Is the compensation in case of withdramal of the construction contract really different from the compensation under the general system?

Generalmente se ha considerado que la facultad de desistir del contrato de obra contemplada en el artículo 1594 del Código Civil español es singular: no solo porque permite al promotor extinguir, por su sola voluntad, el contrato, sino también porque contempla una indemnización especial. En este artículo se pone en duda, principalmente, la segunda consideración: teniendo en cuenta que los tres conceptos contemplados en ese artículo normalmente coincidirán con la indemnización derivada de las reglas generales, la posible diferencia entre uno y otro régimen solo puede hallarse en el elemento subjetivo, esto es, en si el promotor ha actuado conscientemente de los daños que causa o no ha tenido otra alternativa que desistir. No obstante, tampoco esta diferencia con el régimen general es tan clara como pudiera pensarse

Els Monòlegs de Capri. Amb l'aigua al coll (1990) o la temptativa de portar els monòlegs de Joan Capri a la televisió

Aquest article estudia la temptativa televisiva amb els monòlegs de Capri concretada en Amb l'aigua al coll (1990) de TV3, i ho fa tenint en compte els monòlegs de Joan Capri dels seixanta i setanta editats en disc. S'hi estudien, en primer lloc, les motivacions del programa i el context de la seva gravació. En segon lloc, el caràcter satíric dels monòlegs, la naturalesa d'aquest humor satíric i, relacionat amb això, la funció de censura moral dels monòlegs i els seus motius. En tercer lloc, el caràcter tipificat —d'acord amb un tipisme psicomoral i costumista— amb què és representada la realitat social i malgrat que en els monòlegs televisius augmenten les referències al context social del moment i creix el prisma personalitzador associat al monologuista. I finalment, el format del programa, la comunicació paralingüística que s'hi activa i la configuració narrativa dels monòlegs.The purpose of this paper is to study the attempt made to broadcast Joan Capri’s monologues on the TV3 television programme Amb l’aigua al coll (1990), based on Capri’s monologues from the 1960s and 70s released on an album. First we analyse the motivations of the programme and the circumstances of its recording. Secondly, the satirical traits in his monologues, the nature of this satirical humour and, related to this, its role of moral censorship and its reasons are considered. Thirdly, we deal with the typified character − reflecting a psychomoral and customs- and manners-based typicality − in which the social reality is mainly represented, although in the television monologues one finds a larger number of references to the social context of the moment and the personal angle of the monologist is more emphasised. Lastly, we discuss the television format of the programme, the paralinguistic communication involved and the narrative configuration of the monologues

Servir el vino. Algunas observaciones sobre la adopción del oinochoe en el curso inferior del Ebro (s. VII-VI aC)

Traditionally, in the northeastern peninsula, the introduction of the first indicators of Mediterranean influence in relation to the consumption of wine, is dated to the second half of the sixth century BC (ionian cups, Attic kylix, Attic black-figure). Nevertheless, in the lower Ebro valley, the exceptional frequency of Phoenician trade shows clear evolution of the ceramic repertoire during the sixth and seventh centuries BC, a fact that makes it possible to evaluate the occurrence of certain ceramic products that show the existence of significant changes in the portfolio of objects associated with the ritual practices of community consumption. In this article we evaluate the adoption of oinochoe in relation to the first signs of renewal being experienced by the indigenous materials associated with drinking. The goal is to represent a stage of fundamental social changes during which ideology shows a significant increase in importance.Tradicionalmente, en el noreste peninsular, la introducción de los primeros parámetros de influencia mediterránea en relación al consumo del vino, se han situado en la segunda mitad del siglo VI aC (copas jonias, kylix áticas, cerámica ática de figuras negras). No obstante, en el curso inferior del Ebro, la incidencia destacada del comercio fenicio conlleva una clara evolución del repertorio cerámico a lo largo de los siglos VII y VI aC, un hecho que permite evaluar la aparición de ciertas producciones de vajilla que evidencian la existencia de modificaciones importantes en el repertorio de instrumentos vinculados a las prácticas rituales de consumo comunitario. En el presente artículo se valora la adopción del oinochoe en relación a los primeros síntomas de renovación que experimenta el instrumental indígena asociado a la bebida.
