Cybersquatting: The Latest Challenge in Federal Trademark Protection

    Get PDF
The explosion in Internet technology in the past decade has drawn the Lanham Act into the realm of electronic commerce. Trademark owners seeking to register domain names have recently found themselves entwined in a number of disputes, such as disputes involving claims to multiple domain names and disputes over whether the domain name registration system is fairly administered. One important legal issue that has recently come to the fore is over the practice of cybersquatting. Today, courts must contend with the cybersquatter, a speculator who reserves trademarks as Internet domain names for the sole purpose of selling or licensing them back to trademark owners willing to pay a considerable price for their use. Complicating matters, the most potent weapons in the Government\u27s anticybersquatting arsenal--the Anticybersquatting Consumer Protection Act (ACPA) and Federal Trademark Dilution Act (FTDA)--each give rise to grave constitutional concerns

Investigating neurodegeneration after traumatic brain injury: a longitudinal study of axonal injury

Traumatic brain injury (TBI) is associated with neurodegeneration and dementia, with Alzheimer’s disease (AD) reported to be more prevalent post-injury. Traumatic axonal injury (TAI) is suspected to trigger progressive neurodegeneration, with axonal damage leading to proteinopathies of tau and amyloid, also features of AD. However, while axonal injury has been difficult to assess clinically, advances in biomarkers now make this more amenable to quantification. This thesis uses advanced fluid and imaging biomarkers to investigate TAI longitudinally and assess how this relates to neurodegeneration post-TBI. I assess biomarkers in plasma and cerebral microdialysate after acute moderate-severe injuries, relating changes to diffusion tensor imaging (DTI) MRI measures of TAI, brain volumetric change and clinical outcomes. In a separate cohort in the chronic phase I assess how DTI measures predict neurodegeneration in comparison with other possible predictors, and characterise the neurodegenerative consequences of injury in comparison with AD and atrophy in healthy ageing. I found that axonal markers neurofilament light (NfL) and tau were markedly increased in concentration within brain extracellular fluid early post-TBI, correlating closely with plasma levels. Subacute plasma NfL related to DTI measures of TAI, predicted clinical outcomes and white matter neurodegeneration, with peak tau predicting grey matter atrophy. In the chronic phase, I found that DTI predicts the extent and pattern of brain atrophy and explains substantially more variance than clinical severity measures. Comparing post-traumatic atrophy with AD and ageing, I show that post-traumatic atrophy patterns are distinctive and reminiscent of axonal injury spatially. These findings provide evidence of axonal injury as a trigger of progressive neurodegeneration and show this can be sensitively measured with fluid and neuroimaging tools both early and late after single moderate-severe injury. These approaches have the potential to improve clinical diagnosis of TAI and its sequelae, prognostication, and facilitate trials of anti-neurodegeneration treatments.Open Acces

The development of the self concept scale for the hearing impaired

Bibliography: pages 173-181.The self concept is a critical variable in the overall development and functioning of hearing impaired pupils, yet the findings of research studies indicate that pupils may have difficulty forming a realistic, positive self concept. The consequences of the hearing loss appear to contribute to lowered self-esteem. The accumulated effect of unresolved psychosocial developmental stages may increase the probability of identity confusion in adolescence. The results of research on the self concept of the hearing impaired has been inconclusive and difficult to interpret partly due to the use of inappropriate self concept scales. There is a need for a relevant test which assesses pupils' strengths and weaknesses in dimensions of the self concept. In this dissertation, the 'Self Concept Scale for the Hearing Impaired' (SSHI) is developed with the purpose of designing an appropriate self concept scale specifically for use on hearing impaired pupils between the ages of 11 and 19 years. During the construction and administration of the SSHI, an attempt was made to control for confounding variables known to influence responses of pupils and to distort scores obtained. The SSHI was constructed primarily according to the homogenous-keying approach. Test-retest reliability coefficients were computed over a 4 to 5 week period for 198 pupils in three schools for the hearing impaired in the Western Cape

We Shall See: Critical Theory and Structural Inequality in Economics

This paper seeks to provide educators with a critique of dominant narratives through the disciplinary tools of economics. Specifically; issues of race, gender, and geography are addressed via the common economic subjects of fiscal and monetary policy, economic indicators, wages, and economic growth. By providing a practical blueprint for a more critical curriculum in economics, these lessons and the literature that supports them demonstrates the potential of teachers to challenge taken-for-granted notions of what economics is and what it is for
