    Increasing Substantive Fairness and Mitigating Social Costs in Eviction Proceedings: Instituting a Civil Right to Counsel for Indigent Tenants in Pennsylvania

    The U.S. Constitution provides criminal defendants the right to a court-appointed attorney but gives no similar protection to civil litigants. Although federal law does not supply any categorical rights to counsel for civil litigants, all 50 states have instituted the right in at least one category of civil law that substantially impacts individuals’ rights. Since 2017, several U.S. cities have enacted such a right for tenants facing eviction. In so doing, these cities responded to American families’ increasing rent burden, the recent publication of nationwide eviction data, the sociological research concerning the impact of eviction, and the lack of procedural and substantive fairness for tenants in court. The COVID-19 pandemic has only exacerbated the urgency for this right. This Comment will recommend that the Pennsylvania legislature enact the nation’s first statewide civil right to counsel for tenants in eviction proceedings, given the support in case law and anticipated benefits to individuals and communities. This Comment explores the unique challenges and opportunities Pennsylvania faces in implementing tenants’ right to counsel, based on its demographics, its existing legal services infrastructure, and its largely rural geography. Additionally, this Comment overviews the implementation and results from similar programs in other jurisdictions. This Comment concludes by proposing concrete steps and raising abstract considerations for making aspirational justice a reality for tenants facing eviction in Pennsylvania

    Applications of a “Whole Community” Framework for Enhancing Community or Campus Resilience

    AbstractThe Community and Regional Resilience Institute (CARRI) has developed a unique approach to community resilience based on a “Whole Community” concept. It treats communities as a collection of systems, each with its own resilience. CARRI has applied its approach to two kinds of communities: civil communities, and institutions of higher education (IHEs). For both civil communities and IHEs, CARRI carried out a pilot program. For each participant, their leadership directed an assessment of the resilience of the component systems to the types of changes most relevant to that community. Each assessment provided suggestions for filling any gaps identified as part of the assessment. The pilot for the seven IHEs followed that for the seven civil communities and was able to take advantage of lessons learned from the first. These two pilot programs led to the following conclusions:•CARRI's systems-based approach is both understandable and usable by both types of communities. In practice, it seemed to provide a natural way to look at a community.•In general, IHEs were able to make better use of the approach than civil communities. This is due, in part, to the improvements made in the IHE pilot program based on the civil communities’ results. However, it also reflects the more hierarchical nature of IHEs, the tighter coupling of systems within an IHE and greater discretion in the use of resources in an IHE.•College campuses can be crucial catalysts for enhancing the resilience of civil communities.•Leadership is a key, perhaps the key, element in the success of a community resilience initiative

    Sequestration of C in soils under Miscanthus can be marginal and is affected by genotype-specific root distribution

    AbstractMiscanthus is a low input energy crop suitable for low fertility marginal arable land and thought to provide carbon sequestration in soil. We analysed a long-term field experiment (14-year) to determine whether differences in genotype, growth habit, and root distribution affected soil carbon spatially under different Miscanthus genotypes. Soil cores were taken centrally and radially to a depth of 1m, and divided into six vertical segments. Total root length (TRL), root dry matter (RDM) and δ13C signature of soil organic carbon (SOC) were measured directly, and root length density (RLD), fractions of Miscanthus-derived soil organic C (SOCM), and residual soil carbon (SOCorig) were calculated. Genotype was found to exhibit a statistically significant influence on spatial allocation of SOC. Grouping varieties into ‘tuft-forming’ (T) and ‘non-tuft-forming’ (NT) phenotypes revealed that respective groups accumulated similar amounts of RDM over 14 years (11.4±3.3 vs. 11.9±4.8Mgha−1, respectively). However, phenotype T allocated more carbon to roots in the subsoil than NT (33% vs. 25%). Miscanthus genotypes sequestered between 4.2 and 7.1gC4-SOCkg−1 soil over the same period, which was more than the average loss of C3-derived SOC (3.25gkg−1). Carbon stocks in the ‘A horizon’ under Miscanthus increased by about 5Mgha−1 above the baseline, while the net increase in the subsoil was marginal. Amounts of Miscanthus root C in the subsoil were small (1.2–1.8MgCha−1) but could be important for sustainable sequestration as root density (RLD) explained a high percentage of SOCM (R2=0.66)

    A comparison of two colorimetric assays, based upon Lowry and Bradford techniques, to estimate total protein in soil extracts

    Soil extracts usually contain large quantities of dissolved humified organic material, typically reflected by high polyphenolic content. Since polyphenols seriously confound quantification of extracted protein, minimising this interference is important to ensure measurements are representative. Although the Bradford colorimetric assay is used routinely in soil science for rapid quantification protein in soil-extracts, it has several limitations. We therefore investigated an alternative colorimetric technique based on the Lowry assay (frequently used to measure protein and humic substances as distinct pools in microbial biofilms). The accuracies of both the Bradford assay and a modified Lowry microplate method were compared in factorial combination. Protein was quantified in soil-extracts (extracted with citrate), including standard additions of model protein (BSA) and polyphenol (Sigma H1675-2). Using the Lowry microplate assay described, no interfering effects of citrate were detected even with concentrations up to 5 times greater than are typically used to extract soil protein. Moreover, the Bradford assay was found to be highly susceptible to two simultaneous and confounding artefacts: 1) the colour development due to added protein was greatly inhibited by polyphenol concentration, and 2) substantial colour development was caused directly by the polyphenol addition. In contrast, the Lowry method enabled distinction between colour development from protein and non-protein origin, providing a more accurate quantitative analysis. These results suggest that the modified-Lowry method is a more suitable measure of extract protein (defined by standard equivalents) because it is less confounded by the high polyphenolic content which is so typical of soil extracts

    Common species contribute little to spatial patterns of functional diversity across scales in coastal grasslands

Several studies have previously used a sequential addition approach to determine the subsets of species that contribute to the spatial distribution of species richness, frequently showing the importance of common species to richness patterns. This approach, however, has not been applied to functional diversity despite the central role of species traits in community ecology. Here we use a multiscale survey of plants from the Machair grassland system of the Western Isles of Scotland to ask the following questions: (i) Do functional diversity patterns correlate better with geographically common or geographically rare species?; (ii) Do their relative contributions vary with spatial scale?; and (iii) Do these patterns vary between functional diversity measures? We show that while species richness patterns correlate with geographically common species, common species contribute less than expected to spatial patterns of functional diversity at frequently used spatial monitoring scales. The relative contribution of species to overall biodiversity patterns, however, can vary with spatial scale. Synthesis. Surveying only common species may be inadequate for estimating spatial patterns of functional diversity, especially if using occurrence as opposed to percentage cover or abundance data, and spatial scale needs to be considered when designing surveys. Our approach highlights the species that may be adequate indicators of different dimensions of biodiversity and contributes to our understanding of the distribution of functional diversity in space

    Nine Strategies to Guide Efforts to Reduce Youth Gun Violence

    Gun violence, including that perpetrated by young people, is a pernicious problem for many communities, particularly those facing historically high levels of concentrated disadvantage and disinvestment. To effectively address youth gun violence and establish and maintain peace, communities need stable safety infrastructures and effective interventions.We developed a research-based practice guide to help local governments, law enforcement agencies, and antiviolence organizations determine how to shape their approaches to reducing gun violence perpetrated by young people ages 10 to 25 in gangs or groups. Here, we summarize the guide's recommendations on how to develop effective interventions and build a broader safety infrastructure that supports the success of different partners working to protect young people and communities from gun violence

    A Research-Based Practice Guide to Reduce Youth Gun and Gang/Group Violence

    While extensive research exists, the field lacks a current and translational synthesis of what works to reduce youth group and gun violence. In response, the Urban Institute developed a research-based practice guide to inform local government, law enforcement, and community-violence-intervention stakeholders as they implement new antiviolence interventions and refine existing ones. To inform the development of the guide, Urban researchers conducted a comprehensive literature synthesis of research on violence reduction interventions and conducted a scan of interventions representing well-known antiviolence models and other innovative strategies. Drawing on the findings from the literature synthesis and scan of practice, the practice guide presents recommendations around nine practice areas related to building an infrastructure to support a multi-faceted antiviolence strategy and implementing effective violence reduction programs

    Quantum lattice dynamical effects on the single-particle excitations in 1D Mott and Peierls insulators

    As a generic model describing quasi-one-dimensional Mott and Peierls insulators, we investigate the Holstein-Hubbard model for half-filled bands using numerical techniques. Combining Lanczos diagonalization with Chebyshev moment expansion we calculate exactly the photoemission and inverse photoemission spectra and use these to establish the phase diagram of the model. While polaronic features emerge only at strong electron-phonon couplings, pronounced phonon signatures, such as multi-quanta band states, can be found in the Mott insulating regime as well. In order to corroborate the Mott to Peierls transition scenario, we determine the spin and charge excitation gaps by a finite-size scaling analysis based on density-matrix renormalization group calculations.Comment: 5 pages, 5 figure
