This article offers an extended critique of the Delaware Supreme Court\u27s unprecedented use of an entire fairness test in a breach of due care setting, as first articulated in Cede & Co. v. Technicolor, Inc. 634 A.2d 345 (Del. 1993) and Cinerama, Inc. v. Technocolor, Inc., 663 A.2d 1156 (Del. 1995). The article then argues for a generalized reasonableness standard for director conduct and for judicially reviewing care claims, thereby providing Delaware law with something it has lacked historically ? a pervasive (yet still streamlined) duty of due care

Roe and the Original Meaning of the Thirteenth Amendment

The current debate over Roe v. Wade as a substantive due process right has prompted scholars to investigate alternative sources for a constitutional right to abortion. One approach argues that the Thirteenth Amendment’s prohibition on “slavery” and “involuntary servitude” prohibits the government from denying women the right to terminate a pregnancy. Scholars making this argument con-cede that the right to abortion was not the expected application of the Thirteenth Amendment but insist that a forced continued pregnancy falls within the original meaning of the Amendment’s terms

Delaware Fiduciary Duty Law After QVC and Technicolor: A Unified Standard (and the End of Revlon Duties?)

This Article seeks to analyze and understand Paramount Communications, Inc. v. QVC Network, Inc. and Cede & Co. v. Technicolor, Inc. as part of a movement in Delaware fiduciary law toward a single, more unified standard, away from doctrinal fragmentation. In addition, the Article considers Delaware law leading up to QVC and Technicolor, tracing both the growing fragmentation of Delaware law in the 1980s and the growing judicial concern about fragmentation. This Article will argue that the concern over fragmentation and the desire for a unified standard were not the result of external pressures or policy concerns, but of internal judicial concerns about potential inequity, manipulability and lack of coherence in Delaware law. Finally, this Article will look at the practical significance of these new cases and the seeming trend toward a more unified conception of fiduciary law

Using Wave-Packet Interferometry to Monitor the External Vibrational Control of Electronic Excitation Transfer

We investigate the control of electronic energy transfer in molecular dimers through the preparation of specific vibrational coherences prior to electronic excitation, and its observation by nonlinear wave-packet interferometry. Laser-driven coherent nuclear motion can affect the instantaneous resonance between site-excited electronic states and thereby influence short-time electronic excitation transfer (EET). We first illustrate this control mechanism with calculations on a dimer whose constituent monomers undergo harmonic vibrations. We then consider the use of nonlinear wave-packet interferometry (nl-WPI) experiments to monitor the nuclear dynamics accompanying EET in general dimer complexes following impulsive vibrational excitation by a sub-resonant control pulse (or control pulse sequence). In measurements of this kind, two pairs of polarized phase-related femtosecond pulses following the control pulse generate superpositions of coherent nuclear wave packets in optically accessible electronic states. Interference contributions to the time- and frequency-integrated fluorescence signal due to overlaps among the superposed wave packets provide amplitude-level information on the nuclear and electronic dynamics. We derive the basic expression for a control-pulse-dependent nl-WPI signal. The electronic transition moments of the constituent monomers are assumed to have a fixed relative orientation, while the overall orientation of the complex is distributed isotropically. We include the limiting case of coincident arrival by pulses within each phase-related pair in which control-influenced nl-WPI reduces to a fluorescence-detected pump-probe difference experiment. Numerical calculations of pump-probe signals based on these theoretical expressions are presented in the following paper

Modulação transcricional de genes associados à fosforilação oxidativa em genótipos contrastantes de feijão-caupi submetidos à desidratação radicular.

Mitocôndrias são conhecidas como as "estações energéticas" da célula. Elas abrigam o processo de fosforilação oxidativa, através do qual o transporte de elétrons por meio de carreadores é acoplado ao bombeamento de prótons para o espaço intermembranar gerando um gradiente eletroquímico que fornece energia para a síntese de ATP. Tal molécula é de suma importância para os organismos vivos, pois cede energia para os processos celulares. No presente trabalho, foi analisada, via unitags SuperSAGE e de acordo com a base de dados KEGG, a regulação dos genes associados a enzimas participantes da fosforilação oxidativa, em genótipos contrastantes de feijão-caupi cultivados em hidroponia e submetidos à desidratação radicular por até 150 min. Resultados apresentaram um painel de genes diferencialmente regulados, sendo as principais divergências transcricionais entre os genótipos associadas a diferenças na regulação dos genes formadores dos complexos II, IV e V. Entretanto, maiores análises são necessárias para observar como essas diferenças influenciam fisiologicamente a espécie analisada

As lutas tradicionais Kaingang do Séc XXI

Trabalho apresentado no V CONPEF, Londrina-PR.O presente trabalho aborda as transformações ocorridas nas manifestações corporais Kaingang no estado do Paraná, fora desenvolvido por meio do Projeto “O Esporte/Lazer em Comunidades Indígenas no Estado do Paraná”, para tal fora elencados a prática descrita como Canjirê e Pinjirê como uma prática bélica, as manifestações identificadas na contemporaneidade são as Lutas Tradicionais Kaingang que em um primeiro momento muito se assemelha com o Judô, no entanto, um registro claro acerca de seu surgimento ainda não se sabe. Busca-se por meio da análise antropológica e pelo viés da psicologia histórico cultural a compreensão da transformação, sendo assim uma prática cultural ressignificada, ou seja, os valores sociais ainda estão atuando na dinâmica da comunidade, mostra elementos acerca da historicidade Kaingang e do Estado do Paraná, possibilitando assim vindouras práticas pedagógicas na educação física no estudo da luta com base em registros etnográficos, desenvolvimento da psiquê em enfoque dialético.REDE CEDE
