Perda Progressive : an Alternative to Fulfillment of Poor People Rights of Health in Local Autonomy
Autonomy system based on act No. 32 /2004 directed the effort to accelerate the realization of thepeople\u27s welfare. Level of welfare can be measured through human development index consist of twomain indicators, that are health and the economy. Autonomy will be encourage government localaccountability and increased sensitivity to provide public goods and services. Accountability andsensitivity of local government based on Perdawhich is form of local legislation.However, the fact shown that there has been a gap between perda and social condition materialized inthe form of poverty. Perda can not guarantee the health rights for the poor in term of freedom,availability, affordability, acceptability and quality. In addition, there is lack on the quantity of perdaand quality of perdas a legal framework to ensure the good services provided by local government.The fulfillment of the health poor rights is requiring progressive perda encompassing the aspects ofauthority, procedure and substance of perda. The moralityof perda progressive can be achieved throughthe empowerment for the poor using a rights-based approach. Restorative Justice as an Effort to Fulfill the Constitutional Rights of Citizens: Restorative Justice sebagai Upaya Pemenuhan Hak Konstitusional Warga Negara
This study aims to determine whether the settlement of criminal cases through restorative justice is an effort to fulfill the constitutional rights of citizens. The method used in this research is normative legal research with a statutory approach and a conceptual approach. The results of the study show that the settlement of cases through restorative justice is an effort to fulfill the constitutional rights of citizens because the principle of resolving cases through restorative justice can be said to be more able to guarantee justice and equality before the law (equality before the law) as regulated in Article 27 paragraph (1), Article 28D paragraph (1) and Article 28I paragraph (2) of the 1945 Constitution of the Republic of Indonesia
Hukum dan Bahasa: Refleksi dan Transformasi Pemenuhan Hak Ekonomi, Sosial dan Budaya
The regulation of economic, social and cultural rights is always intertwined with language. Language is significant in the written dimension of legal protection and the legal fulfillment of rights. The text of the law is a commitment to fulfilling rights. Understanding the structure of the text is necessary to predict and reach the needs, as well as to fulfill the rights. States must be able to recognize legal texts that are aligned and responsive. These legal texts must favor the fulfillment of the civil rights through language that reflects and transforms elements of the economic, social, and cultural rights (ie. freedom, availability, accessibility, and conformity). Yet, it is often that the language in the legal text formulated is inconsistent and uncertain. Language as a tool of transformation can also become a tool that shackles. This issue requires an understanding of intertextuality, with respect to the text of the law. One strategy is to highlight the elements in legal texts: principles, standards, and concepts to enforce values and legal goals. This effort is intended to understand the various factors and relationships that affect the accuracy of meaning, and subsequently reflect on the purpose of formulating that legal text. The discovered weakness of the text can thus be reconstructed in responsive, progressive and communicative spaces and structures.

MODAL SOSIAL DAN KOMUNITAS AGAMA SEBAGAI PENDUKUNG INSTRUMEN HUKUM DALAM PENGELOLAAN SAMPAH DI KOTA METRO
Tulisan ini mengajukan argumentasi bahwa modal sosial masyarakat, partisipasi komunitas-komunitas agama di suatu wilayah merupakan salah satu faktor pendukung bekerjanya instrumen hukum dan kebijakan. Tulisan ini mengambil studi di Kota Metro yang mayoritas masyarakatnya adalah suku Jawa dan juga memiliki beragam pemeluk agama. Filosofi hidup Rumongso Melu Handarbeni yang diyakini oleh masyarakat Jawa dalam prakteknya ikut mendukung berbagai program Pemerintah Kota Metro. Di sisi lain keberadaan berbagai komunitas agama yang ada di Kota Metro sesungguhnya memiliki potesi yang besar dalam mendukung Kota Metro yang berwawasan lingkungan. Agama dengan ajaran tentang kepedulian lingkungan akan dapat menjembatani proses bertemunya modal sosial dan kebijakan pemerintah dalam mengatasi permasalahan lingkungan khususnya sampah di Kota Metro. Agama Islam dan Kristen dapat menjadi prototype dalam membangun kesadaran lingkungan antarpemeluknya. Pada konteks inilah usaha Pemerintah Kota Metro dalam membentuk sebuah produk hukum daerah sebaiknya memperhatikan modal sosial masyarakat. Hal ini harapanya akan mampu mendukung proses transformasi Kota Metro menuju Kota yang berwawasan lingkungan.This article discribes about social capital behold, the participate of religion communities in the region is one of the supporting factor to operation of legal instruments and the policy.This paper a study in Metro when the major of Javanese and also has a variety of faiths. Navigating Legal Complexities in Localising the Sustainable Development Goals Agenda for Village Governance in Indonesia
Indonesia\u27s commitment to the global Sustainable Development Goals (SDGs) is exemplified by its Village SDGs program, which serves as a strategic pilot initiative. Nevertheless, the efficacy of the Village SDGs is contingent upon several critical factors, including resource availability, community engagement, and stakeholder collaboration. These factors present significant challenges that impede progress. Given that villages constitute 91% of Indonesia\u27s territory, developments at this local level have profound implications for the national implementation of the SDGs. This study elucidates that persistent challenges in resource allocation and stakeholder coordination remain despite advancements in embedding the SDGs within the national legal framework. The assessment of the Village SDGs highlights local capacity disparities and underscores the necessity for enhanced support mechanisms. Integrating the SDGs within village governance necessitates tailored approaches that are sensitive to local contexts. This paper establishes a comprehensive framework for the Village SDGs roadmap within local governance to achieve the global agenda. It explores three pivotal aspects, namely the incorporation of the SDGs into the national legal framework, the evaluation of Village SDGs implementation, and the contextualisation of the SDGs within village governance. Employing a normative legal approach and secondary data sources, the research reveals significant progress while also identifying critical gaps that must be addressed to ensure the effective implementation of the Village SDGs
