Part 14 – Too Much of a Compromise? Defining Classes for Creditor Compromise Approval
In 2013, the Auckland High Court delivered New Zealand’s leading judgment on the compromise with creditors process set out in Part 14 of the Companies Act 1993. In particular, the Court considered the way in which different classes of creditors might be grouped together for the purposes of approving a compromise arrangement. This essay considers the cogency of the Court’s conclusion on the class issue. It concludes that the outcome was possibly incorrect and that the Part 14 process warrants some legislative clarification

In the early stages of a previous study of fossil spores of Botryopteris globosa and B. americana from the Carboniferous (Phillips & Rosso, 1970), considerable difficulty was encountered in replicating and cleaning spore materials and associ- ated debris from the carbon-platinum spore replicas. After numerous attempts to clean these carbon films, the techniques presented in this paper proved ef- ficient and reliable for transmission electron microscope examination of Botry- opteris spores found in calcified coal ball fossils
Consolidation of complex events via reinstatement in posterior cingulate cortex
It is well-established that active rehearsal increases the efficacy of memory consolidation. It is also known that complex events are interpreted with reference to prior knowledge. However, comparatively little attention has been given to the neural underpinnings of these effects. In healthy adult humans, we investigated the impact of effortful, active rehearsal on memory for events by showing people several short video clips and then asking them to recall these clips, either aloud (Experiment 1) or silently while in an MRI scanner (Experiment 2). In both experiments, actively rehearsed clips were remembered in far greater detail than unrehearsed clips when tested a week later. In Experiment 1, highly similar descriptions of events were produced across retrieval trials, suggesting a degree of semanticization of the memories had taken place. In Experiment 2, spatial patterns of BOLD signal in medial temporal and posterior midline regions were correlated when encoding and rehearsing the same video. Moreover, the strength of this correlation in the posterior cingulate predicted the amount of information subsequently recalled. This is likely to reflect a strengthening of the representation of the video's content. We argue that these representations combine both new episodic information and stored semantic knowledge (or "schemas"). We therefore suggest that posterior midline structures aid consolidation by reinstating and strengthening the associations between episodic details and more generic schematic information. This leads to the creation of coherent memory representations of lifelike, complex events that are resistant to forgetting, but somewhat inflexible and semantic-like in nature

The role of Jupiter in driving Earth’s orbital evolution: an update
In the coming decades, the discovery of the first truly Earth-like exoplanets is anticipated. The characterisation of those planets will play a vital role in determining which are chosen as targets for the search for life beyond the Solar system. One of the many variables that will be considered in that characterisation and selection process is the nature of the potential climatic variability of the exoEarths in question.
In our own Solar system, the Earth’s long-term climate is driven by several factors – including the modifying influence of life on our atmosphere, and the temporal evolution of Solar luminosity. The gravitational influence of the other planets in our Solar system add an extra complication – driving the Milankovitch cycles that are thought to have caused the ongoing series of glacial and interglacial periods that have dominated Earth’s climate for the past few million years.
Here, we present the results of a large suite of dynamical simulations that investigate the influence of the giant planet Jupiter on the Earth’s Milankovitch cycles. If Jupiter was located on a different orbit, we find that the long-term variability of Earth’s orbit would be significantly different. Our results illustrate how small differences in the architecture of planetary systems can result in marked changes in the potential habitability of the planets therein, and are an important first step in developing a means to characterise the nature of
climate variability on planets beyond our Solar system
Ventromedial prefrontal cortex : Adding value to autobiographical memories
The medial prefrontal cortex (mPFC) has been consistently implicated in autobiographical memory recall and decision making. Its function in decision making tasks is believed to relate to value representation, but its function in autobiographical memory recall is not yet clear. We hypothesised that the mPFC represents the subjective value of elements during autobiographical memory retrieval. Using functional magnetic resonance imaging during an autobiographical memory recall task, we found that the blood oxygen level dependent (BOLD) signal in ventromedial prefrontal cortex (vmPFC) was parametrically modulated by the affective values of items in participants' memories when they were recalling and evaluating these items. An unrelated modulation by the participant's familiarity with the items was also observed. During retrieval of the event, the BOLD signal in the same region was modulated by the personal significance and emotional intensity of the memory, which was correlated with the values of the items within them. These results support the idea that vmPFC processes self-relevant information, and suggest that it is involved in representing the personal emotional values of the elements comprising autobiographical memories
A high signal to noise ratio map of the Sunyaev-Zel'dovich increment at 1.1 mm wavelength in Abell 1835
We present an analysis of an 8 arcminute diameter map of the area around the
galaxy cluster Abell 1835 from jiggle map observations at a wavelength of 1.1
mm using the Bolometric Camera (Bolocam) mounted on the Caltech Submillimeter
Observatory (CSO). The data is well described by a model including an extended
Sunyaev-Zel'dovich (SZ) signal from the cluster gas plus emission from two
bright background submm galaxies magnified by the gravitational lensing of the
cluster. The best-fit values for the central Compton value for the cluster and
the fluxes of the two main point sources in the field: SMM J140104+0252, and
SMM J14009+0252 are found to be ,
6.5 mJy and 11.3 mJy, where the first error
represents the statistical measurement error and the second error represents
the estimated systematic error in the result. This measurement assumes the
presence of dust emission from the cluster's central cD galaxy of
mJy, based on higher frequency observations of Abell 1835. The cluster image
represents one of the highest-significance SZ detections of a cluster in the
positive region of the thermal SZ spectrum to date. The inferred central
intensity is compared to other SZ measurements of Abell 1835 and this
collection of results is used to obtain values for and the cluster peculiar velocity km/s.Comment: 9 pages, 5 figure
