La Constitution polonaise à l'époque des grands changements

The Polish Constitution at the time of major changes. The regime introduced in Poland after the parliamentary elections of 27th October 1991 should be associated with a new juridical order, based on a new Constitution. The author traces the historical development of the 1952 Constitution, which through the years underwent increasingly significant revisions until it finally became an act reflecting values which were radically opposed to those of the original text. He then considers the part which should be played by the President in Poland, in other words should one choose a Presidential (or semi-Presidential) régime, or a parliamentary government ? All of which may be summed up in one very simple question : should the President of the Republic be granted wider powers than he already enjoys, or not ? The article concludes with an analysis of relations between the government and the administration. How is it possible to create a genuine public role and associate a politically responsible government with an apolitical administration with no partisan ties ? The author examines Polish constitutional practice, and discusses the various solutions proposed for the problems under discussion.Au régime instauré en Pologne après les élections parlementaires du 27 octobre 1991 doit correspondre un ordre juridique nouveau, fondé sur une nouvelle Constitution. L'auteur retrace l'évolution de la Constitution de 1952, qui a subi au fil des ans des révisions de plus en plus importantes pour se transformer finalement en un acte reflétant des valeurs radicalement opposées à celles du texte initial. Il s'interroge ensuite sur le rôle que devra jouer le Président en Pologne, c'est-à-dire sur le choix du régime : présidentiel (semi-présidentiel) ou parlementaire-gouvernemental ? Ce qui se résume à une question fort simple : faut-il donner ou non plus de pouvoirs qu'il n'en a déjà au Président de la République polonaise ? L'article s'achève par une analyse des rapports entre le gouvernement et l'administration. Comment créer une authentique fonction publique et associer un gouvernement politiquement responsable à une administration apolitique, sans attaches partisanes ? L'auteur étudie la pratique constitutionnelle polonaise et discute les diverses solutions apportées aux problèmes soulevés.Sokolewicz Wojciech.
