ПРО НЕОБХІДНІСТЬ УДОСКОНАЛЕННЯ ЗАКОНОДАВСТВА ЩОДО ЗДІЙСНЕННЯ СУДОВО-ЕКСПЕРТНОЇ ДІЯЛЬНОСТІ В УКРАЇНІ

The issue of reforming forensic expert support for justice and the need to improve the legislation of Ukraine regarding forensic science activity were investigated. Despite the fact that in recent years, the norms of the laws of Ukraine have been actively subjected to quite significant changes, some issues remain to be resolved on the legal regulation of forensic expert support for justice in the state. The analysis of the specialized literature and relevant legislation confirms the relevance of this issue. On the basis of studying the norms of the basic and procedural legislation regarding forensic science, proposals for its improvement are presented. So, in order to improve the legislation governing forensic science and the unambiguous application of the conceptual apparatus in this field, it is proposed to change the title of Article 1 of the Law of Ukraine On Judicial Examination and introduce the basic terms used in this Law in the the Criminal Procedural Code of Ukraine, Civil Procedural Code of Ukraine, Code of Administrative Proceedings of Ukraine. Improving the regulatory framework for the appointment and performing forensic examinations, as well as the legal status of a forensic expert on the basis of creating the proper legal status and legal support for organizing activities of the system of state forensic expert institutions, as well as forensic experts who do not work in these institutions; increasing the role of legitimate ways to motivate forensic experts; combating corruption in the field of forensics is one of the most important tasks of forensic expert support in the state. The implementation of the proposed measures will be a powerful lever of influence on the processes of improving forensic activities.Исследован вопрос о реформировании экспертного обеспечения правосудия и необходимости совершенствования законодательства Украины о судебно-экспертной деятельности. Несмотря на то обстоятельство, что за последние годы нормы законов Украины активно подвергаются довольно существенным изменениям, остаются нерешенными отдельные вопросы нормативно-правового регулирования экспертного обеспечения правосудия в государстве. Анализ специальной литературы и соответствующих норм законодательства подтверждает актуальность данного вопроса. На основании изучения норм базового и процессуального законодательства о судебной экспертизе сформулированы предложения по его усовершенствованию. Так, с целью усовершенствования законодательства, регулирующего судебно- экспертную деятельность, и однозначного применения понятийного аппарата в этой области предложено изменить наименование статьи 1 Закона Украины «О судебной экспертизе» и ввести в нее основные термины, используемые в этом Законе, в Уголовном процессуальном кодексе, Гражданском процессуальном кодексе, Хозяйственном процессуальном кодексе, Кодексе административного судопроизводства Украины. Совершенствование нормативного регулирования вопросов назначения и проведения судебных экспертиз и правового статуса судебного эксперта на основе создания надлежащего правового положения и нормативно-правового обеспечения организации деятельности системы государственных судебно-экспертных учреждений, а также судебных экспертов, которые не работают в этих учреждениях; повышение роли законных способов мотивации судебных экспертов; противодействие коррупционным проявлениям у сфере судебной экспертизы является одной из важнейших задач экспертного обеспечения правосудия в государстве. Реализация предложенных мероприятий станет мощным рычагом влияния на процессы совершенствования судебно-экспертной деятельности.Досліджено питання реформування судово-експертної діяльності та необхідності вдосконалення законодавства України про судово-експертну діяльність. Незважаючи на те, що в останні роки норми законів України активно піддаються досить суттєвим змінам, залишаються не вирішеними окремі питання нормативно-правового регулювання експертного забезпечення правосуддя в державі. Modern science considers the complexity of researches as one of the regularities of the process of cognition. Forensic examination, which is aimed at the use of knowledge accumulated in various fields of science with the purpose of resolving problems of legal proceedings, in the process of scientific and technological progress, is constantly subjected to the influence integration processes taking place in these areas. Scientific publications indicate that the integration of knowledge in forensic examination is an obligate process of its development, one of the main levers of influence on the formation of the foundations of comprehensive forensic expert studies; and now it is gaining more and more in depth and spread. Studying the forms of complexation in forensic examination, it is necessary to start from the analysis of the subject, tasks, objects, parties and techniques of comprehensive studies, since integration processes are realized in the development of forensic examination on the subject of knowledge integration, tasks of forensic, objects, subjects of knowledge integration and methods.Сучасна наука розглядає комплексність досліджень як одну із закономірностей процесу пізнання. ДО ПИТАННЯ ВЗАЄМОЗАЛЕЖНОСТІ ЄВРОПЕЙСЬКИХ ІНТЕГРАЦІЙНИХ ПРОЦЕСІВ І ТЕНДЕНЦІЙ ІНТЕГРАЦІЇ СПЕЦІАЛЬНИХ ЗНАНЬ В УКРАЇНІ

In the conditions of world globalization, the interdependence of the countries of the world, their transformation into a single global organism, which has its own laws and tendencies of development, is growing ever more. Globalization, like any complex and multifaceted phenomenon, has certain consequences that significantly affect the historical destinies of countries and peoples. Globalization concerns the issues of the development of law and judicial sciences. The holding of the First Kharkiv International Legal Forum "The Law and Problems of Sustainable Development in the Globalized World" is a peculiar confirmation of this. During the opening of the Forum, the rector of the National Law University academician V Ya. Tatsyi stressed that the processes of the world globalization not only give certain advantages in the development of the humanity but also generate new problems, which impossible to solve without an active participation of lawyers-scientists and practitioners. He noted: "From us expect balanced, well-reasoned and effective recommendations that might be implemented both in the national legislation and in the international legal practice”. Undoubtedly, the processes of globalization have their own specifics in various fields, including, in the field of forensic examination. A special place in this case belongs to the influence of the world globalization upon European integration processes. These processes are realized in the forensic examination, primarily by means of implementation of the legislation of Ukraine on forensic examination into European legislation, and in addition, by means of unification of the techniques of expert research for all forensic institutions by their accreditation in accordance with international quality standards. There were defined the ways of realization by Ukrainian criminalists andforensic experts of the requirements of the European documents containing the minimum standards in themselves and various variants of activities in the field of Criminalistics and Forensic Expertise have been proposed.Досліджено окремі питання глобалізації світу та її впливу на європейські інтеграційні процеси, а також на тенденції інтеграції спеціальних знань у судовій експертизі. Проаналізовано порівняльний огляд європейських експертів в аспекті діяльності органів судової експертизи в Україні та державах - членах ЄС. Визначено шляхи реалізації українськими криміналістами й судовими експертами положень основних європейських документів, що визначають мінімальні стандарти та пропонують різні варіанти діяльності в галузі судової експертизи

Quality and safety problems of sports nutrition products

The purpose of this work was to study the quality and safety of some sports nutrition products. The objects of study were sports nutrition products: protein bars of ‘ProteinBar’ (Russia) and ‘Bombbar’ (Russia); capsule forms of dietary supplements ω–3, ω–6, ω–9 firms ‘Sportline’ (Russia), ‘Multipower’ (Germany) and ‘Maxler’ (USA). According to the research results, the normalized safety indicators of the fat component of the studied products for sports nutrition (acid number and peroxide) are within acceptable values. The standardized safety indicators of the fat component do not fully reflect the safety requirements for the fat component of sports nutrition products, since there are no standards for the most important indicators of fat safety – the content of secondary oxidation products – copolymers insoluble in petroleum ether and epoxides. The results obtained in the course of the work showed that in almost all of the studied samples are content of epoxides (7.5–47.6 g -1 ) and secondary oxidation products – 1% or more

ШЛЯХИ ВИРІШЕННЯ ПРОБЛЕМ НАУКОВО-МЕТОДИЧНОГО ЗАБЕЗПЕЧЕННЯ ЕКСПЕРТНОЇ ДІЯЛЬНОСТІ В УКРАЇНІ

The article deals with the ways of improving the provision of scientific and method support in Ukraine, which is one of the main tasks offorensic and expert activity aimed at ensuring justice by providing an independent, qualified, scientifically-reasoned, objective forensic examination. It offers procedures that seem expedient in cases when there is a need for the introduction of a new king (type, class) of a forensic examination, expert speciality. Namely, they include stages that can be presented in the following way. First of all it is necessary to summarize the existing scientific and practical materials (specialized publications and expert practices). The next stage consists of statistically analyzing the obtained data, it is detailed in the memo for the discussion by the Research Board of the Institute. In case of a favorable decision on undertaking this scientific and research efforts, then it must be planned, conducted, tested and following that recommended for implementation in the designated order. These efforts include the development of expert training programs and suggestions for amending the relevant normative and legal acts.Розглянуто шляхи вдосконалення науково-методичного забезпечення судово-експертної діяльності в Україні, що є одним з основних завдань експертного забезпечення правосуддя в Україні. АКТУАЛЬНІ ПРОБЛЕМИ СПІВРОБІТНИЦТВА З ОРГАНІЗАЦІЯМИ ІНОЗЕМНИХ ДЕРЖАВ У СФЕРІ СУДОВО-ЕКСПЕРТНОЇ ДІЯЛЬНОСТІ

The article shows the role of international cooperation in the field of forensic expert activity. On development of forensic expert institutions of the Ministry of Justice of Ukraine and the expansion of the possibilities for forensic examinations have a positive effect their activity in the implementation of international contacts: the organization of joint international scientific and practical conferences, seminars, internship of specialists with the purpose of sharing work experience, training of forensic experts, familiarization with the organization of activities and advanced methods of conducting forensic examinations and expert studies, allows a specialist there constantly to be aware of the latest achievements of science and to use the experience of their colleagues from other countries. Currently, work is underway to conduct joint scientific developments, training of highly qualified scientific personnel, but this is not specified in Art. 24 of the Law about forensic science, and therefore we propose this article be amended as follows: "State specialized institutions that perform forensic examinations are entitled establish international scientific ties with the institutions of forensic science, criminalistics and so on other states for the purpose of joint research and development, exchange of scientific and methodological information and printed publications, use of common international information funds, data banks, training, retraining and advanced training of forensic experts, international conferences, symposia, seminars, joint publications in forensic science and criminalistics, training of highly qualified scientific personnel". In connection with the further development of international cooperation, it is desirable in the staffing of forensic institutions to provide for such a structural unit as the International Relations Department. In 2018, KhRIFE obtained the Accreditation Certificate for compliance with the requirements of the international standard ISO/IEC 17025. The collection of scientific proceedings "Theory and Practice of Forensic Science and Criminalistics" is included in the international scientometric database Index Copernicus. The development of international cooperation in the field of forensic science will contribute to enhancing the scientific and methodological potential of forensic expert institutions, developing new directions and types of forensic expert activity, and increasing the effectiveness of the fight against crime.Показана роль международного сотрудничества в области судебно-экспертной деятельности. На развитие судебно-экспертных учреждений Министерства юстиции Украины и расширение возможностей судебных экспертиз положительно влияет их деятельность по осуществлению международных контактов: организация совместных международных научно-практических конференций, семинаров, стажировок специалистов с целью обмена опытом работы, обучение судебных экспертов, ознакомление с организацией деятельности и передовыми методами проведения судебных экспертиз и экспертных исследований, позволяет специалистам постоянно находиться в курсе последних достижений науки и использовать опыт своих коллег из других стран. В настоящее время осуществляется работа по проведению совместных научных разработок, подготовке научных кадров высшей квалификации, однако в статье 24 Закона о судебной экспертизе это не указано, в связи с чем предлагаем ее изложить в такой редакции: «Государственные специализированные учреждения, выполняющие судебные экспертизы, пользуются правом устанавливать международные научные связи с учреждениями судебных экспертиз, криминалистики и так далее других государств с целью проведения совместных научных исследований и разработок, обмена научно-методической информацией и печатными изданиями, использования общих международных информационных фондов, банков данных, проведения подготовки, переподготовки и повышения квалификации судебных экспертов, международных конференций, симпозиумов, семинаров, осуществления совместных изданий в области судебной экспертизы и криминалистики, подготовки научных кадров высшей квалификации». В связи с дальнейшим развитием международного сотрудничества желательно в штатном расписании судебно-экспертных учреждений предусмотреть такое структурное подразделение, как отдел международных связей. В 2018 году ХНИИСЭ получил Аттестат об аккредитации на соответствие требованиям международного стандарта ISO/IEC 17025. Сборник научных трудов «Теория и практика судебной экспертизы и криминалистики» включен в международную наукометрическую базу данных Index Copernicus. Развитие международного сотрудничества в области судебной экспертизы будет способствовать повышению научно-методического потенциала судебно-экспертных учреждений, разработке новых направлений и видов судебно-экспертной деятельности, повышению эффективности борьбы с преступностью.Міжнародне співробітництво є одним із важливих напрямів роботи судово-експертних установ і закладів вищої освіти України, зокрема, Харківського науково-дослідного інституту судових експертиз ім. Засл. проф. М. С. Бокаріуса та Харківського національного медичного університету. Одним із результатів міжнародної співпраці є удосконалення законодавства України і його адаптація до норм міжнародного права. Нині міжнародні взаємовідносини у сфері здійснення судово-експертної діяльності є недостатньо врегульованими, що потребує більш детального опрацювання нормативно-правових актів в аспекті міжнародних договірних відносин. Tuning Pt characteristics on Pt/C catalyst for aqueous-phase reforming of biomass-derived oxygenates to bio-H-2

Pt/C catalysts with varied Pt sizes and distributions were investigated for aqueous-phase reforming (APR) of ethylene glycol (EG) to H2. APR experiments were performed on a continuous-flow fixed bed reactor with a catalyst loading of 1 g and EG feeding of 120 mL h−1 at 225 °C and 35 bar for 7 h. The fresh and used Pt/C catalysts were characterized by XRF, BET, CO chemisorption, TEM, XTEM, and XPS. Catalyst preparation protocols changed Pt characteristics on Pt/C catalysts, leading to a distinguishable H2 production. The rates for EG conversion and H2 production increased linearly with mean Pt size (3–11 nm), while having a volcano relationship with the mean size of agglomerated Pt particles (17–30 nm). Pt with concentrated Pt particles on surface of Pt/C catalysts was more preferable for APR of EG than the homogeneously distributed in catalysts. Optimal performance was obtained over a Pt/C-PR catalyst, which was prepared by precipitation method, showing a superb turnover frequency of 248 molH2 molPt−1 min−1 for H2 production from EG in APR. Besides, Pt/C catalysts also showed excellent stability. These results have shown the promise of Pt/C catalyst for APR of EG, which can be extended for bio-H2 production via APR of biomass-derived oxygenates in waste streams

Social Portrait of Young People Who Moved to the Russian Arctic

В статье представлены результаты социологического исследования молодежи в возрасте 16–35 лет, переехавшей в Арктическую зону России. Цель исследования — формирование социального портрета этой молодежи, дополняющего ограниченную статистическую информацию необходимой детализацией: уровень образования, пол, длительность проживания и потенциальная закрепляемость в арктических территориях. Исследование проведено по репрезентативной выборке (8583 чел.), подвыборка по переехавшим молодым людям составила 2156 чел. В АЗРФ приезжает квалифицированная молодежь, имеющая социальные связи, в основном с целью работы, учебы и «проверки себя на прочность».The article presents the results of a sociological survey of young people aged 16–35 who moved to the Russian Arctic. The research aims to develop a social portrait of these youth, supplementing the limited statistical information with necessary details: education level, gender, length of residence and potential placement in the Arctic territories. The study was conducted on a representative sample (8583 respondents) and the subsample of young people who moved (2156 respondents). Experimental Stand for Investigations of Insulator Degradation and Electrode Erosion in High-current Breaker

An experimental stand for studies of electric arc, electrode erosion and insulator degradation processes in high-current circuit breakers and some preliminary experimental data is described. The setup includes a discharge chamber, a capacitive energy storage with capacitance of 0.11 F, voltage up to 10 kV, and all necessary diagnostic techniques. The stand is designed for modeling current pulse with amplitude of 3–150 kA and duration of the first half period of 1.0–3.0  ms during the process of disconnecting the ring and the pin contacts. The arc is cooled by transverse gas blowing at pressure in the chamber of 0.5–3 MPa. Acquired experimental data can be used for verification of the modelling results of the heat transfer processes in the discharge chamber. At the stand, advanced composite materials based on carbon and iron-copper pseudoalloy are studied
