    A View from the First Amendment Trenches: Washington State\u27s New Protections for Public Discourse and Democracy

    In his latest book, Democracy, Expertise, and Academic Freedom: A First Amendment Jurisprudence for the Modern State, Dean Robert Post promotes the concept of “democratic legitimation” as the cornerstone of democratic decision making. Dean Post defines “democratic legitimation” as “all efforts” to influence “public opinion.” As Post explains, “[d]emocracy requires that government action be tethered to public opinion” because “public opinion can direct government action in an endless variety of directions.” As a result, First Amendment coverage should extend to all communications that form public opinion, he contends. Those who object to speech aimed at influencing public opinion have learned they can file a Strategic Lawsuit Against Public Participation (SLAPP). The purpose of the SLAPP suit is to impede efforts to influence public opinion by intimidating the speaker with expensive and lengthy litigation. Since the late 1980s, states have reacted to SLAPP lawsuits by enacting anti-SLAPP statutes. Washington State has had a statute in place since 1989 that protects speakers from litigation resulting from statements made to government officials. In 2010, the Washington legislature expanded those protections by enacting Revised Code of Washington 4.24.510, which more broadly protects speakers who comment on matters of public concern. This Article reviews Dean Post’s theory of democratic legitimation and then looks at statutes across the nation and in Washington that are aimed at protecting speakers from litigation that seeks to chill the First Amendment rights of citizens who comment on matters of public concern. The Article concludes that Washington’s new statute promotes Dean Post’s goal of democratic legitimation

    Semantic Priming of Familiar Songs

    We explored the functional organization of semantic memory for music by comparing priming across familiar songs both within modalities (Experiment 1, tune to tune; Experiment 3, category label to lyrics) and across modalities (Experiment 2, category label to tune; Experiment 4, tune to lyrics). Participants judged whether or not the target tune or lyrics were real (akin to lexical decision tasks). We found significant priming, analogous to linguistic associative-priming effects, in reaction times for related primes as compared to unrelated primes, but primarily for within-modality comparisons. Reaction times to tunes (e.g., Silent Night ) were faster following related tunes ( Deck the Hall ) than following unrelated tunes ( God Bless America ). However, a category label (e.g., Christmas) did not prime tunes from within that category. Lyrics were primed by a related category label, but not by a related tune. These results support the conceptual organization of music in semantic memory, but with potentially weaker associations across modalities

    Rice genotype differences in tolerance of zinc-deficient soils: evidence for the importance of root-induced changes in the rhizosphere

Efforts to breed more Zn-efficient rice are constrained by poor understanding of the mechanisms of tolerance to deficiency. Here we assess the contributions of root growth and root Zn uptake efficiency, and we seek to explain the results in terms of specific mechanisms. We made a field experiment in a highly Zn-deficient rice soil in the Philippines with deficiency-tolerant and -sensitive genotypes, and measured growth, Zn uptake and root development. We also measured the effect of planting density. Tolerant genotypes produced more crown roots per plant and had greater uptake rates per unit root surface area; the latter was at least as important as root number to overall tolerance. Tolerant and sensitive genotypes took up more Zn per plant at greater planting densities. The greater uptake per unit root surface area, and the planting density effect can only be explained by root-induced changes in the rhizosphere, either solubilizing Zn, or neutralizing a toxin that impedes Zn uptake (possibly HCO − 3 HCO3− or Fe2+), or both.     The Simplest Walking Robot: A bipedal robot with one actuator and two rigid bodies

    We present the design and experimental results of the first 1-DOF, hip-actuated bipedal robot. While passive dynamic walking is simple by nature, many existing bipeds inspired by this form of walking are complex in control, mechanical design, or both. Our design using only two rigid bodies connected by a single motor aims to enable exploration of walking at smaller sizes where more complex designs cannot be constructed. The walker, "Mugatu", is self-contained and autonomous, open-loop stable over a range of input parameters, able to stop and start from standing, and able to control its heading left and right. We analyze the mechanical design and distill down a set of design rules that enable these behaviors. Experimental evaluations measure speed, energy consumption, and steering

    Protozoal Coinfection in Horses with Equine Protozoal Myeloencephalitis in the Eastern United States

    Background: Infection by 2 or more protozoa is linked with increased severity of disease in marine mammals with protozoan encephalitis. Hypothesis/Objectives: To assess whether horses with equine protozoal myeloencephalitis (EPM) caused by Sarcocystis neurona also have evidence of infection with Neospora hughesi or Toxoplasma gondii. We hypothesized that horses with EPM would be more likely than horses with cervical vertebral stenotic myelopathy (CVSM) to be positive for antibodies to multiple protozoan parasites. Animals: One hundred one horses with neurologic disease: 49 with EPM and 52 with CVSM. Methods: Case review. Archived serum and cerebrospinal fluid (CSF) from 101 horses were examined. Inclusion criteria included neurologic disease, antemortem or postmortem diagnosis of EPM or CVSM, and availability of serological results or archived samples for testing. Additional testing for antibodies was performed on serum for T. gondii, as well as serum and CSF for N. hughesi. Results: Horses with EPM were more likely than horses with CVSM to have positive immunologic results for S. neurona on serum (95.9% versus 76.9%, P = .0058), CSF (98.0% versus 44.2%, P \u3c .00001), and serum : CSF titer ratio (91.8% versus 0%, P \u3c .00001). Positive results for Neospora and Toxoplasma were uncommon, with total seroprevalence rates of 12.9% and 14.9%, respectively. The proportions of EPM cases testing positive for Neospora and Toxoplasma (16% and 12%) were not different from the proportions of CVSM cases testing positive (10% and 17%, P = .31 and .47, respectively). Conclusion: Results do not indicate an important role for protozoal coinfection in EPM in the eastern United States

    The Infrared Properties of Hickson Compact Groups

    Compact groups of galaxies provide a unique environment to study the mechanisms by which star formation occurs amid continuous gravitational encounters. We present 2MASS (JHK), Spitzer IRAC (3.5-8 micron) and MIPS (24 micron) observations of a sample of twelve Hickson Compact Groups (HCGs 2, 7, 16, 19, 22, 31, 42, 48, 59, 61, 62, and 90) that includes a total of 45 galaxies. The near-infrared colors of the sample galaxies are largely consistent with being dominated by slightly reddened normal stellar populations. Galaxies that have the most significant PAH and/or hot dust emission (as inferred from excess 8 micron flux) also tend to have larger amounts of extinction and/or K-band excess and stronger 24 micron emission, all of which suggest ongoing star formation activity. We separate the twelve HCGs in our sample into three types based on the ratio of the group HI mass to dynamical mass. We find evidence that galaxies in the most gas-rich groups tend to be the most actively star forming. Galaxies in the most gas-poor groups tend to be tightly clustered around a narrow range in colors consistent with the integrated light from a normal stellar population. We interpret these trends as indicating that galaxies in gas-rich groups experience star formation and/or nuclear actively until their neutral gas consumed, stripped, or ionized. The galaxies in this sample exhibit a ``gap'' between gas-rich and gas-poor groups in infrared color space that is sparsely populated and not seen in the Spitzer First Look Survey sample. This gap may suggest a rapid evolution of galaxy properties in response to dynamical effects.     Variation in reversal learning by three generalist mesocarnivores

    Urbanization imposes novel challenges for wildlife, but also provides new opportunities for exploitation. Generalist species are commonly found in urban habitats, but the cognitive mechanisms facilitating their successful behavioral adaptations and exploitations are largely under-investigated. Cognitive flexibility is thought to enable generalists to be more plastic in their behavior, thereby increasing their adaptability to a variety of environments, including urban habitats. Yet direct measures of cognitive flexibility across urban wildlife are lacking. We used a classic reversal-learning paradigm to investigate the cognitive flexibility of three generalist mesocarnivores commonly found in urban habitats: striped skunks (Mephitis mephitis), raccoons (Procyon lotor), and coyotes (Canis latrans). We developed an automated device and testing protocol that allowed us to administer tests of reversal learning in captivity without extensive training or experimenter involvement. Although most subjects were able to rapidly form and reverse learned associations, we found moderate variation in performance and behavior during trials. Most notably, we observed heightened neophobia and a lack of habituation expressed by coyotes. We discuss the implications of such differences among generalists with regard to urban adaptation and we identify goals for future research. This study is an important step in investigating the relationships between cognition, generalism, and urban adaptation

    Postimpact deformation associated with the late Eocene Chesapeake Bay impact structure in southeastern Virginia

    Upper Cenozoic strata covering the Chesapeake Bay impact structure in southeastern Virginia record intermittent differential movement around its buried rim. Miocene strata in a graben detected by seismic surveys on the York River exhibit variable thickness and are deformed above the crater rim. Fan-like interformational and intraformational angular unconformities within Pliocene–Pleistocene strata, which strike parallel to the crater rim and dip2°–3° away from the crater center, indicate that deformation and deposition were synchronous.Concentric, large-scale crossbedded, bioclastic sand bodies of Pliocene age within ~20 km of the buried crater rim formed on offshore shoals, presumably as subsiding listric slump blocks rotated near the crater rim

    Can the quality of social research on ethnicity be improved through the introduction of guidance? Findings from a research commissioning pilot exercise

    As the volume of UK social research addressing ethnicity grows, so too do concerns regarding the ethical and scientific rigour of this research domain and its potential to do more harm than good. The establishment of standards and principles and the introduction of guidance documents at critical points within the research cycle might be one way to enhance the quality of such research. This article reports the findings from the piloting of a guidance document within the research commissioning process of a major funder of UK social research. The guidance document was positively received by researchers, the majority of whom reported it to be comprehensible, relevant and potentially useful in improving the quality of research proposals. However, a review of the submitted proposals suggested the guidance had had little impact on practice. While guidance may have a role to play, it will need to be strongly promoted by commissioners and other gatekeepers. Findings also suggest the possibility that guidance may discourage some researchers from engaging with ethnicity if it raises problems without solutions; highlighting the need for complementary investments in research capacity development in this area
