    A utilização de plano de negócios como ferramenta de reequilíbrio econômico-financeiro em contratos de concessão de rodovias

    Bibliografia: p. 204-206.Este artigo pretende lançar luz sobre a potencial perda de eficiência econômica decorrente da vinculação, ao contrato de concessão, do plano de negócios entregue pela proponente no momento do leilão. O trabalho concentra-se sobre o setor rodoviário, no qual esse mecanismo vinha sendo extensivamente utilizado até as mudanças ocorridas nos contratos relativos aos leilões de 2013. Procurou-se evidenciar os efeitos perversos de tal vinculação sobre a modicidade tarifária e as formas como esse plano de negócios pode ser operado em benefício da concessionária regulada. Conclui-se que existem outras formas de assegurar a manutenção do equilíbrio econômico-financeiro do contrato compatíveis com o modelo de regulação adotado e que reduzem a assimetria de informação entre regulador e regulado. Tais formas vêm sendo adotadas nos últimos contratos de concessão rodoviária federal e em outros setores, como o aeroportuário.The objective of this article is to shed light on the potential loss of economic efficiency resulting from the binding of the business plan presented by the proponent at the auction time to the concession contract. This research focuses on the road sector, in which that mechanism had been extensively used until changes in contracts related to 2013 auctions. We intended to highlight the harmful effects of such binding on the low rates, and how this business plan can be operated for the benefit of the regulated concession holder. In short, there are other ways to ensure the economic-financial balance of the contract, according to the regulation model adopted, which reduce information asymmetry between regulator and regulated. Such ways have been adopted in the last federal highway concession contracts and in other sectors, such as the airport industry

    Association between light exposure and metabolic syndrome in a rural Brazilian town

    Context: Metabolic syndrome (MetS) is a complex condition comprising a ‘clustering’ of components representing cardiometabolic risk factors for heart disease and diabetes; its prevalence rate is high and consequences serious. Evidence suggests that light exposure patterns and misalignment of circadian rhythms might contribute to MetS etiology by impacting energy metabolism and glucose regulation. Objective: We hypothesised that individuals with MetS would show disrupted circadian and sleep parameters alongside differences in light exposure profiles. We investigated this using data from a cohort study in Brazil. Methods: Data from 103 individuals from the Baependi Heart Cohort Study aged between 50 and 70 were analysed. Motor activity and light exposure were measured using wrist-worn actigraphy devices. Cardiometabolic data were used to calculate the number of MetS components present in each participant, and participants grouped as MetS/non-MetS according to standard guidelines. Between-group comparisons were made for the actigraphy measures; additionally, correlation analyses were conducted. Results: Motor activity and circadian profiles showed no differences between groups. However, the MetS group presented lower light exposure during the day and higher light exposure at night. Correlation analyses, including all participants, showed that greater daytime light exposure and greater light exposure difference between day and night were associated with reduced MetS risk (a lower number of MetS components). Also, the light exposure difference between day and night correlated with body mass index across all participants. Conclusions: The observed results suggest a direct association between light exposure and MetS which appears to not be attributable to disruptions in circadian activity rhythm nor to sleep parameters. This link between light exposure patterns and MetS risk could inform possible prevention strategies

    A presente dissertação tem como objetivo o estudo do controle de constitucionalidade que envolve finalidades. Nesse âmbito, o trabalho pretende identificar e analisar quais as principais relações que as finalidades nutrem com as normas jurídicas e com outras finalidades; que fatores exercem influência sobre essas relações; qual a posição do legislador ordinário em face das finalidades da Constituição; e quais os tipos de raciocínio de que se vale o julgador ao lidar com fins. Para tanto, com arrimo na doutrina e na jurisprudência, a dissertação desenvolve certas distinções, tais como: finalidades contidas nas normas e finalidades justificantes das normas; normas-comando e normas-fim; valores e estados de coisas; relações conceituais e relações causais; promoção e restrição; oposição e divergência; interpretação e concretização, além de procurar estabelecer alguns critérios mínimos para a decisão no controle finalístico. Com base nos conceitos trabalhados, estuda-se o chamado desvio de poder legislativo. Com o fito de aplicar e exemplificar as ideias desenvolvidas, coletam-se manifestações de ministros do Supremo Tribunal Federal em litígios submetidos a sua apreciação. Relaciona-se sucintamente, por fim, o tema principal com os temas: controle incidental, efeitos da decisão e natureza da inconstitucionalidadeThis dissertation aims to study the constitutionality control that involves finalities. In this extent, the work intends to identify and analyze which are the main relationships that finalities maintain with juridical norms and other finalities; which factors influence these relationships; which is the position of ordinary legislator in view of Constitution; and what kinds of reasoning the judge apply when dealing with ends. To perform this task, with the support of doctrine and jurisprudence, the dissertation develops some distinctions as: finalities contained in norms and finalities that justify norms; command-norms and endnorms; values and states of affairs; conceptual relationships and causal relationships; promotion and restriction; opposition and divergence; interpretation and concretization, besides attempting to establish some minimum criteria to the decision in finalistic control. On the basis of these concepts, the work studies the so-called deviation of legislative power. In order to apply and exemplify the developed ideas, there are selected some manifestations of judges from Supreme Federal Court in disputes submitted to their appreciation. At last, the dissertation briefly relates the main theme to the following themes: incidental control, decision effects and nature of unconstitutionality

    O limite de comprometimento da Receita Corrente Líquida em contratos de parceria público-privada

    Bibliografia: p. 158-159Este artigo discute a aplicação do art. 28 da Lei Federal 11.079/2004, que trata do limite de comprometimento da Receita Corrente Líquida (RCL) de estados e municípios em projetos de concessão desenvolvidos no formato de parceria público-privada (PPP). Além de discorrer sobre o propósito do art. 28 e as alterações legislativas nele aplicadas, o texto aborda diferentes possibilidades interpretativas para o cômputo do limite, de modo que a restrição seja aplicada de forma razoável e não venha futuramente a coibir a utilização das PPPs para a implementação de políticas públicas.This work discusses the enforcement of article 28 of Federal Statute n.º 11.079/2004, which establishes a percentage limit for the expenditure of public revenues owned by states and municipalities in projects structured as public-private partnerships. Besides describing the objective of the constraint and the recently legislative modifications applied to article 28, this work proposes different interpretative possibilities for the limit computation. Once the proposed interpretations be adopted, this restriction would be enforced reasonably and wouldn’t represent a possible threat for the future use of PPPs

    Esse artigo tem por objetivo gerar hipóteses sobre a articulação entre política externa e política de defesa na gestão Cardoso. Partiu-se de estudo de caso sobre a formulação da Política de Defesa Nacional (PDN) e as conseqüências dessa para a institucionalização do Ministério da Defesa (MD). Constatou-se a baixa prioridade atribuída pela diplomacia ao poder militar como ferramenta de política externa. Finalmente, explicitou-se a inexistência de mecanismos efetivos de articulação.<br>This article has the objective of producing hypotheses on the articulation between foreign and defense policies during President's Cardoso administration. Initially, a case study on the formulation of the National Defense Policy Document (PDN) and its consequences to the institutionalization of the Defense Ministry (MD) was conducted. The low priority Brazilian diplomacy attributes to military power as a foreign policy tool was established. Finally, the lack of effective articulation mechanisms between foreign and defense policies was stressed

    Neotropical freshwater fisheries : A dataset of occurrence and abundance of freshwater fishes in the Neotropics

    The Neotropical region hosts 4225 freshwater fish species, ranking first among the world's most diverse regions for freshwater fishes. Our NEOTROPICAL FRESHWATER FISHES data set is the first to produce a large-scale Neotropical freshwater fish inventory, covering the entire Neotropical region from Mexico and the Caribbean in the north to the southern limits in Argentina, Paraguay, Chile, and Uruguay. We compiled 185,787 distribution records, with unique georeferenced coordinates, for the 4225 species, represented by occurrence and abundance data. The number of species for the most numerous orders are as follows: Characiformes (1289), Siluriformes (1384), Cichliformes (354), Cyprinodontiformes (245), and Gymnotiformes (135). The most recorded species was the characid Astyanax fasciatus (4696 records). We registered 116,802 distribution records for native species, compared to 1802 distribution records for nonnative species. The main aim of the NEOTROPICAL FRESHWATER FISHES data set was to make these occurrence and abundance data accessible for international researchers to develop ecological and macroecological studies, from local to regional scales, with focal fish species, families, or orders. We anticipate that the NEOTROPICAL FRESHWATER FISHES data set will be valuable for studies on a wide range of ecological processes, such as trophic cascades, fishery pressure, the effects of habitat loss and fragmentation, and the impacts of species invasion and climate change.
