Os Precedentes da Corte Europeia de Direitos Humanos como Instrumento de Refinamento das Normas de Direitos Humanos: Decisão Judicial e Norma de Direito Fundamental Adscrita /Derivada

This research has the objective of demonstrating the importance of the decisions of the International Tribunals, specifically the European Court of Human Rights, for the refinement of human / fundamental rights standards. Therefore be devoted, at first, to identify the semantic concept of a rule, which will put the legal hermeneutics in evidence; and, punctuate the question of the standard of identification of the opening due to the ethical and moral content inserted into legal norms that prescribe human / fundamental rights. In a second step, we will present what Robert Alexy calls a fundamental right given standard or enrolled, which will identify as fundamental rights standards all legislative or judicial manifestation that store chains of reasoning with the primary standards of human rights / fundamental rights. With this, we will analyze two decisions of the European Court of Human Rights as a refinement tool, delimitation and more, as a mechanism for effective implementation of human rights / fundamental rights standards. Precedents of the European Court of Human Rights.Essa pesquisa possui o objetivo de demonstrar importância das decisões dos Tribunais Internacionais, especificamente a Corte Europeia de direitos Humanos, para o refinamento das normas de direitos humanos/fundamentais. Para tanto, se dedicará, em um primeiro momento, a identificar o conceito semântico de norma jurídica, o que colocará a hermenêutica jurídica em evidência; bem como, pontuará a questão da abertura da identificação da norma em decorrência dos conteúdos ético-morais inseridos nos enunciados normativos que prescrevem direitos humanos/fundamentais. Em um segundo momento, apresentaremos aquilo que Robert Alexy denomina de norma de direito fundamental atribuída ou adstrita, o que permitirá identificar como normas de direitos fundamentais todas as manifestação legislativas ou jurisdicionais que guardem correntes de fundamentação com as normas primárias de direitos humanos/fundamentais. Com isso, analisaremos duas decisões do Tribunal Europeu de Direitos Humanos como instrumento de refinamento, delimitação e, mais, como mecanismo de efetiva concretização das normas de direitos humanos/fundamentais, a partir das correntes racionais de argumentação
