    Why States Create International Tribunals: A Response to Professors Posner and Yoo

    A recent article in the California Law Review by Professors Eric Posner and John Yoo, Judicial Independence in International Tribunals, argues that the only effective international tribunals are dependent tribunals, by which the authors mean ad hoc tribunals staffed by judges closely controlled by governments through the power of reappointment or threats of retaliation. Independent tribunals, by contrast, meaning tribunals staffed by judges appointed on similar terms as those in domestic courts, pose a danger to international cooperation. According to Posner and Yoo, independent tribunals are suspect because they are more likely to allow moral ideals, ideological imperatives or the interests of other states to influence their judgments. In this response, we identify the many shortcomings in the theory, methodology, and empirics in Judicial Independence in International Tribunals. We do so to challenge the authors\u27 core conjecture: that formally dependent international tribunals are correlated with effective judicial outcomes. We then offer our own counter-theory; a theory of constrained independence in which states establish independent international tribunals to enhance the credibility of their commitments and then use more fine grained structural, political, and discursive mechanisms to limit the potential for judicial excesses

    Butterfly Hysteresis and Slow Relaxation of the Magnetization in (Et4N)3Fe2F9: Manifestations of a Single-Molecule Magnet

    (Et4N)3Fe2F9 exhibits a butterfly--shaped hysteresis below 5 K when the magnetic field is parallel to the threefold axis, in accordance with a very slow magnetization relaxation in the timescale of minutes. This is attributed to an energy barrier Delta=2.40 K resulting from the S=5 dimer ground state of [Fe2F9]^{3-} and a negative axial anisotropy. The relaxation partly occurs via thermally assisted quantum tunneling. These features of a single-molecule magnet are observable at temperatures comparable to the barrier height, due to an extremely inefficient energy exchange between the spin system and the phonons.     Studying Diquark Structure of Heavy Baryons in Relativistic Heavy Ion Collisions

    We propose the enhancement of Λc\Lambda_c yield in heavy ion collisions at RHIC and LHC as a novel signal for the existence of diquarks in the strongly coupled quark-gluon plasma produced in these collisions as well as in the Λc\Lambda_c. Assuming that stable bound diquarks can exist in the quark-gluon plasma, we argue that the yield of Λc\Lambda_c would be increased by two-body collisions between udud diquarks and cc quarks, in addition to normal three-body collisions among uu, dd and cc quarks. A quantitative study of this effect based on the coalescence model shows that including the contribution of diquarks to Λc\Lambda_c production indeed leads to a substantial enhancement of the Λc/D\Lambda_c/D ratio in heavy ion collisions.Comment: Prepared for Chiral Symmetry in Hadron and Nuclear Physics (Chiral07), Nov. 13-16, 2007, Osaka, Japa

    Optimization of robustness of scale-free network to random and targeted attacks

    The scale-fee networks, having connectivity distribution P(k)kαP(k)\sim k^{-\alpha} (where kk is the site connectivity), is very resilient to random failures but fragile to intentional attack. The purpose of this paper is to find the network design guideline which can make the robustness of the network to both random failures and intentional attack maximum while keeping the average connectivity per node constant. We find that when $=3$ the robustness of the scale-free networks reach its maximum value if the minimal connectivity $m=1$, but when is larger than four, the networks will become more robust to random failures and targeted attacks as the minimal connectivity mm gets larger
