    CONTRACTS Contracts in Partial Restraint of Trade: Restrictive Covenant Act

    The Act provides that contracts in partial restraint of trade that are reasonable are valid and enforceable. The Act establishes rules for determining when a restrictive covenant is reasonable and establishes procedures for identification, clarification and reformulation of such covenants. Courts must enforce restrictive covenants independently of the enforceability of any other covenant, or part of a covenant, contained in a non-compete agreement. A post-employment loss or forfeiture provision conditioned upon the occurrence of subsequent competition does not constitute a restraint of trade and is enforceable regardless of the unenforceability of non-compete covenants contained in the same contract

    A Matter of Principle: The Influence of America’s Declaration of Independence on Post-Declaration Literature

    This study explores the ways in which selected principles contained within America’s Declaration of Independence are addressed in works of post-Declaration literature. The examined works are from the nineteenth-century. It was during this time that America’s writers were attempting to establish a uniquely American literature, and the Declaration of Independence, with its rhetoric of equality and unalienable rights, provided a fertile ground for that effort. Drawing upon scholarship from the document itself, I discuss the Declaration and provide a brief explication of the principles contained within the preamble. I then compare and contrast how those same principles are incorporated and interpreted in passages from Ralph Waldo Emerson’s essay, The American Scholar; Nathaniel Hawthorne’s novel, The House of Seven Gables; and Henry David Thoreau’s essay, Resistance to Civil Government. The purpose of the study is to demonstrate how important political ideas and values become infused into public consciousness and rooted into cultural identities by way of artistic medium. The results indicate a significant influence of the political ideas embodied within the Declaration upon the selected works

    Psychometric Properties of the MMPI-A Harris-Lingoes and Si Subscales in a Forensic Sample

    The purpose of the current study was to examine the internal and external psychometric properties of the Harris-Lingoes subscales. This was accomplished by use of both self-report and caregiver-rated external criterion measures. The present study employed an archival data set consisting of 760 adolescents (470 boys and 290 girls) who completed the MMPI-A at an outpatient adolescent treatment facility as part of a court-ordered psychological evaluation. Overall, a number of subscales demonstrated good internal consistency reliability (e.g., D4 and Hy3) whereas other subscales (e.g., Pd2) demonstrated unacceptable internal consistency reliability for both genders. Correlations with external self-report scores and caregiver ratings showed varying degrees of support for the construct validity of scores on the Harris-Lingoes and Si subscales in this sample. As a secondary analysis, stepwise regression was used to predict scores on the CBCL Internalizing and Externalizing scales. Limitations and directions for future research are discussed

    Individuals in positions of leadership should possess certain qualities that allow them to situations of great stress and crisis. These qualities are especially important in extraordinary and overwhelming circumstances such as natural disasters. Hurricane Katrina, a devastating storm which hit the United States Gulf Region back in 2005, certainly fits into that category. This project examines the leadership and disaster management efforts of prominent government officials in response to Hurricane Katrina; special focus is given to Ray Nagin, mayor of New Orleans at the time. New Orleans was especially impacted by Katrina, and the efforts of officials at all levels of government would significantly influence his ability to manage the crisis brought on by Katrina’s devastation. Available investigative and academic sources are utilized to discuss desirable leadership disaster management characteristics, the empirical numbers behind Katrina’s damage, actions performed by officials in Katrina’s aftermath and how those actions affected the local efforts of Nagin and his administration.     Anatomical Society core regional anatomy syllabus for undergraduate medicine: the Delphi process

    A modified Delphi method was employed to seek consensus when revising the UK and Ireland's core syllabus for regional anatomy in undergraduate medicine. A Delphi panel was constructed involving ‘expert’ (individuals with at least 5 years’ experience in teaching medical students anatomy at the level required for graduation). The panel (n = 39) was selected and nominated by members of Council and/or the Education Committee of the Anatomical Society and included a range of specialists including surgeons, radiologists and anatomists. The experts were asked in two stages to ‘accept’, ‘reject’ or ‘modify’ (first stage only) each learning outcome. A third stage, which was not part of the Delphi method, then allowed the original authors of the syllabus to make changes either to correct any anatomical errors or to make minor syntax changes. From the original syllabus of 182 learning outcomes, removing the neuroanatomy component (163), 23 learning outcomes (15%) remained unchanged, seven learning outcomes were removed and two new learning outcomes added. The remaining 133 learning outcomes were modified. All learning outcomes on the new core syllabus achieved over 90% acceptance by the panel
