Better regulation in the European Union

Jean-Claude Juncker elnök (2014–2019) az irányítása alatt álló Európai Bizottság feladatául tűzte ki, hogy javítsa az uniós jogalkotás és szakpolitikai döntéshozatal minőségét annak érdekében, hogy az uniós szakpolitikák eredményesebben szolgálják az állampolgárokat, a vállalkozásokat és a közigazgatási hatóságokat. A korszerű, arányos és a céloknak megfelelő jogszabályok nemcsak a jogállamiság és a közös európai értékek megőrzése, hanem a tagállami közigazgatások és vállalkozások hatékonysága szempontjából is alapvető fontosságúak.Az Európai Uniót gyakran érte – nem ritkán jogos – kritika a túlszabályozás és a gyenge minőségben megírt jogszabályok miatt. A felesleges terhek és a bürokrácia elkerülése azt is megköveteli, hogy a jogszabályokat a várható hatások teljes körű ismeretében dolgozzák ki. Ugyanakkor a jogszabályok egyszerűsítése és a terhek csökkentése révén a végrehajtás és az alkalmazás is javul. Az EU-jogszabályoknak a célnak megfelelőeknek kell maradniuk, és biztosítaniuk kell az uniós jogalkotók által tervezett és a nyilvánosság által elvárt eredményeket. A szakpolitikai döntéshozatal megnyitása, a szakpolitikák javítását szolgáló hatásvizsgálatok, értékelések, támogató eszközök (ideértve a minőségi jogalkotási iránymutatásokat és eszköztárat), valamint a Szabályozói Ellenőrzési Testület (2015) által biztosított független minőségellenőrzés olyan kulcsfontosságú eszközök, amelyek becsatornázzák a tényeket és az érdekelt felek hozzájárulását a szakpolitikai döntéshozatalt alátámasztó objektív elemzésbe. A tanulmány tényeken alapuló értékelést nyújt a minőségi jogalkotás jelenlegi helyzetéről, áttekinti a Juncker-Bizottságnak a minőségi jogalkotás, a jobb minőségű jogszabálytervezetek előállítása terén elért eredményeit. V4-perspektívák és az Északi Együttműködés

In the last decades, several initiatives have been taken in Europe with a view to diminishing or even eliminating the legal-administrative barriers still existing among the European countries. The paper reviews the existing regional cooperations, established in Western Europe. By adopting the experience and traditions of regional cooperation from the Nordic and Benelux countries the Visegrad cooperation was created in 1991. The paper aims at analysing the Visegrad cooperation, launched in 1991. Since then the meetings of presidents, prime ministers, ministers of foreign affairs and members of parliaments of the Visegrad Group began a process of creating foundations and new forms of political, economic and cultural cooperation of these countries in the altered situation in Central Europe. The favorable basis for intensive development of cooperation is ensured by their traditional, historically shaped system of mutual contacts, cultural and spiritual heritage and common roots of traditions. The influences exerted over a long period of time, resulting from the fact of proximity, could support cooperation based on historical development. In terms of the applicability of the Nordic model within the Visegrad Group, it is obvious that besides the diverse public administration systems and legislative background, there is also a completely different socio-economic, cultural and political atmosphere in the region. In addition, the history, the desire and the capacity to cooperate seem to meet a lower standard than in the Nordic region which makes the adoption of the model extremely challenging. The study aims to provide an overview of the structure, operation, and areas of cooperation of V4 in order to develop a proposal for a model system within Visegrád cooperation. Based on the lessons learned from the Copenhagen study visit to the Nordic Council and the desk research, the paper presents the proposed setup, permanent structure, and procedures for removing obstacles to institutionalization. To preserve and promote deeper cohesion and deepened cooperation within the Visegrad Group the formal institutional framework provides a greater opportunity

Az EGTC alapítás kihívásai a hármashatár térségében : a Banat-Triplex Confinium EGTC

The European Union created an opportunity for members to establish EGTCs, bodies with legal personality in 2006 to facilitate the cooperation of national, local and regional players and the efficient use of Union’s resources. Revision process of the EGTC Regulation (1082/2006/EC) gives an opportunity to examine the conditions for elaboration of development and codification propositions of EGTCs on the formation of Banat-Triplex Confinium with Hungary and Romania full member-ship, Serbia as observer member, and to give a new legal bases The criteria for approval by national authorities are specified, a simplificaton of procedures and a limited time for examinaton proposed. Hungarian experience from the setting up of EGTC shows the three month period for approval by a Member State has rarely been respected
