    In criminal procedural law, we know that to prove that an event was a criminal event, a mechanism is needed which is not simple. In the Criminal Code, it is stated that it must fulfill several conditions for an event to be included in the category of a criminal act, namely that it must go through just evidence, of course in fair proof it must be supported by evidence stipulated in Article 184 paragraph (1) of the Criminal Procedure Code. In addition to witness statements, there is also evidence from expert testimony. The expert gap is mentioned in Article 1 number 28, namely information given by someone with special expertise on matters needed to explain a criminal case for examination purposes. Then, sometimes the examination of a case by a judge requires expert testimony from various fields of science which implies that several experts must be presented who can clarify a case, here the question arises when these experts are presented, especially in expert examinations whose fields are contradictory to each other, so that cross-examination can be carried out. experts. In addition, problems that arise in criminal trials related to expert testimony are related to the time or when (timing) the expert is presented, so far we both know that after the statement of the defendant, the examination of evidence is considered to have ended. However, often the public prosecutor, legal advisers, and the judge himself want to dig deeper into the case being examined, especially about expert testimony, this is where a problem is found because the procedural rules have not been clearly explained, while the nature of procedural law itself is rigid and limitations

     Penelitian ini dilakukan mengenai implementasi AMDAL di daerah perumahan di Tatah Belayung Baru. Lokasi yang dipilih sebagai penelitian merupakan lokasi yang terdampak perubahan lahan pertanian yang berubah menjadi lahan perumahan. Target dari kegiatan ini dilakukan untuk Pemerintah Daerah, Developer dan Masyarakat yang berada di lingkungan tersebut. Implementasi AMDAL ini berpengaruh untuk kebijakan mengenai perizinan yang ada di Tatah Belayung Baru disebabkan daerah tersebut dibuat perumahan. Izin Peruntukan Penggunaan Tanah adalah izin yang wajib dimiliki oleh setiap warga masyarakat yang akan mengubah tanah pertanian menjadi non pertanian. Fungsi dari izin peruntukan penggunaan tanah adalah untuk menekan serta pengendalian alih fungsi lahan yang terjadi. Tanah sawah (tanah pertanian) yang akan diubah ke non-pertaniantentunya haruslah sesuai dengan rencana tata ruang dan wilayah di Tatah Belayung Baru agar terjadi kesimbangan dimasa mendatang. Adanya alih fungsi lahan pertanian menjadi perumahan menyebabkan penyusutan jumlah lahan pertanian terus berkurang, hal ini menjadi masalah bagi pemerintah sendiri untuk menyediakan pasokan pangan. Berkurangnya lahan pertanian dalam arti untuk penyediaan bahan-bahan pangan, juga berakibat rusaknya ekosistem alam sebagai tempat penyerapan air hujan sebagai pencegah banjir.Kata-Kunci: Implementasi AMDAL, Lahan Pertanian, PerizinanThis research was conducted on the implementation of AMDAL in a residential area in Tatah Belayung Baru. The location chosen as the research is a location that is affected by changes in agricultural land that are turned into residential land. The target of this activity is for the Regional Government, Developers and Communities in the environment. The implementation of this AMDAL has an effect on policies regarding existing permits in Tatah Belayung Baru because the area is made into housing. Land Use Permit is a permit that must be owned by every citizen who will convert agricultural land into non-agricultural land. The function of the land use permit is to suppress and control the land conversion that occurs. Paddy land (agricultural land) which will be converted to non-agricultural land must of course be in accordance with the spatial and regional planning in Tatah Belayung Baru so that there is a balance in the future. The conversion of agricultural land into housing causes the shrinkage of the amount of agricultural land to continue to decrease, this is a problem for the government itself to provide food supplies. The reduction of agricultural land in the sense of providing food, also results in the destruction of natural ecosystems as a place to absorb rainwater as a flood prevention.Keywords: AMDAL Implementation, Agricultural Land, Licensin

    The purpose of this study is to analyze the Hand-Catching Operation (OTT) system carried out by the Corruption Eradication Commission and also how the Effectiveness of the Hand-Catching Operation Position (OTT) carried out by the Corruption Eradication Commission (KPK) in the perspective of legal certainty. The type of research used is normative legal research by collecting andanalyze legal material related to the issue to be discussed. As well as comparing several judge's decisions related to the one in question. The results of this study are that the Hand-Catching Operation is an Illegal Action or an arrest where this action can be a reason for carrying out a Pretrial, in which the meaning of Hand-Catching Operation (OTT) still does not have a clear meaning, legal basis and direction. Because the Hand-Catching Operation (OTT) does not have clear regulatory basis in Corruption Crimes, it follows from the juridical implications of the process of investigating Corruption criminal cases. The Hand-Catching Operation carried out by the Corruption Eradication Commission is also an act of Super Power because it is not contained in the Criminal Procedure Code (KUHAP), so the concept of Hand-Catching Operation is still a question mark against the legal framewor

    The purpose of doing this research is to analyze first, How is the measure of violating the public interest as a reason for the attorney to dissolve a limited liability company; and secondly, what are the legal steps for a limited liability company that was filed for dissolution by the Attorney General's Office on the grounds that it violated the public interest. First Research Results because the definition of public interest is still dynamic and keeps up with the times and in UUPT does not explain the definition of public interest in detail. then the measure of violating the public interest is taken from the law which provides a definition of public interest in the Land Law, the Prosecutor's Law, the State Administrative Court Act. So that if a Limited Liability Company violates the understanding of a public interest as described in the law, the Limited Liability Company will automatically violate the Public Interest. Second: The legal steps taken are filing an objection in court on the basis that the dissolved Limited Liability Company can still carry out re-management and improve the company even better so that it can operate again in accordance with applicable regulations

    Tujuan penelitian ini adalah untuk menganalisis batasan penyidik melakukan penyadapan dalam tahap penyidikan dan Pengujian terhadap keabsahan tindakan penyidik dalam melakukan penyadapan. Jenis penelitian hukum yang digunakan adalah jenis penelitian hukum normatif. Penelitian ini adalah penelitian hukum dengan menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Hasil dari penelitian ini menjelaskan bahwa Pertama Batasan penyidik melakukan penyadapan dalam tahap penyidikan adalah mengacu kepada Standar Operasional Prosedur yang telah diatur dalam undang-undang khususnya masing-masing. Pada pokoknya Putusan Mahkamah Konstitusi Nomor 5/PUU-VIII/2010 menyatakan pada pokoknya penyadapan (interception) adalah sebuah perbuatan melawan hukum. Hal ini dikarenakan penyadapan merupakan sebuah tindakan yang melanggar privasi orang lain dan oleh karenanya melanggar hak asasi manusia. Sehingga batasan penyidik dalam melakukan penyadapan harus diawasi dengan ketat dalam aturan yang berlevel undang-undang. Dan Kedua, Penyadapan atau intersepsi merupakan salah satu upaya penegak hukum yang istimewa dalam usaha menemukan bukti-bukti yang cukup guna proses penyidikan. Pengujian terhadap keabsahan tindakan penyidik dalam melakukan penyadapan masih belum jelas diatur. Terhadap penyadapan yang dilakukan penyidik diluar prosedur yang ditentukan masih memungkin terjadi, hal ini disebabkan tidak adanya mekanisme yang dapat menguji keabsahan penyidik dalam melakukan penyadapan

    THE DOCTRINE OF PUBLIC POLICY AS A GROUND FOR THE ANULLMENT OF ARBITRAL AWARD IN INDONESIA

    This research aims to determine the position of the doctrine of public policy as a ground to annul foreign arbitral awards in Indonesia. The methodology used in this research is normative juridical research method. The results of the study concluded that in practice the use of public policy doctrine as a reason for the annulment of awards may be conduct by the country, because if the award is executed it will cause a great jolt in the Indonesian legal system. However, on the other hand, if this doctrine is often used as a reason to refuse an enforcement of foreign arbitral awards, it will also be a negative assessment for Indonesia in the eyes of the world and affect Indonesia's relations with other countries.Key Words: Public Policy, Award,Arbitratio
