Stewardship Plan Isinglass River Conservation Reserve, Strafford, NH
In addition to the significant frontage on the Isinglass River, the Hanson Lot supports myriad wetlands â vernal pools, beaver flowages, forested swamps, meadow marshes, and scrub-shrub wetlands. These are embedded within a hemlock â oak â beech - pine forest that was heavily logged in 1998. A plan to build a large 58- to 70-lot residential subdivision on the property was averted by the acquisition of the Hanson Lot as permanent conservation land. The Bedford property is also mostly wooded; the forest was carefully managed by previous owners and therefore retains a mix of tree species and ages. Together the properties are embedded within a 1,800-acre block of undeveloped lands that offers habitat for wide-ranging wildlife, protects water quality, and provides unique recreational experiences. A woods road runs through both properties, used by snowmobilers, hikers, mountain bikers, and horseback riders. The river corridor is a popular fishing destination
Non-Responders: Current Findings in Reading Instruction as Related to Students Unresponsive to Early Intervention
Questions still remain about whether or not current research â based reading instruction is effective for all students. There is a population of students that continue to struggle to learn how to read despite the use of research â based instruction. This population of students has been termed ânon â respondersâ or âtreatment resisters.â The emphasis on research â based reading instruction has promoted an increase of reading levels among students in the United States; however, the limited amount of research on the needs of students who are non â responder has yielded mixed reviews. The following paper will address current reading instruction practices that are in place for all students to become successful readers. In addition, the paper will present a review of what current research says about the characteristics of students who are non â responders, and suggested elements of effective instruction for this population
Evaluating Flight Delay Benefits From The NextGen Program
This research proposes a method to simulate the flight delay effects of the NextGen program against an actual flight schedule. With the advent of the NextGen program and the substantial cost associated with the program, this research studies the impact the NextGen program may have on flight delays, an area critical to air carrier operations. This research is based on historical results from the summer of 2013 flight schedule to study the impact of a simulated NextGen implementation. The research studied aircraft on a given day looking specifically at the propagation effects of a flight delay and how it would change the total delay for a day. This study was conducted used a delay reduction distribution applied to historical flight delays attributed to the National Airspace System category. The research found a significant reduction in median flight delays per aircraft per day between the simulation results and historical delay. The delay reduction distribution was sampled to estimate the reduction for each segment in the flights for an aircraft\u27s day. Therefore, only reductions of delay or no changes to delay are possible in this study.
At-Will Fiduciaries? The Anomalies of a âDuty of Loyaltyâ in the Twenty-First Century
This article proposes a means of improving the at-will world for employeesâinsofar as that world includes the threat of a sudden end to oneâs livelihoodâthat does not tamper with the âat-will-nessâ of termination itself. An at-will employee should owe only the duty of âgood faith and fair dealingâ derived from contract law, which, in effect, would fill any hole left in the legal web defining the employment relationship when the duty of loyalty is excised. Part II of this article provides an overview of the duty of loyalty as it is applied by the courts in the various states. Part III returns to various aspects of the law regarding the duty of loyalty that are particularly ambiguous and argues the ambiguity infects the very validity of imposing a duty of loyalty and renders it very difficult for employers and employees to understand and comply with the duty. Part IV illustrates why the jurisprudential provenance of the duty of loyaltyâemanating from the medieval doctrine of master and servantâunderstandably does not map clearly onto the twenty-first-century global employment market. Finally, Part V argues the duty of loyalty is not necessary to âprotectâ the employer from âbadâ conduct on the part of the employeeâwhich is its essential functionâand that if removing the duty of loyalty does pose any significant threat, requiring good faith and fair dealing by the employee satisfactorily fills any perceived gaps
Sovereign Immunity Tests Bankruptcyâs Least Contested Axioms
Section 106 of the Bankruptcy Code expressly abrogates the sovereign immunity of governmental units with respect to fifty-nine other provisions of the Code. There are currently two distinct issues splitting circuit courts over the meaning of this provision. First, does section 106 waive the sovereign immunity of the Internal Revenue Service in avoidance actions brought against it by a bankruptcy trustee under section 544(b)? Second, are Native American Indian Tribes âgovernmental unitsâ within the meaning of section 101(27), such that their sovereign immunity is abrogated to the extent set forth in section 106? Invoking conventional canons of statutory construction, this Article takes the minority position on both issues, arguing that the IRS may not be sued under section 544(b) and that Tribes are not governmental units within the meaning of the Code. Moreover, these issues illustrate a tension between two of bankruptcyâs least contested axioms: (1) creditors with legally similar claims should be treated similarly; and (2) bankruptcy should not adjust nonbankruptcy entitlements unless necessary. A textualist reading suggests that, when it comes to sovereign immunity, the Code cuts this tension by privileging the second axiom over the first. It is for Congressânot the judiciaryâto change that if necessary
Exploring the Market Potential for Aquaculture Grown Quahogs in the Gulf of Maine
This report is a qualitative analysis of the viability of establishing a market for aquaculture-grown quahogs (Mercenaria mercenaria) in the state of Maine. Our work is in conjunction with Manomet and the University of Maine Orono and is funded by the National Sea Grant Office. The aim of the project is to explore the barriers and opportunities of establishing such a market for farmed quahogs as a livelihood diversification strategy for Maine fisherman and aquaculturists.
Our research on the possibility of a regional quahog market relies on interviews with seven shellfish managers and four shellfish dealers from across the eastern seaboard. All interviews follow a prescribed set of questions provided by Manomet. The testimonies of shellfish managers and dealers provide a basis for qualitative coding, and our group categorized them according to environmental, human, and regulatory factors. Each of these subcategories contain numerous classifications of coded data populated with anywhere from one to five corroborating interviewees. We further classified these results as barriers and opportunities to the establishment of a farmed quahog market. These barriers and opportunities inform the recommendations for further study and aquacultural work.
Our results indicate that among the most prominent barriers to establishing a farmed quahog market are issues of siting and leasing for fisheries as storms and water temperatures. However, these climatic factors also provide the state of Maine with certain advantages that differ from those experienced by aquaculturists in other states. Furthermore, interviewees expressed the need to fill a gap in the seafood industry, affirming that farmed quahogs could expand and diversify fishing opportunities. None were opposed to a farmed quahog market, but all interest varied based on the perceived ability of such a market to be lucrative in comparison to the wild harvest
Evidence for narrow resonant structures at and GeV in real Compton scattering off the proton
First measurement of the beam asymmetry for Compton scattering off
the proton in the energy range GeV is presented. The
data reveals two narrow structures at and
GeV. They may signal narrow resonances with masses near
and GeV, or they may be generated by the sub-threshold
and production. Their decisive identification requires additional
theoretical and experimental efforts.Comment: Published versio
