Rethinking critical criminology - A panel discussion

This paper takes the form of a report on the panel discussion held at the conclusion of the 1992 meetings of the European Group for the Study of Deviance and Social Control in Padua in September 1992. In the light of a perceived crisis of relevance for earlier, 1970s notions of critique in criminology, and in the context of a conference dedicated to the theme of human rights in a uniting Europe, eight panellists from Italy, England, and Canada via Ireland debated their different versions of the project of critical criminology in the last years of the twentieth century. Each of these presentations is summarised here, and an attempt is made to recognise the emergence of a debate between a "human rights criminology", eversensitive to the possibilities of repression and control in Fortress Europe, and an alternative perspective, predicated perhaps on some notion of Social Defence and a realist programme of crime prevention and control across free market Europe

El objetivo de la conferencia fue explicar los debates contemporáneos sobre la existencia o no del giro punitivo en Europa, con especial mención del caso de Holanda. Para ello, en primer lugar, se expuso detenidamente la relación existente entre penalidad y desarrollo social. En segundo lugar, se presentaron los diferentes enfoques teóricos relacionados con el punitivismo, así como las críticas y aportes de dichos enfoques. Cross-Border Quest: The Reality and Legality of Transplant Tourism

Background. Transplant tourism is a phenomenon where patients travel abroad to purchase organs for transplants. This paper presents the results of a fieldwork study by describing the experiences of Dutch transplant professionals confronted by patients who allegedly purchased kidney transplants abroad. Second, it addresses the legal definition and prohibition of transplant tourism under national and international law. The final part addresses the legal implications of transplant tourism for patients and physicians. Methods. The study involved seventeen interviews among transplant physicians, transplant coordinators and policy-experts and a review of national and international legislation that prohibit transplant tourism. Results. All Dutch transplant centers are confronted with patients who undergo transplants abroad. The estimated total number is four per year. Transplant tourism is not explicitly defined under national and international law. While the purchase of organs is almost universally prohibited, transplant tourism is hardly punishable because national laws generally do not apply to crimes committed abroad. Moreover, the purchase of organs (abroad) is almost impossible to prove. Conclusions. Transplant tourism is a legally complex phenomenon that warrants closer research and dialogue.
