DIVORCE OF MARRIAGE-FACTORS AND PROBLEMS
AbstractModern society has led to fundamental changes in the institution of marriage and itssurvival. The diminishing importance of morals and values to be promoted by family lawhas led to the destabilization of marital and family relations. This has led to a decrease in thenumber of marriages, an increase in the number of extramarital affairs, illegitimate childrenand an increase in the number of divorces.But divorce is never based on one factor or cause. It is a sublime of many influencesof various nature. In the elaboration of the paper, the author will emphasize the sociologicalfactors that have an impact on the divorce. The disintegration of the traditional family modeland the emergence of the modern model, led to changing the roles of family members,increasing the equality of women and changing the position of children, which significantlyaffects the stability of marriages. Economic problems, domestic violence are the reasons forthe increase in the divorce rate and the transformations in the emotional and sexual relations,have led to the emergence of heterogamous and homogeneous marriages.As it is in the nature of people to merge and form communities, so over time andchanges in society and the separation of people from married communities becomes normaland natural. Divorce grows into an opportunity to push the boundaries of human happinessand expand human freedoms.By analyzing the factors, the author will try to clarify the reasons that influence theincrease of this current trend which unfortunately will undoubtedly continue in the future
COMPARATIVE ANALYSIS OF CONSEQUENCES AND CHANGES IN THE SYSTEMS OF DIVORCE IN THE WORLD AND REPUBLIC OF NORTH MACEDONIA
The dynamic lifestyle, altered value models of behavior in people, mobility of the population, hedonistic way of life and the liberal view of divorce, result in the realization of personal needs and interests, before those of the family, which undoubtedly affect the galloping number of divorces in the past few decades. Divorce as a social phenomenon that exists in many cultures around the world, a state in which no society and state is immune to its occurrence.
The divorce is an important topic for analyzing from aspect of the consequences, as well as the occurrence of changes in the family system. The legal regulation of divorce is closely related to the historical, moral, economic, cultural and religious circumstances that were dominant in certain periods of their history of their history.
In this paper we will consider and study the various systems of divorce in the world as well as in the Republic of North Macedonia in order to draw appropriate conclusions and recommendations for further research
