O niektórych ogólnych problemach kryminologii i znaczeniu paradygmatu humanistycznego
Trzeba zacząć od stwierdzenia, że kryminologia jest nauką autonomiczną i to w dwojakim sensie.
Po pierwsze, będąc nauką multidyscyplinarną nie jest zlepkiem różnych dyscyplin zajmujących się człowiekiem. Pod tym względem ma ona charakter wyjątkowy i osobliwy, bowiem całościowo i syntetycznie ujmuje człowieka i jego zachowanie. Człowiek jako istota o bardzo złożonej naturze bio-psycho-społecznej, stanowiącej jednak pewną jedność, musi być widziany całościowo i „szatkowanie” tej jedności między różnych specjalistów bez jakiejś syntezy nie może być uznane za badawczo satysfakcjonujące. Oczywiście – jak dobrze wiadomo – osiągnięcie potrzebnej tu syntezy jest bardzo trudne (Fragment tekstu)
Kryminogeneza i sposoby jej badania
Nie jest specjalnie odkrywcze stwierdzenie, że badania kryminologiczne są wielokierunkowe,
z całą pewnością jednak do centralnych przedmiotów badań należy, czy powinna należeć, kryminogeneza. Poświęciłem jej sporo uwagi w innym opracowaniu, tutaj więc ograniczam się do krótkiego zaakcentowania kwestii najważniejszych. Kryminogeneza to wpleciony w życie człowieka proces, którego finałem jest popełnienie
czynu zabronionego. Odgrywają w nim rolę różne tzw. czynniki kryminogenne, a także w pewnym zakresie czynniki antykryminogenne. Punktem centralnymtego procesu jest decyzja sprawcy czynu zabronionego. Jej znaczenie było ignorowane przez kryminologię nastawioną pozytywistycznie, natomiast w kryminologii
humanistycznej, której założeniem jest wizja homo eligens oparta na umiarkowanym indeterminizmie uznającym w pewnym zakresie wolną wolę człowieka, niezdeterminowana całkowicie przez czynniki biopsychospołeczne decyzja ma podstawowe znaczenie. Dzięki uwzględnianiu czynników negatywnych i pozytywnych kryminogeneza
służy też prognozie kryminologicznej, co powoduje konieczność sprawdzania trafności tej prognozy i ewentualnego badania kolejnej kryminogenezy (Fragment tekstu)
O efektywności prawa karnego, ciemnej liczbie, wiktymizacji i rozmiarach narkomanii
Trudno przecenić problematykę efektywności jakiejkolwiek gałęzi prawa. Prawo ma na celu organizowanie życia społecznego w tych wszystkich wypadkach, gdy takie organizowanie przez władze państwowe czy samorządowe jest potrzebne. Some general settlements concerning criminology and the importance of the humanistic paradigm
The article presents a series of statements concerning criminology: it is a autonomous and multidisciplinary science; it should be separated from the criminal policy and merged with the study of social pathology. The distinction between descriptive and explaining criminology is of certain importance. In the latter, the problem of assumed paradigm is of particular importance. Approximately since l960, in social sciences and in criminology the antinaturalistic paradigm prevails. Its nature is raises controversies. The author thinks that the antinaturalistic paradigm – understood correctly – must be a humanistic paradigm based on the idea of "homo eligens" (a choosing man) and a moderate indeterminism. This point of view has many advantages: among others, it explains poor effects of the research in the etiology of crime and the difficulties in the struggle against crime. Criminology must be developed. That is relatively easy within descriptive criminology but significantly more difficult in explanatory criminology, where the more interesting information must be obtained from the criminal himself
Le problème de l'intégration des sciences et la criminologie
L'auteur s'occupe du problème de l'intégration des sciences né en conséquence d';un énorme développement de la science a l'heure actuelle. „L'émiettement'' progressif a causé, à l'avis de l'auteur, le postulat de l'intégration des sciences. L'auteur souligne que les problèmes de jonction de l'intégration des sciences n'ont pas été encore élaborés de la manière générale et définitive. Ensuite il commence à discuter la problématique de l'intégration en criminologie. Il cite à ce propos les opinions de H. Schellhoss et M. B. Luszki. L'analyse des Maisons de la criminologie avec d'autres sciences commence par la définition de la criminologie. L'auteur croit, que cette science vise à la •connaissance universelle des phénomènes psyche-physiques et sociaux: de l'infraction aux lois, de la criminalité, du criminel et du fonctionnement des mesures juridiques-répressives pourla lutte contre la criminalité. Comme une tache principale de la criminologie l'auteur reconnait la question de l'explication de la genèse de la criminalité. En examinant ce probléme il souligne l'acception des suivants ensembles d'éléments: l'acte délictueux, la situation extérieure et intérieure, la personnalité, l'environnement et l'organisme. Dans la sphère des ensembles donnés d'éléments l'auteur souligne de grandes compétences de telles sciences comme: la doctrine du droit pénal, psychologie, psychiatrie, psychosociologie, sociologie et biologie. From a naturalistic to a huma7iistic paradigm on chief behavioural sciences and in criminology
The author begins with a characterization of behavioural sciences, to which
he includes the sciences dealing with a human being and the society. Typical behavioural
sciences are criminology and a science of social pathology, tightly connected
with the former one. Having explained the concept of paradigm and commented
on the structure of science, which usually includes also basic ontological
assumptions, the author presents a naturalistic paradigm of behavioural sciences
formulated by positivism. It includes the following elements: 1) strict determinism
in conceiving human behaviour; 2) methodology based on natural sciences; 3) reductionists
tendencies consisting in attempts to explain human behaviour by reference
to biological or the like processes. A naturalistic paradigm, dominating
for several decades, have produced distinct symptoms of a crisis in behavioural
sciences. Their development is insufficient. Thus, it is high time to focus attention,
on antipositivistic tendencies which have become stronger and stronger since the
1960s. They can be traced in such trends as interactionism, phenomenological sociology,
ethnomethodology or humanistic psychology. A new paradigm — the humanistic
paradigm — starts to appear. It contains the following elements: 1) since
a human being possesses some onthological autonomy, strict determinism must
be rejected; 2) the methodology of natural sciences must be complemented with
methods allowing to reach to the abundance of psychical states of an individual;
3) instead of the simplyfying reductionism, a complex outlook on human behaviour,
where autonomy and different determinants appear simultaneously, must be
applied. There is an urgent need to perform a thorough analysis of the elements
of a humanistic paradigm and to develop new theories and new empirical research
