Homenagem da Revista da Faculdade de Direito e Ciências Políticas na Universidad Pontificia Bolivariana, o distinto professor da Faculdade de Direito Dr. Carlos Alberto Restrepo Jaramillo como um símbolo de gratidão e reconhecimento

El sábado 11 de marzo de 2017, al finalizar la tarde, murió el Dr. Carlos Alberto Jaramillo Restrepo, ilustre abogado penalista, quien estuvo vinculado con nuestra Universidad durante gran parte de su vida. Al Dr. Jaramillo se le recuerda como un hombre alegre, de suma inteligencia, honorable, bondadoso, gran orador, brillante y respetado litigante, de impecables formas, infatigable defensor de las más nobles causas. Sin duda, dejó profunda huella en sus estudiantes y una enorme sensación de ausencia entre quienes tuvieron el privilegio de conocerlo. La Facultad de Derecho de la Universidad Pontificia Bolivariana quiere dedicar este número de su revista a quien fuera uno de los profesores que, en forma más decidida, determinaron un estilo propio de elegancia y de decoro en el ejercicio profesional. Portador de una insondable profundidad de la que, entre otras cosas, dieron cuenta su gusto por la literatura y su inclinación, en general, por la vida contemplativa, supo, siempre, respetar los proyectos existenciales de sus estudiantes, animándolos a construirlos, auténticamente, en el marco del respeto por los otros y de la comprensión del sufrimiento ajeno

Soberanía y negación de la vida humana. Un análisis sociopolítico sobre el control del riesgo

La soberanía contemporánea se actualiza dentro del campo de la gubernamentalidad, y ejerce su poder de forma extralegal y extrahumana sobre ciertas poblaciones consideradas peligrosas para la seguridad social. Estas prácticas producen vidas invivibles, no solo porque están fuera de la ley, sino también, y por las mismas razones lógicas, porque están fuera de los marcos que definen lo humano. Guantánamo constituye aquí el paradigma ejemplar de la negación del estatuto jurídico y ontológico de los prisioneros cuyas vidas son suspendidas indefinidamente. Entre las conclusiones que arroja esta reflexión, se encuentra que el exceso de poder soberano amenaza la vida humana de aquellos sectores seleccionados como riesgosos, al igual que la vida comunitaria reducida al riesgo, la enemistad y el rechazo.Contemporary sovereignty is updated within the field of governmentality, and exercises its power in an extralegal and extrahuman form on certain populations considered dangerous for social security. A propósito de los efectos ético-políticos sobre la vulnerabilidad: de la criminalización a la humanización

Vulnerability, understood as a negative aspect of criminalization under immune considerations, constitutes itself as a creative and transformative force that makes it possible to think about a life in common sustained through care and affirmative protection of life. The development of this idea requires three specific stages: in the first, it is described the current democracy as a government technique whose management depends on vulnerable populations; in the second, it is reviewed criminalization as a specific form of immune control; and finally, it is recognized vulnerability as the basis of a new way of democratic life, departing from the attention of certain social groups that have been criminalized due to their precariousness.La vulnerabilidad, entendida como factor negativo de criminalización bajo las lógicas inmunitarias, se constituye, a su vez, en fuente creativa y transformadora que permite pensar la vida en común mediante el cuidado y la protección afirmativa de la vida. El desarrollo de esta idea exige tres momentos específicos: en el primero, se describe la democracia actual como una técnica de gobierno cuya gestión recae sobre la población vulnerable; en el segundo, se revisa la criminalización en tanto forma específica de control inmunitario; y, finalmente, se reconoce la vulnerabilidad como el fundamento de otra forma de vida democrática, a partir de la atención de ciertos grupos sociales criminalizados debido a sus condiciones de precariedad

Nociones introductorias a un curso de Derecho penal: parte general

This article is the first chapter of a Criminal Law Syllabus that is being written for students. Therefore, it contains basic concepts for a criminal law course, and furthermore, it sketches the program and future scope of the aforementioned Syllabus. Accordingly, this writing or first chapter approaches the following topics: in the first place, the location of the criminal law in the universe; in the second place, the criminal law and the political and legal context; in the third place, the concept, content and delimitation of the basics of criminal law; and, in the last place, the purpose or teleology of the basics of criminal law.Ce document constitue le premier chapitre de ce qui aspire à devenir un Manuel de Droit Pénal (partie générale) pour étudiants. Par conséquent, en plus de contenir des notions introductives à un cours de droit pénal - partie générale, il trace le programme érigé comme horizon de projection du manuel mentionné. The DUNE Far Detector Vertical Drift Technology, Technical Design Report

International audienceDUNE is an international experiment dedicated to addressing some of the questions at the forefront of particle physics and astrophysics, including the mystifying preponderance of matter over antimatter in the early universe. The dual-site experiment will employ an intense neutrino beam focused on a near and a far detector as it aims to determine the neutrino mass hierarchy and to make high-precision measurements of the PMNS matrix parameters, including the CP-violating phase. It will also stand ready to observe supernova neutrino bursts, and seeks to observe nucleon decay as a signature of a grand unified theory underlying the standard model. The DUNE far detector implements liquid argon time-projection chamber (LArTPC) technology, and combines the many tens-of-kiloton fiducial mass necessary for rare event searches with the sub-centimeter spatial resolution required to image those events with high precision. The addition of a photon detection system enhances physics capabilities for all DUNE physics drivers and opens prospects for further physics explorations. Given its size, the far detector will be implemented as a set of modules, with LArTPC designs that differ from one another as newer technologies arise. In the vertical drift LArTPC design, a horizontal cathode bisects the detector, creating two stacked drift volumes in which ionization charges drift towards anodes at either the top or bottom. The anodes are composed of perforated PCB layers with conductive strips, enabling reconstruction in 3D. Light-trap-style photon detection modules are placed both on the cryostat's side walls and on the central cathode where they are optically powered. This Technical Design Report describes in detail the technical implementations of each subsystem of this LArTPC that, together with the other far detector modules and the near detector, will enable DUNE to achieve its physics goals
