Juan Bautista Alberdi : un discours entre culture juridictionnelle et culture Ă©tatique
This thesis points to study Alberdiâs thought and to demonstrate that itâs fundamentally a thought of the complexity of the categories founded on the hybrid character of the order which is contemporary to him. Alberdi inherited the legacy of two cultures, the traditional culture of Ancien RĂ©gime and a revolutionary culture whose language also imposed itself with the independance. The major question for Alberdi is which order to give back to the social body since it lost the legitimacy of the Ancien RĂ©gimeâs transcendent order. The traditional historiography often pick up Alberdiâs figure and speeches to convert him in the eminent precursor or representative of distinct tendencies, sometimes contradictories, and especially to promote him as the « modernity »âs, the contemporary liberalismâs and the contemporary Argentinian Stateâs figurehead. Quite the contrary, Alberdi is still rather immerged in the traditional legal culture, and he tries to adapt the availables languages to his reality, in permanent backs and forths between reality and speeches since the first models the seconds and viceversa. Some categories like « individual », « Liberty », « administration » imposed themselves with the Revolution but the publicist gives them another significations (je ne sais pas comment traduire âresĂ©mantiserâ?) according to his context considerably penetrated with traditional dynamics. The « individual », so, intersects the excluding category of the « vecino » overall. In the same way, Alberdi preferentially uses the term of « administration » in its old meaning of « justiceâs administration », not in its modern acceptation. Besides, the publicistâs « modernity » is to be reconsiderated seeing as he leaves a fundamental role to the traditional legal sources and doesnât fall into legal voluntarism but occasionally and cautiously. He actually plays on different scales : he speaks the political modernityâs language on the national scale and the traditional legalâs one on the local level (local level which remains the stability base of the social body). My thesis is that this traditional base on one hand and the categories of « trade » (understood in his polysemic acceptations) and « political economics » on the other hand will be the two fundamental instruments which enable the autor to rethink the link, to create a society based on the traditional social body. Quand la « rĂ©publique » dâAlberdi se fait « monarchiste »
Juan Bautista Alberdiâs works have often been studied through the prism of ârepublicanismâ, particularly since the author has recommended in his Bases the necessary construction of a âpossible republicâ before the establishment of a âreal republicâ when the young Argentinean nation will have educated its people in the principles that have to rule such a regime. This article voluntarily does not employ the terms of ârepublicâ or ârepublicanismâ as categories of analysis, in order to explain what could be considered as contradictions in the authorâs speeches,who, according to the periods, categorically defends the Republican regime or, on the contrary, the monarchy. Alberdi plays with the wide semantic plasticity of the word ârepublicâ, which allows him not to oppose it to the âmonarchyâ in many cases. Moreover, â Alberdi is, above all, a pragmatic empiricist â the question of the political regime to adopt does not represent the heart of his concern ; the political regime is only a means to an end, which would be civilization and progress. The best political regime will be, thus, the one that will assure peace, order, and conditions for development, whether that regime is a monarchy or a republic

Juan Bautista Alberdi, ses « mauvais sauvages » et ses « barbares civilisés »
Si le Facundo de Sarmiento est lâouvrage qui vient immĂ©diatement Ă lâesprit lorsque lâon Ă©voque la fameuse dichotomie « civilisation / barbarie » qui a travaillĂ© le xixe siĂšcle argentin, nous pourrions aussi convoquer les Ă©crits dâun autre Argentin cĂ©lĂšbre de la mĂȘme Ă©poque, Juan Bautista Alberdi, qui nous livrent une conception bien particuliĂšre de ce que seraient la « barbarie », le « sauvage » et la « civilisation ». Ainsi est-il intĂ©ressant de noter que si, tout comme Sarmiento, le publiciste tucumano relĂšgue lâIndien aux catĂ©gories de « barbare » et de « sauvage », il rĂ©fute lâidĂ©e sarmientine du gaucho sauvage. En outre, la sauvagerie ne sâarrĂȘte pas au seuil des civilisations supposĂ©ment plus avancĂ©es, plus « civilisĂ©es », comme il cherche Ă le dĂ©montrer notamment dans El Crimen de la guerra. Plus encore, la barbarie peut rĂ©apparaĂźtre dans la sphĂšre des Ă©lites â la figure de Sarmiento est convoquĂ©e dans les Ă©crits alberdiens sous ces traits. Nous chercherons donc Ă mettre en Ă©vidence les diffĂ©rentes acceptions que peuvent prendre ces concepts sous la plume alberdienne.Cuando evocamos la famosa dicotomĂa «civilizaciĂłn / barbarie» que tanto preocupĂł siglo XIX argentino, pensamos inmediatamente en el Facundo de Sarmiento. Sin embargo tambiĂ©n resulta interesante profundizar los escritos de otro argentino cĂ©lebre del mismo perĂodo, Juan Bautista Alberdi, que nos entregan una concepciĂłn bastante particular de lo que serĂan «la barbarie», el «salvaje» y la «civilizaciĂłn». Por ejemplo es llamativo el hecho de que si el publicista relega al indio a las categorĂas de «bĂĄrbaro» y «salvaje» como Sarmiento, rechaza en cambio el concepto del «gaucho salvaje» elaborada por el sanjuanino. AdemĂĄs el salvajismo no se detiene en el umbral de las sociedades que se suponen mĂĄs avanzadas, mĂĄs «civilizadas» como intenta demostrarlo en El Crimen de la guerra. AĂșn mĂĄs, la barbarie puede volver a aparecer en la esfera de las Ă©lites: bajo la pluma de Alberdi, la figura de Sarmiento toma precisamente dichos rasgos. Alberdi presenta a Sarmiento (con quien mantuvo frecuentes y famosas polĂ©micas) como un hombre polĂtico salvaje que utiliza la lengua al igual que los indios su lanza, y sobre todo como un historiador bĂĄrbaro que deforma el logos comĂșn y la historia argentina. Entonces intentaremos poner de realce las distintas acepciones y matices que toman estos conceptos en los discursos alberdianos
Une rĂ©volution du globe : le « peuple-monde » dâAlberdi ou la rĂ©solution transnationale du cycle rĂ©volutionnaire
Juan Bautista Alberdi is a jurist whose production has already been thoroughly discussed. Consequently, this chapter does not purport to present an interpretation of his works which would claim to be unique and exclusionary, but rather it aims to propose another perspective, perhaps less studied, on his production. The Tucuman jurist, heir of two cultures â a jurisdictional culture of the Ancien RĂ©gime and a culture that stems from revolutions â is confronted with the fundamental question of the re-establishment of a social order after the revolution. Far from promoting only principles belonging to what has been named « Western Modernity », his propositions are the result of a real metabolisation of the principles which emerged with the revolutions by the jurisdictional culture. Furthermore, far from thinking of this resolution in solely the frame of the Argentinean âstateâ or the ânationâ, his propositions are conceived only if integrated into an order that exceeds the frame of the nation, a transnational order, called âpueblo mundoâ by Alberdi

Some categories like « individual », « Liberty », « administration » imposed themselves with the Revolution but the publicist gives them another significations (je ne sais pas comment traduire âresĂ©mantiserâ?) according to his context considerably penetrated with traditional dynamics. The « individual », so, intersects the excluding category of the « vecino » overall. In the same way, Alberdi preferentially uses the term of « administration » in its old meaning of « justiceâs administration », not in its modern acceptation. Besides, the publicistâs « modernity » is to be reconsiderated seeing as he leaves a fundamental role to the traditional legal sources and doesnât fall into legal voluntarism but occasionally and cautiously. He actually plays on different scales : he speaks the political modernityâs language on the national scale and the traditional legalâs one on the local level (local level which remains the stability base of the social body). My thesis is that this traditional base on one hand and the categories of « trade » (understood in his polysemic acceptations) and « political economics » on the other hand will be the two fundamental instruments which enable the autor to rethink the link, to create a society based on the traditional social body. Far from considerating the order on the very national level, his approach also fits into an international perspective : the pacified exchanges between the nations would be the only way to end the atlantic revolutionsâs cycle and to recover an order : this order will admittedly be immanent, but it necessarily will transcend the national frame
Los discursos alberdianos o la gran plasticidad del orden jurisdiccional tradicional
En este artĂculo se propone demostrar que dos culturas en tensiĂłn han penetrado los discursos de Juan Bautista Alberdi: por una parte, la cultura jurisdiccional caracterĂstica del orden tradicional de Antiguo RĂ©gimen y por otra, la cultura que emergiĂł despuĂ©s de las independencias que solemos llamar âmodernaâ (aunque esta categorĂa tendrĂa que ser cuestionada), una cultura estatal. En los escritos del publicista argentino se observa una verdadera âmetabolizaciĂłnâ de los principios que se impusieron, durante la Independencia, mediante la cultura jurisdiccional, tal como lo veremos con el tratamiento que hace de conceptos como los de âconstituciĂłnâ o de âcĂłdigoâ.Le modĂšle propose Ă©galement une assistance Ă la prĂ©paration Ă©ditoriale des documents.
