    Contemporary Problems of the Codification of Civil Procedural Law

    The author considers the issue of whether the postulate of creating a new code of civil procedure is still valid. He comes to the conclusion that the following arguments support the new codification: the poor state of the current Code of Civil Procedure and the need to take into account the challenges facing civil procedural law like constitutionalization, Europeanization and digitalization of this law, as well as the creation of new solutions to protect collective interests. However, he indicates, as obstacles to the preparation of the new code, the collapse of the culture of creating law in Poland, problems resulting from changes in the justice system and threats resulting from legal populism

    This article examines the judgment intervening effect. It is an effect of a judgment issued in the dispute in which third-party intervened in support of a party to that dispute or in which third party acceded to the dispute upon notice. That effect operates in further proceeding between an intervenor and supported party or between summoned party and party who filled a notice. The judgment intervening effect has a procedural nature and may not be disposed by parties. Upon that effect judgment’s sentence and its factual and legal grounds are binding. The effect operates to the benefit as well as to the detriment of involved parties. Judgment intervening effect is taking into consideration ex officio and may be waived in exceptional circumstances

    [Abstrakt tylko w j. niemieckim / Abstract only in German] Einige Anmerkungen Bezüglich der Internationalen Zuständigkeit für Deliktsklagen im Europarecht Im Artikel wird die Frage der internationalen Zuständigkeit für Deliktsklagen gemäß Art.5 Nr.3 der Verordnung Nr.44/2001 des Rates vom 16. Dezember 2000 über die gerichtliche Zuständigkeit und die Anerkennung und Vollstreckung von Entscheindungen in Zivil- und Handelssachen erörtert. Es wird das Problem besprochen, wo der zuständigkeitsbergründende Ort liegt, an dem der Schaden eingetreten ist, wenn es um sog. mittelbar Geschädigte geht. Der Autor vertritt die Meinung, dass die geschädigten Verwandten eines Unfallopfers ihre Ansprüche nur am Unfallort oder am Wohnsitz des Beklagten geltend machen können, nicht aber dort, wo für sie selbst ein Schaden entstanden ist. The article discusses the question of international jurisdiction for actions under Article 5 (3) of Council Regulation No 44/2001 of 16 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters. It discusses the problem of where the jurisdiction over which the damage occurred when dealing with so-called indirectly injured parties. The author is of the opinion that the injured relatives of an accident victim can assert their claims only at the scene of the accident or at the domicile of the defendant, but not where damage has been caused to them

    This paper describes the influence, which had already been exerted, and which is still exerted by the Russian Civil Judicial Proceedings Act of November 20, 1864 (CJPA) on the Polish civil proceedings. First, the authors present the history of CJPA’s presence in the Polish territories. Next, they discuss the general significance of this act and its solutions for the process of shaping the Polish civil procedure in the interwar period. Finally, they present selected examples of the regulations and solutions that demonstrate the CJPA’s impact on the Polish civil proceedings. The authors conclude that CJPA exerted a minor impact on the pre-war and present Polish procedural regulations in comparison to the other codes, i.e. the Austrian and German codes. Even today, however, one can find in the Polish Code of Civil Procedure some provisions patterned after the CJPA

В первую очередь, авторы раскрывают историю применения Устава на территории Польши. Затем, обсуждается общее значение данного Устава и его роль в процессе формирования польского гражданского судопроизводства в межвоенный период. И, наконец, авторы приводят отдельные примеры предписаний, которые наглядно показывают влияние, оказываемое Уставом на гражданское судопроизводство в Польше. Авторы приходят к выводу о том, что Устав оказал на польское гражданское судопроизводство довоенного периода не такое большое влияние, как законодательные акты Австрии и Германии. Однако, даже сегодня в Гражданском Процессуальном Кодексе Польши можно обнаружить положения, перенятые из данного Устава
