Sons, Brothers and Relatives in the Entourages of the Roman Provincial Commanders during the Republic: A Characteristic Behaviour of the Roman Ruling Class

    Get PDF
Corporate criminal liability: similarities and differences between Spain and Philippines

    Get PDF
This paper focuses on the topic of corporate criminal liability and the common and opposite aspects that regimes of Spain and The Philippines have. On the one hand, in Spain, criminal liability of legal persons has suffered a deep reform with the organic law 1/2015, after being introduced in year 2010. This reform has brought important modifications and news, as the creation of an exemption of liability through the adoption of compliance programs. On the other hand, corporate criminal liability is more limited in The Philippines, being criticized by the doctrine that, rather to impose this kind of liability to companies, natural persons as directors, officers or employees of the corporation are the only ones considered responsible for some crimes. The analysis of both regimes, the Spanish and the Philippines one, will comprise different aspects of the issue as the crimes for which companies can be criminally liable, the ways to require to them criminal liability or their exemption of it and the possible sanctions that can be imposed. The comparative study will bring out the positive and the negative points of both regimes.Universidad de Málaga. Campus de Excelencia Internacional Andalucía Tech

Spain and the Philippines in the protection of the right to a reasonable time in criminal proceedings

The subject of this work deals with the right of every person, provided in Article 6.1 of the European Convention on Human Rights, to a hearing within a reasonable time, specifically in criminal proceedings. This right, which in Spain enjoys constitutional protection in Article 24.2 and gives rise to a reduction of the penalty through the application of a mitigating circumstance, provided in article 21.6 of the Criminal Code, also constitutes an object of protection in the Philippines through Article III Section 14 of its Constitution or through the Speedy Trial Act, among other regulations. The legal configuration of this right in both legal systems has been specially conditioned by case-law but in different senses. Thus, on the one hand, in Spanish law the mitigation applicable to the penalty was introduced into the Criminal Code in 2010 on the basis of a consolidated case-law practice, influenced by the requirements contained in the judicial decisions of the European Court of Human Rights, which pay attention to the circumstances of the specific case, instead of requiring predetermined deadlines. On the other hand, the protection of this right in the Philippine Law, and in particular, the case-law of the Supreme Court, has closely followed the case-law of the United States to interpret the constitutional right to speedy trial, in addition to constitutionally demanding deadlines which the courts must respect. In conclusion, the present paper intends to compare the two systems, to firstly determine whether in both cases this issue is addressed from the same approach, since in the Spanish case the term used is ‘reasonable time’ while in the Filipino ‘speedy trial’; secondly, to study the requirements of both legal systems; and, thirdly, to evaluate them to consider whether, in both cases, the protection of this procedural guarantee of great relevance is ensured.Universidad de Málaga. Indexación: Web of Science; Scielo.ABSTRACT. The Easter submarine alignment corresponds to a sequence of seamounts and oceanic islands which runs from the Ahu-Umu volcanic fields in the west to its intersection with the Nazca Ridge in the east, with a total length of about 2.900 km and a strike of N85°E. Recent bathymetric compilations that include combined satellite derived and shipboard data (Global Topography) and multibeam bathymetric data (from NGDC-NOAA) are interpreted both qualitatively and quantitatively by using a morphological analysis, which was comprised of the determination of bathymetric patterns, trends in lineations and structures; height measurements, computation of basal areas and volumes of seamounts, in order to establish clues on the origin of this seamount chain and to establish relationships with the regional tectonics. In the study region 514 seamounts were counted, of which 334 had a basal area less than the reference seamount (Moai). In general, the largest seamounts (>1000 m in height) tend to align and to have a larger volume, with an elongation of their bases along the seamount chain. On the other hand, smaller seamounts tend to be distributed more randomly with more circular bases. As a consequence of the morphological analysis, the best possible mechanism that explains the origin of the seamount chain is the existence of a localized hotspot to the west of the Salas y Gómez Island. The corresponding plume would contribute additional magmatic material towards the East Pacific Rise through canalizations, whose secondary branches would feed intermediate volcanoes. It is possible that within the Easter Island region there would be another minor contribution through fractures in the crust, due to the crustal weakening that was produced by the Easter Fracture Zone.RESUMEN.

A tool for symbolic analysis of analog integrated circuits is presented featuring accurate simplification, pole/zero extraction, and tools for parametric AC circuit characterization. The program, called ASAP, uses signal flowgraph methods and has been written in C for portability. In its current version, ASAP is able to deal with the complexity levels arising in typical analog building blocks when described by device-level models. The ASAP inputs and outputs, the architecture, and the graphical interface are discussed

Automating SLA-Driven API Development with SLA4OAI

The OpenAPI Specification (OAS) is the de facto standard to describe RESTful APIs from a functional perspective. OAS has been a success due to its simple model and the wide ecosystem of tools supporting the SLA-Driven API development lifecycle. Unfortunately, the current OAS scope ignores crucial information for an API such as its Service Level Agreement (SLA). Therefore, in terms of description and management of non-functional information, the disadvantages of not having a standard include the vendor lock-in and prevent the ecosystem to grow and handle extra functional aspects. In this paper, we present SLA4OAI, pioneering in extending OAS not only allowing the specification of SLAs, but also supporting some stages of the SLA-Driven API lifecycle with an open-source ecosystem. Finally, we validate our proposal having modeled 5488 limitations in 148 plans of 35 real-world APIs and show an initial interest from the industry with 600 and 1900 downloads and installs of the SLA Instrumentation Library and the SLA Engine.Ministerio de Economía y Competitividad TIN2015-70560-RMinisterio de Ciencia, Innovación y Universidades RTI2018-101204-B-C21Ministerio de Educación, Cultura y Deporte FPU15/0298

    Fostering SLA-Driven API Specifications

Software architecture tendencies are shifting to a microservice paradigm. In this context, RESTful APIs are being established the standard of integration. API designer often identifies two key issues to be competitive in such growing market. On the one hand, the generation of accurate documentation of the behavior and capabilities of the API to promote its usage; on the other hand, the design of a pricing plan that fits into the potential API user’s needs. Besides the increasing number of API modeling alternatives is emerging, there is a lack of proposals on the definition of flexible pricing plans usually contained in the Service Level Agreements (SLAs). In this paper we propose two different modeling techniques for the description of SLA in a RESTful API context: iAgree and SLA4OAI.Ministerio de Economía y Competitividad TIN2015-70560-RJunta de Andalucía P12-TIC-1867Ministerio de Economía y Competitividad TIN2014-53986-RED
