The notion of victim and the Colombian armed conflict: Hermeneutics, citizenship and gender equity

El presente artículo tiene como objetivo mostrar, desde una perspectiva crítica, los límites del concepto de víctima implícitos en la Ley 1448 de 2011, conocida como Ley de Víctimas y Restitución de Tierras. Para lograrlo, se tienen en cuenta los siguientes pasos: en primer lugar, el análisis sobre el concepto de víctima a partir de la filosofía política y su relación con la violencia en perspectiva hermenéutica; en segundo lugar, la profundización en la noción de víctima desde el ejercicio real de ciudadanía; y, en tercer lugar, la interpretación de las limitaciones de la noción de víctima desde la equidad de género. El resultado: existe un concepto de víctima excluyente e inoperativo el cual promueve la segregación y limita, tanto el ejercicio real de ciudadanía como la equidad de género en Colombia. En síntesis: una noción de víctima que profundiza las relaciones de poder y perpetúa las violencias resultantes del conflicto armado colombiano.The purpose of this article is to analyze, from three points of view, the limits of the concept of victim, implicit in Law 1448 of 2011, known as the Victims and Land Restitution Law. These three axes are presented as such: frst, drawing upon political philosophy, an analysis of the concept of victim and its relation to violence from a hermeneutic perspective; second, the deepening of the notion of victim from the exercise of citizenship; and third, the interpretation of the limitations of the notion of victim from a gender equity perspective. Para hacer efectivo el análisis, el texto se divide de la siguiente manera: 1) Breve compilación de la mirada de la Grecia antigua y medieval; 2) El cuerpo como objeto-técnico-científico en la época moderna; y 3) el cuerpo de la violencia en relación a la técnica. Con todo esto, finalmente se busca vislumbrar las posibilidades de una hermenéutica de la violencia para la comprensión de nuestros tiempos

La violencia de Benjamin y el conflicto colombiano a partir de la Noción de víctima: ¿un desafío en el nuevo escenario de guerra?

O objetivo deste artigo de reflexão é pensar a relação Violência-Vítima o contexto de guerra violência na Colômbia. Para atingir o objetivo três momentos são propostos: primeiro, a noção de violência desde Walter Benjamin e seu relação com a vítima; segundo, uma leitura crítica da atual Lei 1.448 de 2011 (Lei de Vítimas); e, finalmente, uma interpretação das possibilidades de cenário pós-conflito na Colômbia.El objetivo del presente artículo de reflexión consiste en pensar la relación Violencia-Víctima del contexto de guerra en Colombia.
