Perfection of Legal Basis in Organized Crime’s Combating in Ukraine. Is it Enough to Combat Organized Crime?
The aim of the paper is to overview and analyze legal basis
for combating organized crime in Ukraine, namely international
and regional agreements (The Conventions and their additional
protocols).
The novelty of the paper is the fact that this type of research has not
been carried out in depth yet abroad with exceptions on some aspects
in Ukraine. This will allow us to have clear picture on legal basis for
combating organized crime in Ukraine from international point of
view. At the same time it facilitates to get a clear and comprehensive
answer for the following questions: is international and regional
legal basis enough to combat successfully a public enemy? Does
Ukraine have law on prevention organized crime
Application of the latest scientific and technological achievement in the investigation of offences
The Fourth Industrial Revolution have created the products which have
deeply penetrated into everyone’s daily life. It is difficult to imagine the areas of
life where you would not meet with various by its essence, functions products
created with the help of the latest scientific and technological achievements: a
smartphone, a robot vacuum cleaner, a self-driving car, appliances for a smart
home and etc. The achievements of the Fourth Industrial Revolution also have
penetrated public relations regulated by the laws, including one of the most
conservative areas of the law – criminal proceedings, which regulate the conduction
of investigative actions, court hearings with aim to determine whether
a person has violated the criminal law by his actions (both inaction and active).
It presupposed that the author of this scientific research have chosen the aim
of the it’s research – application of the web mapping platform and consumer
application “Google Maps” offered by company “Google” in the context of the
latest scientific and technological achievements. In order to achieve the research aims and to solve the tasks set up in this
scientific research the author of this research analyzes the legal basis and case
law for the application of the latest scientific and technological achievements
into the investigation of criminal acts, namely the usage of the web mapping
platform and consumer application “Google Maps” for gathering evidence in
the criminal proceedings
The author of this study uses scientific research methods to conduct analysis
of legal acts, materials of scientific research on this topic and with the help
of the survey questionnaire design using “Google Forms” conducted survey of
pre-trial officers, defense lawyers and their assistants on usage the web mapping
platform and consumer application “Google Maps” during performance
their duties
Application of 5th Generation Cellular Technology in the Pre-Trial Investigation Stage
The author is going to overview and analyze technological-theoretical, international and national legal grounds for the usage of this advanced technology in tackling criminal offences. The novelty of this paper is that this type of research has not yet been carried out in depth in either Lithuania or Latvia. The majority of research on advanced technology and human rights was and is still focused on the possible threats to human rights which can be caused by new technologies, especially in the area of communication. But let us consider this area of research from a fresh perspective and thereby raise an important question: How does 5th generation cellular technology help with the protection of human rights during a criminal pre-trial investigation

Šis autorių kolektyvo parengtas vadovėlis turėtų pasitarnauti siekiant geriau suprasti tinkamiausio ikiteisminio tyrimo procesinius, taktinius, metodinius, psichologinius, organizacinius ir kitus klausimus bei ugdant tam tikrus praktinius įgūdžius, reikalingus atliekant atskirų kategorijų nusikalstamų veikų tyrimą. Use of terminology while investigating criminal acts related to the safety of e-data and information systems
The paper deals with terminology usage in the investigation criminal acts targeting the security
of electronic data and information systems. Every year the amount of cyber attacks against private and
state institutions have been increasing. The presented data suggests the formation of a new threat,
which many researchers and practitioners identify as „cyber crime“, „computer crime“, and „virtual
crime“. This example revealed another area where the technological revolution of the 20th century
brought certain confusion. It is an inappropriate use of terms in the area of information technology,
where one and the same phenomenon, process or material object is identified in different terms and
this causes confusion, miscommunication between practitioners and academics when it comes to
criminal acts on electronic data and information system security investigations Author has analysed
some term meanings and suggests explanations which can be used in the methodology of criminal act
investigation with the aim to unify and summarize the terms and their definitions.Vykstant visuotinam kompiuterizacijos bumui, skaitmeninė technika skverbiasi ne
tik į strategines gyvenimo sritis kaip, pavyzdžiui, karinę pramonę ir valdymą, kosmosą, bet ir į
telefoninių ryšių aptarnavimo sritį ar net namų šeimininkės virtuvę. Kitą vertus, kasmet vis daugėja
kibernetinių atakų prieš valstybines ir privačias institucijas elektroninio ryšio tinkluose, siekiant
išgauti informaciją apie naujausias technologijas karinėje srityje, pramoninius išradimus ir pan. Tai
akivaizdžiai parodo užsienio šalių ir Lietuvos statistiniai duomenys apie incidentus susijusius su
informacijos perdavimo tinklų pažeidimais, kibernetinių atakų skaičiai prieš atskirų valstybių
institucijų tinklapius. Tai rodo naujos grėsmės formavimąsi, kuri daugelio mokslininkų ir praktikų
įvardijama įvairiais terminais: „kibernetiniai nusikaltimai“, „elektroniniai nusikaltimai“,
„kompiuteriniai nusikaltimai“, „virtualūs nusikaltimai“. Šis pateiktas pavyzdys atskleidė dar vieną
sritį, kur technologinis perversmas, prasidėjęs XX a. paskutiniame dešimtmetyje, atnešė tam tikros
painiavos. Tai – terminų vartojimas netinkama prasme informacinių technologijų srityje, kur vienas ir
tas pats reiškinys, procesas ar materialus objektas įvardijami skirtingais žodžiais kas sukelia painiavą,
nesusikalbėjimą tarp praktikų, akademinio pasaulio atstovų kai kalba pakrypsta prie nusikalstamų
veikų elektroninių duomenų ir informacinės sistemos saugumui tyrimo. Taigi svarbus faktorius šios
rūšies nusikalstamų veikų tyrime yra tinkamas terminologijos vartojimas, įvardijant tam tikrus
socialinės tikrovės reiškinius, įvairiausios paskirties įrangą tinkamais terminais. Tai sąlygojo šio
mokslinio tyrimo tikslą – išanalizuoti įvairių terminų vartojimą apibūdinant atskirus procesus, objektus
informacinių technologijų srityje. Autoriaus išanalizuoti ir pateikiami terminai informacinių
technologijų srityje adresuoti informacinių technologijų vartotojams, ypač tyrėjams tiriantiems
nusikalstamas veikas turėtų įnešti tam tikro aiškumo ir išvengti dviprasmybių kai vienas ir tas pats
reiškinys įvardijamas skirtingu pavadinimu, sukelia nesusikalbėjimą, nesusipratimus pareigūnų
tiriančių ir nagrinėjančių nusikalstamas veikas, kitų proceso dalyvių, visuomenės

The doctoral dissertation analyses the practical use of covert surveillance as well as issues which arise in the processing of previously mentioned pre-trial action. It also studies structural elements, conditions of application, necessity, appropriateness and factual grounds of covert surveillance. The first part of the dissertation deals with the problems of how we know, how we get accurate knowledge about the real world and the inner world, analyses the sources of knowledge in the philosophy. Based on the complexity of subject of the dissertation, the researcher analyses three main sources of knowledge: senses, reason and intuition in the doctoral dissertation and their correlations with each other in the cognitive process. It allows to further understand the observation method as a data collection instrument on which surveillance is based. After revealing sources of knowledge research focuses into human’s physiology seeking to percept how human being finds, perceives, memorises, transfers and storages information (data) and recalls information back. The second part of the dissertation analyses a concept of procedural action from the social action perspective, excludes the features which help to define the concept of a procedural action. Based on concept of procedural action which had been formulated in the doctoral dissertation the author excludes procedural action which have legal forms in the one of criminal procedures stages – pre-trial investigation. Attention has been especially paid to the legal and cognitive aspects of procedural action in the pre- trial investigation stage. It helps to classify all pre-trial investigation action into separate groups and to formulate a concept of pre-trial investigation action. It might be consider as starting point in analysing secret procedural actions regulated by law, to distinct one an investigation action from other similar action. The final chapter of this part is designed for comprehensive analysis similar to covert surveillance the procedural actions defined in the Code of Criminal Procedure of Lithuania and other information collection instruments defined in the other law. The third part. The researcher conducted analysis on regulation of covert surveillance action and other secret procedural actions which are used in the Romano-Germanic and Anglo-Saxon legal systems by using comparative study. It allowed extracting best practice of foreign lawmakers which might be useful for national lawmakers while improving regulations of covert surveillance. The fourth part analyses the structural elements of covert surveillance action as a subject, an object, fixation of an action‘s course and results, area. The analysis of laws and case law revealed some issues on using above mentioned action against individuals granted immunity and allowed the author to formulate his stance on the usage of covert surveillance against immunity holders during pre-trial investigation stage. The fifth part of the doctoral dissertation is designed for deep analysis through prism of human rights and freedom the conditions, necessity, appropriateness, factual (from comparative studies point of view) and legal grounds/basics on application of the covert surveillance. The author revealed content of conditions, necessity, appropriateness and factual grounds of covert surveillance.Disertacijoje nagrinėjamas ikiteisminio tyrimo veiksmas – slaptas sekimas, jo struktūriniai elementai, taikymo sąlygos, būtinumas, tinkamumas, teisinis ir faktinis pagrindai, šio veiksmo taikyme iškylančios problemos. Pirmoje dalyje yra aptariama pažinimo šaltinių problematika filosofijoje, atsižvelgiant į nagrinėjamos problematikos kompleksiškumą, šiame darbe nagrinėjami trys pažinimo šaltiniai: patirtis, protas ir intuicija, ir jų tarpusavio ryšiai pažinime. Atskleidus pažinimo šaltinius, stebėjimo kaip pažinimo metodo, taikomo renkant informaciją (duomenis) apie tyrinėjimo objektą, tyrimas nukreipiamas į žmogaus fiziologiją. Tuo siekiama suprasti kaip informacija (duomenys) aptinkami, suvokiami, įsimenami, o esant poreikiui atgaminami. Antroji dalis yra skiriama tyrimo veiksmo sampratos analizei iš socialinio veiksmo perspektyvos, išskiriant požymius, apibrėžiančius tyrimo veiksmo sampratą. Didelis dėmesys skiriamas ikiteisminio tyrimo veiksmo pažintiniam ir teisiniam aspektams, leidžiantiems atskirti atskiras ikiteisminio tyrimo veiksmų grupes ir pateikti ikiteisminio tyrimo sampratą. Visa tai yra išeitis-taškas, nagrinėjant slaptus tyrimo veiksmus, atskiriant juos pagal išskirtus požymius nuo kitų tyrimo veiksmų. Ši tyrimo dalis užbaigiama į slaptą sekimą panašaus pobūdžio informacijos rinkimo būdų, reglamentuotų Lietuvos Respublikos BPK ir kituose teisės normų aktuose, analize. Trečioje dalyje lyginamuoju aspektu tiriamas Lietuvos Respublikos ir užsienio valstybių priskiriamų kontinentinei (romanų-germanų) ir anglosaksų teisės sistemai slaptų tyrimo veiksmų teisinio reguliavimo modelis. Tai leidžia išskirti taikomų teisinio reguliavimo modelių skirtingose šalyse trūkumus ir privalumus. Ketvirtoje dalyje analizuojami atskiri slapto sekimo struktūriniai elementai: subjektas ir objektas, tyrimo eigos ir rezultatų fiksavimas, šio veiksmo vyksmo erdvė. Teisės aktų ir teismų praktikos analizė taikant slaptą sekimą leido identifikuoti iškilusias problemas praktinėje plotmėje. Penktoje dalyje apžvelgiami, analizuojami ir įvertinami per žmogaus teisių bei laisvių apsaugos prizmę slapto sekimo skyrimo ir taikymo elementai: tikslas, būtinumas, tinkamumas, sąlygos, faktiniai (lyginamuoju aspektu) ir teisiniai pagrindai. Surveillance and privacy. Where is boundary?
This article is about undercover surveillance which is regulated by criminal procedure code.
New technologies made big impact on understanding of undercover surveillance which passed big
changes during last century. The author of this article proposes new description of undercover
surveillance which includes using of special technique during pre-trail investigation. Further one
analizes law of provision on information to the public and preposes several amendments for
aforementioned law. Finally the author expresses needs of new law which will be regulate activity of
private detectives and security companies
