    The Contextualization of Islamic Law in the Pandemic Period through Fiqhiyyah Rules in the MUI Fatwa No. 14 of 2020 as an Effort to Re-actualize the Concept of Religious Moderation

    This paper aims to analyze the efforts to re-actualize the concept of religious moderation during a pandemic through the contextualization of Islamic law by applying the principles of fiqhiyyah in MUI Fatwa No. 14 of 2020. This research applies a descriptive-normative approach, with conclusions using inductive and deductive thinking methods. The results of the study stated that there had been stagnation in the implementation of community diversity during the pandemic by rejecting the recommendation to carry out physical distancing through government regulations and MUI Fatwa No. 14 of 2020, even though this Fatwa is part of the relevant efforts of Islamic law to negotiate with situations and conditions. at the same time adapting to align the text and the context of reality at that time. So through the principles of fiqh which are contained in the substance of the fatwa as a knife of analysis, it is practically clear that Islamic law is an instrument that directs people to the concept of Rahmatan Lil Alamin and in accordance with the principles of Sholihul Likulli at the time of Wal Makan.This paper aims to analyze the efforts to re-actualize the concept of religious moderation during the Covid-19 pandemic through the contextualization of Islamic law by applying the principles of fiqhiyyah based on MUI Fatwa No. 14 of 2020.     Penelitian ini bertujuan membahas realita Implementasi hak mendapatkan pendidikan narapidana di Lapas Kelas IIA Kota Gorontalo, dan kendala yang muncul dalam pelaksanaan hak narapidana untuk mendapatkan pendidikan. Metode yang digunakan dalam penelitian ini adalah metode kualitatif, dengan yang bersifat deskriptif analitik dan preskriptif yaitu menguraikan secara deskriptif Hak narapidana dalam mendapatkan pendidikan menurut hukum pidana positif dan hukum pidana islam, selain itu dalam penelitian ini juga menggunakan pendekatan yuridis empiris, yang nantinya dapat dipergunakan untuk memandang permasalahan dari sudut pandang yang berbeda, yaitu dari sudut pandang penelitian hukum dan yang berdasarkan dari fakta-fakta yang nantinya dapat ditemui di lapangan dengan menggunakan metode pengumpulan data berupa observasi, wawancara, dan dokumentasi. Hasil penelitian ini mengantarkan penulis pada beberapa kesimpulan sebagai berikut: 1) Implementasi pemenuhan hak pendidikan yang dilakukan pihak Lapas Kelas IIA Kota Gorontalo berorientasi pada pembinaan yang senantiasa menetapkan target dalam menjalankan fungsinya, dengan tujuan guna dapat melahirkan kesadaran (consciousness) dalam diri warga binaan, terbukti dengan 38 orang warga binaan yang mengikuti program kejar paket A dan Program sarjana S1 Tata Negara Fakultas Syariah IAIN Sultan Amai Gorontalo. 2) Faktor penghambat pemenuhan hak untuk mendapatkan pendidikan di Lembaga Pemasyarakaan Kelas IIA Kota Gorontalo meliputi : Manajemen waktu yang kurang efektif, Jumlah para pengajar yang terbatas, Latar belakang pendidikan dan kemauan narapidana yang sangat rendah, Over kapasitas jumlah narapidana, sarana dan prasana yang kurang memadai

    This research explores the values of da'wah within the marriage tradition of Pohutu Moponika in Gorontalo, serving as a platform for disseminating religious values. It employs a qualitative approach and a case study methodology. Findings indicate that the processes within Pohutu Moponika reflect principles of Islamic teachings and local wisdom, such as justice, balance, communication, mutual understanding, and sincerity in marriage. These processes also highlight other values aligned with Islamic teachings, such as willingness to communicate, etiquette, morality, goodwill, and honesty in interactions. The Pohutu Moponika tradition also encompasses values of cultural preservation, respect for family, commitment, interfaith harmony, and seriousness in marriage. The marriage processes within the Pohutu Moponika tradition serve as an effective medium for actualizing the values of Islamic da'wah in everyday life. These values can strengthen the foundation of families, promoting harmony in accordance with Islamic teachings and the local traditions of Gorontalo society.Penelitian ini mengeksplorasi nilai-nilai dakwah dalam tradisi perkawinan Pohutu Moponika di Gorontalo, yang menjadi wahana dakwah dalam penyebaran nilai-nilai keagamaan. Penelitian ini menggunakan pendekatan kualitatif dan studi kasus. Hasilnya menunjukkan bahwa prosesi-proses dalam Pohutu Moponika mencerminkan prinsip-prinsip ajaran Islam dan kearifan lokal, seperti keadilan, keseimbangan, komunikasi, kesepahaman, dan keikhlasan dalam pernikahan. Prosesi-proses tersebut juga menyoroti nilai-nilai lain yang sejalan dengan ajaran Islam, seperti kerelaan berkomunikasi, adab, kesusilaan, niat baik, dan kejujuran dalam berinteraksi. Tradisi Pohutu Moponika juga mengandung nilai-nilai konservasi budaya, hormat kepada keluarga, komitmen, kerukunan antar-umat beragama, dan keseriusan dalam pernikahan. Prosesi pernikahan dalam tradisi Pohutu Moponika menjadi medium dakwah yang efektif dalam mengaktualisasikan nilai-nilai dakwah Islam dalam kehidupan sehari-hari. Nilai-nilai tersebut dapat memperkokoh fondasi keluarga yang kokoh dan harmonis, sesuai dengan ajaran Islam dan tradisi lokal masyarakat Gorontalo

    Abstract Islamic law is one of the important instruments that cannot be denied its existence and validity in Indonesia, history clearly records that its emergence was not just spontaneity, but was also colored by the tidal process of political struggle between Islamic intellectuals and state elites at the time, not with the exception of Law No. 1 of 1974 concerning Marriage which in memorandum bene is also in the vortex of the transformation. Al-Siyasah Al-Ahkam Al-Usrah or Islamic family law politics, is a process of achieving the vision and aspiration to form a "national" marriage law, in fact it has been initiated since 1950. In the past renewal of marriage law has always met with failure due to Subjects and objects governed by marriage law are closely related to social and religious life, which are not easy to integrate. This means that the renewal of the national marriage law must be done carefully, so as not to cause disappointment for other groups of the population. The formation of the Marriage Law has a very long process and is then deliberated seriously with the contents of the Draft Law on Marriage, so that it can accommodate the aspirations of the people and provide a technically juridical formulation, and all this again is inseparable from the political atmosphere and intervention that occurred at that time.     Tinjauan Hukum Islam Terhadap Problematika Investasi Haji Pada Masa Pandemi Virus Covid-19

    Penelitian ini bertujuan untuk melihat bagaimana tinjauan hukum islam terhadap pemanfaatan dana haji untuk investasi di masa pandemi menggunakan konsep maslahah sebagai pisau analisis. penelitian ini menggunakan jenis penelitian kualitatif, dengan metode kepustakaan (library research). Adapun tahapan-tahapan pengolahan dan analisis data yaitu: 1) Pengeditan, 2) Klasifikasi, 3) Verifikasi, 4) Analisis, dan 5) Penarikan kesimpulan. Hasil penelitian menyatakan bahwa pemanfaatan dana haji untuk pembangunan infrastruktur melalui investasi dimasa wabah covid-19 secara maslahah diperbolehkan selama tidak melanggar ketentuan syariat dengan melakukan maksiat berupa riba, gharar, maysir,tadlis. This study aims to see how a review of Islamic law on the use of Hajj funds for investment during a pandemic uses the concept of maslahah as a tool of analysis. This research uses a qualitative research type, with a library research method. The stages of data processing and analysis are: 1) Editing, 2) Classification, 3) Verification, 4) Analysis, and 5) Drawing conclusions. The results of the study state that the use of hajj funds for infrastructure development through investment during the Covid-19 outbreak is maslahah allowed as long as it does not violate the provisions of the Shari'a by committing immorality in the form of usury, gharar, maysir, tadlis

    This study aims to uncover the problem of waqf and its solution at Pesantren Al-Falah Limboto Gorontalo. This research is field research, which is descriptive of analytical with the primer data and sekunder data. The data collection techniques used in this study are observation, interview, and documentation. While data analysis techniques include: data reduction, display, conclusions, and verification. The results showed that the procedure for the implementation of waqf at the Al-Falah Islamic Boarding School was originally carried out based on the principle of mutual trust without any element of doubt in the future it will cause problems. So that the agreement to hand over the donated land was not carried out. The path taken in resolving waqf disputes at the Al-Falah Islamic Boarding School is by deliberation or underhand. As for every heir who is deemed less capable of receiving mercy from the boarding school.Penelitian ini bertujuan untuk menyibak problematika wakaf dan penyelesaiannya di Pesantren Al-Falah Limboto Gorontalo. Penelitian ini merupakan penelitian lapangan yang bersifat deskriptif analistis dengan data berupa data primer dan data sekunder. Teknik pengumpulan data yang digunakan dalam penelitian ini adalah pengamatan, wawancara, dan dokumentasi. Sedangkan teknik analisis data meliputi reduksi data, pemaparan, pengambilan kesimpulan, dan verifikasi. Hasil penelitian menunjukan bahwa prosedur pelaksanaan wakaf di Pondok Pesantren Al-Falah pada mulanya dilakukan berdasarkan pada prinsip saling percaya tanpa ada unsur keraguan, namun kemudian hari akan menimbulkan masalah, sehingga perjanjian serah terima tanah wakafpun tidak dilakukan. Jalan yang ditempuh dalam penyelesaian sengketa wakaf di Pondok Pesantren Al-Falah adalah dengan jalur musyawarah atau dibawah tangan. Adapun setiap ahli waris yang dianggap kurang mampu mendapatkan santunan kerahiman dari pihak pondok pesantren sebagai bentuk terima kasih pihak pondok pesantren kepada ahli waris

    This study aims to examine the effectiveness of Law No. 22 of 2001 on the practice of retail gasoline selling by the people of Kota Timur Gorontalo, and uses a type of field research that focuses on the results of data collection from predetermined informants. The research method used is descriptive qualitative, namely research that is intended to gather information from people and observed behavior. The data sources used are primary and secondary data sources, then the data that has been collected will be analyzed using descriptive analysis methods. The results showed that the implementation of Law No. 22 of 2001 in the practice of selling retail gasoline by the community in Kota Timur Gorontalo has not been effective. It is proven that during 2020, the number of petrol depots in the area has increased to 98 petrol depots which also have not obtained a commercial business license. The factors that cause the ineffectiveness of the application of the law are the legal instruments, law enforcement officers, the factors of the community members who are affected by the scope of legal regulations and cultural factors. Therefore, the government's socialization efforts are needed in the form of counseling about the consequences, sanctions of criminal acts and providing information to administer the licensing of retail gasoline sale

    Abstract Tonelo in the literature of the Gorontalo community is a tradition related to marital issues, namely matters that focus on the issue of the cost of marriage, and this tradition itself has long been practiced by the local community, especially in Tamalate, East Gorontalo City, however the author sees an oddity. tends not to be in accordance with the concepts and principles of Islamic law, among the irregularities of the Tonelo tradition is the cost of the marriage itself which is quite expensive/high, so it is not surprising that it causes a lot of controversy and contradiction which gives quite a lot of implications from positive and even negative aspects. The type of research used in this research is a type of empirical phenomenological legal research that is Field Research, using a qualitative approach, while the research location is in Tamalate, Kota Timur, Gorontalo, with the subject of this research being the Tamalate community itself. Finally, the author concludes that the Tonelo tradition in general is makruh, and may be judged to be permissible if there is an element of pleasure/volunteership between the two parties to the prospective bride and groom, and it can also be said to be unlawful if it turns out that in practice its implementation brings harm, as is the principle of Islamic law which allows every tradition. which brings benefit and vice versa.  Abstrak: Tonelo dalam literatur masyarakat Gorontalo merupakan sebuah tradisi yang berkaitan pada persoalan perkawinan yaitu hal-hal yang menitik beratkan pada persoalan biaya perkawinan, dan tradisi ini sendiri telah lama di praktekan oleh masyarakat setempat terutama di Tamalate Kota Timur Gorontalo, namun demikian penulis melihat adanya kejanggalan yang cenderung tidak sesuai dengan konsep dan prinsip hukum islam, diantara kejanggalan tradisi Tonelo tersebut adalah biaya dari perkawinan itu sendiri yang cukup mahal/tinggi, sehingga tidak heran banyak menimbulkan kontroversi dan kontradiksi yang cukup memberikan banyak implikasi dari aspek positif bahkan negatif. Jenis penelitian yang digunakan dalam penelitian ini adalah jenis penelitian hukum Fenomenologis Empiris yang bersifat Field Research, dengan menggunakan pendekatan kualitatif, sedangkan lokasi penelitian berada di Tamalate Kota Timur, Gorontalo, dengan subjek penelitian ini adalah masyarakat Tamalate itu sendiri. Akhirnya penulis menyimpulkan bahwa tradisi Tonelo pada umumnya adalah makruh, dan bisa saja dihukumi boleh bilamana terdapat unsur keridhaan/sukela diantara kedua belah pihak calon mempelai, serta dapat pula dikatakan haram bilamana ternyata pada praktek pelaksanaannya mendatangkan kemudharatan, sebagaimana prinsip hukum islam yang membolehkan setiap tradisi yang membawa kemaslahatan dan begitupun sebaliknya
