Codification and Rule of Law

Depuis ses origines, la codification a toujours été officiellement réalisée en vue d’assurer l’accessibilité et l’intelligibilité de la norme ainsi que la sécurité juridique des individus. Cette conception téléologique de la codification est corroborée par les discours politiques contemporains qui l’associent plus généralement à l’Etat de droit auquel elle est censée contribuer. La seule récurrence de cette affirmation ne suffit pas à prouver sa pertinence. C’est pourquoi, en se fondant sur l’Etat de droit et ses multiples facettes, il est au préalable nécessaire de procéder à la conceptualisation de la codification. Il s’agit de la condition sine qua non pour une étude fiable de l’Etat de droit comme fin de la codification.Since its origins, the codification has always been officially carried out in order to ensure the accessibility and intelligibility of the norm, as well as the legal security of the individuals. This teleological conception of the codification is corroborated by the contemporary political views which associate it, more generally, to the Rule of law to which it is supposed to contribute. The only recurrence of this assertion is not sufficient to prove its relevance. That is why, based on the rule of law and its many facets, it is necessary to proceed first to the conceptualization of the codification. It is the sine qua non for a reliable study of the Rule of law as being the aim of the codification

Axiological foundations of the functioning of territorial self-government in Poland.

Polacy w ramach przemian ustrojowych po 1989 roku opowiedzieli się za zasadami aksjologicznymi demokracji liberalnej mającej stwarzać pozytywne warunki rozwoju społecznego, a także sankcjonować podstawowe prawa podmiotowe każdego obywatela. Stanowiło też urzeczywistnienie idei suwerenności narodu. Najpełniejszy strukturalny wyraz idea ta znalazła w ustanowieniu i rozwoju samorządu terytorialnego zgodnie z zasadą subsydiarności i decentralizacji władzy. Jednocześnie było wyrazem realizacji idei pluralizmu i dobra wspólnego. Rozstrzygnięcia prawne znalazły miejsce w Konstytucji RP z 1997 roku oraz w ustawach. Są one zgodne z założeniami zawartymi w Europejskiej Karcie Samorządu Lokalnego uchwalonej w Strasburgu 15 października 1985 roku ratyfikowanej przez Polskę 26 kwietnia 1993 roku.During the system transformations after 1989 the Poles voted for the axiological rules of liberal democracy which was to create favourable conditions for social development and to sanction the basic human rights of each citizen. This made the sovereignty a reality. The idea has found its complete structural expression in the establishment and development of the local governments based on the principle of subsidiarity and power decentralisation. Simultaneously it was the demonstration of the enactment of the idea of pluralism and the common good. The legal solutions found their place in The Constitution of the Republic of Poland approved in 1997 and in the acts of law. They are in line with the assumptions included in the European Charter of Local Self-Government adopted on October 15, 1985 in Strasburg and ratified by Poland on April 26, 1993

Regional groundwater flow modelling

W pracy omówiono metody postępowania przy modelowaniu filtracji w ujęciu obszarowym, z podkreśleniem szczególnej roli szacowania wartości parametrów, kalibracji i analizy wrażliwości przy tworzeniu modeli prognostycznych. Ponadto przedstawiono przykładowe wyniki symulacji otrzymane za pomocą programu HZPLASKI, opracowanego przez autora. Program ten umożliwia rozwiązywanie zagadnień filtracji obszarowej dla stanów ustalonych, przy wykorzystaniu metody elementów skończonych.The paper presents a modelling approach to the two-dimensional groundwater flow in a horizontal plane. Particular attention is paid to the parameter estimation procedure, model calibration and sensitivity analysis. Examples of numerical simulations, performed with the HZPLASKI code developed by the author, are presented. The code was developed in order to solve steady-state groundwater flow in a horizontal plane, using the finite element method
