Indians, Race, and Criminal Jurisdiction in Indian Country
With the possible exception of the Indian Major Crimes Act, the classification of âIndianâ for the purposes of the ICCA and the Duro Fix is not âracialâ even if it includes non-enrolled people of Indian ancestry with significant connections to tribal communities. Furthermore, although the first prong of the Rogers test should be eliminated on policy grounds, the holding of the Zepeda court that the first prong could be satisfied by proof of blood quantum from any Indian tribe, recognized or not, is highly suspicious, seems to be arbitrary, and boosts the argument that the classification of âIndianâ in such cases is a racial classification. Acknowledging the problems plaguing current law enforcement on Indian reservations, this article has endorsed a position which would allow Indian tribes to determine the meaning of âIndianâ for the purpose of the Duro fix. The Article also argued that the universe of âIndiansâ for the purpose of federal jurisdiction should be limited to enrolled tribal members and those eligible for such membership unless the relevant tribe has enacted precise standards delineating who is an Indian for the purpose of federal jurisdiction on its reservation

Load Balancing and Virtual Machine Allocation in Cloud-based Data Centers
As cloud services see an exponential increase in consumers, the demand for faster processing of data and a reliable delivery of services becomes a pressing concern. This puts a lot of pressure on the cloud-based data centers, where the consumersâ data is stored, processed and serviced. The rising demand for high quality services and the constrained environment, make load balancing within the cloud data centers a vital concern. This project aims to achieve load balancing within the data centers by means of implementing a Virtual Machine allocation policy, based on consensus algorithm technique. The cloud-based data center system, consisting of Virtual Machines has been simulated on CloudSim â a Java based cloud simulator

Hebrew nu: Grammaticization of a Borrowed Particle from Synchronic and Diachronic perspectives
Hebrew nu is a non-referential item borrowed into the language in the early days of revival of spoken Hebrew, as is the case for many discourse markers (Schiffrin 1987) in language contact situations (e. g., Brody 1987; Maschler 1988, 1994,2000; Salmons 1990; Matras 1998). Even-Shoshanâs dictionary (2003) classifies it as an interjection and provides the information that nu was âimported from the European languagesâ, which could be understood as mainly Russian (nu),Yiddish (nu), and possibly Polish (no). Even-Shoshan provides the meanings \u27efo (âthereforeâ), hava (âlet usâ), uvxen (âwell thenâ) â all words of rather high register. To these meanings, another dictionary (Avneyon 1998) adds a colloquial use: milat zeruz (âan urging wordâ) and provides the example: nu kvar, bo! hasha\u27a me\u27uxeret! (ânu already, come! Itâs late!â)
Symposium on World tuna fisheries: commemorating the 50th anniversary of the establishment of the Inter-American Tropical Tuna Commission
The Inter-American Tropical Tuna Commission (lA TTC) came into existence in 1950, after its convention,
signed by representatives ofCosta Rica and the United States in 1949, was ratified. It was the first international tuna organization, and only the third international fisheries organization, whose staff has had the responsibility for performing scientific research, the others being the International Pacific Halibut Commission, established in 1923, and the International Pacific Salmon Fisheries Commission, established in 1937. The current members of the IATTC are Costa Rica, Ecuador, EI Salvador, France, Guatemala, Japan, Mexico, Nicaragua, Panama, the United States, Vanuatu, and Venezuela. The first Director ofthe IATTC was Dr. Milner B. Schaefer, who was in that position from 1950 to 1963. He was followed by Dr. John L. Kask (1963-1969), Dr. James Joseph (1969-1999), and Dr. Robin L. Allen (1999-present). The success ofthe IATIC showed that it was possible to carry out research and management on an international, high-seas fishery successfully. Since then other international organizations for tuna management, including the International Commission for the Conservation of Atlantic Tunas (1969), the Forum Fisheries Agency (1979), the Commission for the Conservation of Southern Bluefin Tuna (1994), and the Indian Ocean Tuna Commission (1996), were established. Appropriately, the 50th anniversary celebration was held in Costa Rica, one of the two charter members of the IATTC. Persons who have held important positions in international fishery management in various parts ofthe world spoke at the celebration. Their presentations, except for that describing the Indian Ocean Tuna Commission, are reproduced in this volume

(Bennie) van der Walt traces his own intellectual development, indicating the many people and different circumstances during the previous century that influenced his shaping into a Christian philosopher. These memoirs are done not in the traditional, typical academic curriculum vitae style, but simply in telling his personal story about understanding reality. His journey through different seasons develops from his early childhood up to the age of 70. He also provides a brief evaluation of his own publications. In his review of the past he recognises the hand of his Father in heaven. He now hands over the torch of reformational philosophy to the present generation. Finally he looks ahead, expecting another journey (that will be both continuous and discontinuous compared to the present) on a new earth

Their relative representativeness legitimises their right to be consulted, their role and effective participation in the European sectoral social dialogue, and their capacity to negotiate agreements. The aim of Eurofound's representativeness studies is to identify the relevant national and European social partner organisations in the field of industrial relations in selected sectors in the EU Member States. This study identified the European Cleaning and Facility Services Industry (EFCI) (representing employers) and UNI Europa (representing employees) as the most representative European-level social partner organisations in the industrial cleaning sector
