regimes Note

    This note describes the fundamental aspects of software protection and applies the requisites of U.S. trade secret protection to software. After explaining how the UNCTAD and Brazilian transfer of technology regimes apply to software licensing arrangements, this note argues that software distribution under these regimes estops U.S. trade secret protection by defeating the requisites of secrecy and competitive advantage. Specifically, the effects of the UNCTAD Draft International Code of Conduct on the Transfer of Technology (UNCTAD Code) and the Brazilian technology transfer regulations are analyzed to demonstrate the difficulties posed by legal regimes being considered and already in force in a number of developing countries. This note concludes with an analysis of some of the possibilities for protection of trade secrets with international softward distribution

    Capacity gaps in post disaster construction & demolition waste management

    Purpose – The purpose of this paper is to focus on the identification of the existing capacities of post disaster C & D waste management in developing countries, with a special emphasis on Sri Lanka to determine the capacity gaps and related influencing factors. Design/methodology/approach – Multiple case studies and expert interviews were conducted to gather primary information on the existing capacities of disaster C & D waste management. Three case studies, including 15 individuals and six experts representing government, non-government institutions and others, were selected. Findings – The results revealed the existing capacities, capacity gaps and influencing factors for post disaster C & D waste management in the areas of skills and confidence building, links and collaborations, continuity and sustainability, research and development, communication and coordination, organisational implementation and investment in infrastructure. Research limitations/implications – This study limited disaster C & D waste to debris generated from totally or partially damaged buildings and infrastructure as a direct impact of natural disasters or from demolished buildings and infrastructure at rehabilitation or at early recovery stages. Originality/value – The research enabled an analysis of existing capacities and identified capacity gaps in post disaster C & D waste management with influencing factors developing countries

    Rotor burst protection program: Experimentation to provide guidelines for the design of turbine rotor burst fragment containment rings

    Empirical guidelines for the design of minimum weight turbine rotor disk fragment containment rings made from a monolithic metal were generated by experimentally establishing the relationship between a variable that provides a measure of containment ring capability and several other variables that both characterized the configurational aspects of the rotor fragments and containment ring, and had been found from exploratory testing to have had significant influence on the containment process. Test methodology and data analysis techniques are described. Results are presented in graphs and tables
