The Contemporary EU's Notion of Territoriality and External Borders

The predominant spatial conception of the EU contributes to an evident emergence of a sharpened territorial building of the European space. By all evidence the idea of both the territorial cohesion and territorial continuity shows how relevant the notion of territoriality in the ‘European discourse’ is and consequently how accepted the instrument of hard and closed border and the sharp inside/outside dichotomy are. Due to this pragmatic notion of territoriality, the idea of the EU as a ‘non-Westphalian new empire’ (according to the ‘neo-medieval paradigm’) became at least unrealistic. Its borders are getting more territorial, physical and visible. Hard border policies and practices on the Eastern and Western Balkan borders mirror the existence of a de facto barrier and of a deep ‘Westphalian memory’ in the way of using the territory as support of political unity

Supercritical carbon dioxide applications for energy conversion systems

In the present paper, the possibility of increasing the thermodynamic efficiency of an electric energy production plant, by using an advanced energy conversion system based on supercritical carbon dioxide (S-CO2) as working fluid, has been analyzed. Since the supercritical carbon dioxide cycles are being considered as a favorable candidate for the next generation of nuclear power plant energy conversion systems, a lead cooled fast reactor has been selected as reference in the present analyses. The main aim of the present study is to compare two different S-CO2 thermal cycles applied on the conversion system of a nuclear power plant. The reference Lead cooled Fast Reactor (LFR) used for the present analyses is the ALFRED reactor, which has a thermal power of 300 MW and it is considered the scaled down prototype of the industrial European Lead Fast Reactor (ELFR). Thermodynamic cycles selected for the present study are a Recompression Cycle and a Brayton Cycle with Regeneration. Each of them has been analyzed under several design conditions regarding the maximum pressure and the regeneration coefficient. Among different design conditions, the solution allowing the maximization of the overall efficiency has been identified. Thermodynamic analyses have been carried out with GateCycle™ v. 6.1.1, which is a General Electric software able to predict design and off-design performance of power plants

Italy’s approach to East–West and South–North migrations: from lack of knowledge to political use of them

After the end of the bipolar world, the possibility of an East–West mass migration became a new issue that took root in the Italian consciousness in forms masked by the feelings of the threat of an imminent “mass invasion” from Central and Eastern Europe. This new fear stimulated restrictive measures belatedly adopted in Italy and created a de facto unjust and imbalanced condition for new migrants from Eastern Europe because the first South–North migrations’ wave had already occurred when the regimes of Central and Eastern Europe collapsed. There are many evident similarities between the beliefs, attitudes and the use of insecurity (not based on data) of the 1990s and the current Italian migration policy. What they have in common is the incorrect perception and the misuse of it by politicians and propagandists. Immigration from Eastern Europe continues to be compared to that from the South of the world and Asia which continues to be interpreted without considering their real natures and the actual trends that characterise them. According to new studies that compared survey results with population data, contemporary Italians overestimate the number of immigrants coming from outside the EU to their country more than any other Europeans. As a result, the misuse or ignorance of the data on migrations is particularly dangerous because the devaluation of them has critical implications for policymaking

Over the past three decades, a debate has been developing in the world over the dynamics and legitimacy of the fragmentation of state territorial space, its sovereignty and unitary character, i.e., those geographical elements that have dominated European and later world political organization since the end of the medieval age. This discussion has been stimulated especially by the collapse of the Soviet Empire. The proliferation of declarations of independence have forced many scholars of political philosophy, law, sociology, and international relations to see that the international order, composed of sovereign territorial states, believed to be immobile and eternal (according to the principles of jus publicum europaeum), was undergoing profound changes

La condizione giuridica di Rom e Sinti in Italia

Il volume rappresenta un’assoluta novità nel panorama della letteratura giuridica italiana. Si tratta, infatti, della prima opera che cerca di fornire una visione completa, aggiornata e interdisciplinare dei problemi giuridici relativi alla condizione in Italia delle persone appartenenti alla minoranza dei Rom e dei Sinti. I capitoli fanno riferimento a molteplici aspetti con ricadute di rilievo tanto per la giurisprudenza costituzionale che per quella ordinaria, ma anche per il diritto dell’UE e la giurisprudenza della Corte europea dei diritti dell’uomo. Sono così approfonditi tutti gli aspetti della condizione delle singole persone (italiane, straniere o apolidi) e dello status della minoranza in sé, le norme statali e regionali rilevanti, le prassi istituzionali e i problemi di discriminazione, le raccomandazioni e le proposte emesse da organismi internazionali. Le analisi vanno a toccare il diritto costituzionale, pubblico e regionale, il diritto amministrativo e urbanistico, il diritto penale e processuale penale, il diritto civile, il diritto del lavoro, il diritto internazionale e dell’Unione europea. Sono presenti altresì riflessioni di diritto comparato (Francia, Spagna, Ungheria, Romania, Stati dell’ex-Jugoslavia), nonché analisi empiriche sulle prassi amministrative e giudiziarie. Oltre ad analisi svolte da giuristi accademici, l’opera contiene contributi di magistrati e avvocati, ma anche di sociologi, politologi, epidemiologi, antropologi e linguisti scelti tra coloro che più si sono distinti nello studio del mondo rom e sinto.
