El anonimato en las donaciones de engendramiento: filiaciĂłn e identidad narrativa infantil en tiempos de descasamiento
Many european countries have decided to lift up the anonimity about sperm and egg donations in the assisted reproduction -AR- processes . At this time, when France begins to check the bioethic law, this article shows why in a kinship sociology based on a comparative and historical anthropology and faithful to the Marcel Mauss approach, allows to update this debate in three ways. First, shows that to lift up the anonimity entails a general transformation on the way to understand the donations on the AR, distinguishing from now on between two complementary status: the donor of reproductive material and the parents by filiation. Secondly, shows that the engender concept as “complex human action” can help us to leave the biased opinions that commonly separates two irreconciliables scenes: the one of the “gametes donation” -eclipsing the doctors- and the other of the “assisted reproduction” - eclipsing the donnors-. To sum up, shows how the anonimity rests implicitly on a particular representation of the filiation: the traditional and lawful parenthood. The author encourage to weight up the decisive dimention of the gender on the Assisted Reproduction at large way and to relocate the bioethical reflection within a more general reflection about the contemporary transformations of the kinship and the basic conditions for the construction of the children´s speech identity.Muchos paĂses europeos han decidido levantar el anonimato sobre las donaciones de esperma y ovocitos en los procesos de reproducciĂłn asistida -RA-. En este momento en el que se empiezan a revisar en Francia las leyes sobre bioĂ©tica, este artĂculo muestra por quĂ© una sociologĂa del parentesco inscrita en una antropologĂa comparativa e histĂłrica, fiel al enfoque de Marcel Mauss permite actualizar este debate de tres maneras. En primer lugar, muestra que levantar el anonimato conlleva una transformaciĂłn general de la forma de entender las donaciones en la RA, distinguiĂ©ndose de ahora en adelante entre dos estatus complementarios: donante de material reproductivo y padres por filiaciĂłn. Por otra parte, muestra que la nociĂłn de engendramiento, entendida como “acciĂłn humana compleja”, puede ayudarnos a escapar del pensamiento sesgado que separa comĂşnmente dos escenas irreconciliables: la “donaciĂłn de gametos” -eclipsando a los mĂ©dicos- y la “reproducciĂłn asistida” -eclipsando a los donantes-. En suma, muestra cĂłmo el anonimato descansa implĂcitamente sobre una representaciĂłn de la filiaciĂłn muy particular: la paternidad legĂtima tradicional. La autora anima a sopesar la dimensiĂłn decisiva del gĂ©nero en la ReproducciĂłn Asistida de una forma amplia y a resituar la reflexiĂłn bioĂ©tica dentro de una reflexiĂłn más general sobre las transformaciones del parentesco contemporáneo y las condiciones elementales de construcciĂłn de la identidad narrativa de los hijos.De très nombreux pays europĂ©ens ont dĂ©cidĂ© de lever l’anonymat des dons de sperme et d’ovocytes dans l’aide mĂ©dicale Ă la procrĂ©ation -AMP-. Alors que la France s’apprĂŞte Ă revoir ses lois bioethiques, cet article montre pourquoi une sociologie de la parentĂ© inscrite dans une anthropologie comparative et historique fidèle Ă la dĂ©marche de M. Mauss, permet de renouveler ce dĂ©bat de trois façons. Tout d’abord, en montrant que lever l’anonymat implique un changement gĂ©nĂ©ral de la comprĂ©hension des dons en AMP distinguant dĂ©sormais deux statuts complĂ©mentaires: donneur d’engendrement et receveur/parent par la filiation. Ensuite, en montrant que la notion d’engendrement comprise comme“action humaine complexe” permet d’échapper Ă la pensĂ©e clivĂ©e qui sĂ©pare habituellement deux scènes incompatibles: celle du “don de gamètes” -effaçant les mĂ©decins- et celle de la “procrĂ©ation mĂ©dicalement assistĂ©e” -effaçant les donneurs-. Enfin, en montrant que l’anonymat repose implicitement sur une reprĂ©sentation de la filiation bien particulière -la paternitĂ© lĂ©gitime traditionnelle-. L’auteur incite Ă prendre la mesure de la dimension dĂ©cisive du genre dans l’Aide MĂ©dicale Ă la ProcrĂ©ation en gĂ©nĂ©ral, et Ă replacer la rĂ©flexion bioĂ©thique au sein d’une rĂ©flexion bien plus globale sur les mutations de la parentĂ© contemporaine et les conditions Ă©lĂ©mentaires de construction de l’identitĂ© narrative des enfants
The PACS and marriage and cohabitation in France
National audienceChange in marriage and cohabitation began in France thirty years ago. 2.5 million cohabiting couples and more than 40 per cent of births outside marriage reveals not only a new acceptability of cohabitation and family formation out of wedlock, but a new social signification of marriage itself. In this paper, we analyse what appears to have been a 'soft' revolution, widely accepted, and a paradoxical mutation. While the abandonment of a strictly matrimonial conception of the family is generally accepted in France, attitudes are much more contradictory with respect to legal rights of unmarried couples. The long, complex and controversial story of the evolution of the Pacs (Parte Civil de Solidarité, shows, behind the issue of homosexuality, how difficult it is for French culture to conceive a legal status of non-married couples. The Pacs, as a new possibility for heterosexual as well as homosexual cohabitees, is not easy to define from a legal point of view. This intermediate status, neither a union nor a contract, neither private nor public, expresses the ambiguity of the French way of responding to increasing cohabitation. Analysing the Pacs as a transitory law, we suggest that a complex jurisprudential story is now beginning in France. This paper ends with a broader perspective on the interpretation of family change: no consensus exists in academic and political circles. The new forms of social inequalities will certainly represent one of the main issues in the public, academic and political debate in the future
Le genre : identité des personnes ou modalité des relations sociales ?
Cet article prĂ©sente une rĂ©flexion thĂ©orique sur la notion de genre, de ses dĂ©finitions et ses usages en sciences sociales. S’opposant Ă l’approche dominante qui conçoit le genre comme identitĂ© ou attribut socialement construits des personnes, conception qu’elle considère comme essentialisante ou substantialisante, l’auteur argumente en faveur d’une approche relationnelle du genre conçu comme modalitĂ© des relations sociales. Elle se fonde pour cela sur des travaux d’anthropologie comparative et historique qui contraignent Ă reconsidĂ©rer le dualisme du moi et du corps constitutif de l’idĂ©ologie individualiste de la personne, et critique l’hypostase du Moi comme homoncule constituĂ© Ă partir d’une absolutisation de la première personne. Analysant le système sexuĂ© des trois personnes grammaticales, elle soutient que, n’étant pas rĂ©fĂ©rentiel, « le je de l’interlocution n’a ni sexe, ni genre ». Les apports croisĂ©s de l’anthropologie et de la philosophie analytique la conduisent Ă revoir la notion de personne pour mieux penser la capacitĂ© proprement humaine de se reconnaĂ®tre comme d’un sexe sans ĂŞtre jamais assignĂ© Ă celui-ci.This article presents a theoretical work on the idea of gender, its definitions and uses in social science. The author objects to the mainstream approach that sees gender as an identity or an attribute that some people socially construct. She sees that idea as essentializing or substantializing. She argues in favor of a relational approach of gender conceived as mode of social interactions. Her approach is based on comparative and historical works of anthropologists that lead to consider the dualism of the ego and the body which make the individualistic ideology of a persona, and she criticizes the hypostasis of the ego as homunculus made up from absolutizing the id. Analyzing the gender system of the three grammatical persons, she asserts that, as it is not a reference, the other person’s “I” does not have a sex nor a gender. The contributions from both anthropology and analytic philosophy lead her to reconsider the notion of persona so as to better grasp the capacity—specifically human—to see ourselves belonging to a sex group without having ever been assigned to it.Este artĂculo presenta una reflexiĂłn teĂłrica respecto a la nociĂłn de gĂ©nero, de sus definiciones y sus usos en ciencias sociales. OponiĂ©ndose al enfoque dominante que concibe el gĂ©nero como identidad o atributo socialmente construidos de las personas, concepciĂłn que considera como esencializante y sustancializante, la autora argumenta a favor de un enfoque relacional del gĂ©nero concebido como modalidad de las relaciones sociales. Para ella, se basa en los trabajos de antropologĂa comparativa e histĂłrica que obligan a reconsiderar el dualismo del yo y del cuerpo constitutivo de la ideologĂa individualista de la persona, y critica la hipĂłstasis del Yo como homĂşnculo constituido a partir de una absolutizaciĂłn de la primera persona. Al analizar el sistema sexuado de las tres personas gramaticales, sostiene que al no ser referencial, “el yo de la interlocuciĂłn no tiene ni sexo, ni gĂ©nero”. Los aportes convergentes de la antropologĂa y de la filosofĂa analĂtica lo llevan a reconsiderar la nociĂłn de persona para pensar mejor la capacidad propiamente humana de reconocerse como de un sexo sin nunca ser asignado a Ă©l.Dieser Artikel bietet theoretische Ăśberlegungen ĂĽber den Begriff Gender, seine Definitionen und seinen Gebrauch in den Sozialwissenschaften. Die Autorin setzt sich gegen die meist verbreitete Auffassung des Genders als sozial aufgebaute Identität oder Attribut des Einzelnen, denn sie betrachtet sie als eine essentialisierende bzw. substantialisierende Definition. Dagegen argumentiert sie fĂĽr eine beziehungsmäßige Herangehensweise an das Gender, die es als eine Modalität der sozialen Beziehungen erfasst. Sie bezieht sich dabei auf vergleichenden und historischen Anthropologiearbeiten, die uns dazu zwingen, das Dualismus des Ichs und des Körpers zu ĂĽberdenken, der einen Bestandteil der individualistischen Ideologie des Menschen darstellt, und kritisiert dazu die Hypostase des Ichs als Einzelnen, der auf Grund einer Absolutisierung der ersten Person geschaffen wird. Indem sie das geschlechtliche System der drei grammatikalischen Personen analysiert, behauptet die Autorin, dass auf Grund seiner UnbezĂĽglichkeit „das Ich in der Interlokution weder Geschlecht noch Gender hat“. Die Beiträge der Anthropologie und der analytischen Philosophie fĂĽhren zu einer Ăśberdenkung des Begriffs Mensch, um die rein menschliche Fähigkeit besser zu erfassen, die darin besteht, dass man sich einem Geschlecht anschlieĂźt, ohne dass es einem je zugewiesen wird
