Judicial Incentives and Indeterminacy in Substantive Review of Administrative Decisions

In the Chevron and State Farm cases the Supreme Court announced what appeared to be controlling standards for substantive review of administrative decisions. Instead, the Chevron framework has broken down, and State Farm has been all but ignored by agencies and the courts, including the Supreme Court. This article accounts for this breakdown by analyzing the impact of judicial incentives on substantive review in administrative law

Standards, information, and the demand for student achievement

Higher student achievement, say the authors, has been severely hampered by a lack of good information comparing achievement levels with today's labor market requirements. They argue that by obtaining this information--in the form of academic standards and assessments--parents can more accurately evaluate the quality of their children's education.Education

A Genetic Locus Regulates the Expression of Tissue-Specific mRNAs from Multiple Transcription Units

129 GIX- mice, unlike animals of the congeneic partner strain GIX+, do not express significant amounts of the retroviral antigens gp70 and p30. Evidence is presented indicating that the GIX phenotype is specified by a distinct regulatory gene acting on multiple transcription units to control the levels of accumulation of specific mRNA species. The steady-state levels of retroviral-homologous mRNA from the tissues of GIX+ and GIX- mice were examined by blot hybridization using as probes DNA fragments from cloned murine leukemia viruses. RNA potentially encoding viral antigens was reduced or absent in GIX- mice, even though no differences in integrated viral genomes were detected between these congeneic strains by DNA blotting. Tissue-specific patterns of accumulation of these RNA species were detected in brain, epididymis, liver, spleen, and thymus, and several distinct RNA species were found to be coordinately regulated with the GIX phenotype. Measurements of RNA synthesis suggest a major role for transcriptional control in the regulation of some retroviral messages

Title VIII - Gambling and Organized Crime

With these words, President Richard Nixon underscored the dangers presented by organized crime\u27s use of gambling. The proceeds of such syndicated gambling activities are universally acknowledged to be the financial lifeblood of organized crime. With the capital initially obtained from illicit gambling, organized crime operatives are able to bribe government officials, make political contributions, engage in loan sharking operations, infiltrate and contaminate legitimate businesses, and hire the vast number of attorneys, accountants and other professionals necessary to the success of the operation. In an effort to launch a frontal attack on syndicated gambling throughout the United States, Congress enacted title VIII of the Organized Crime Control Act of 1970

Title X - Dangerous Special Offender Sentencing

Undoubtedly the most controversial new provision in the Organized Crime Control Act of 1970 is title X. Title X authorizes a federal prosecuting attorney to notify the defendant and the court before trial that the defendant, if found guilty of the felony on which he is being tried, is in the prosecutor\u27s opinion also subject to the dangerous special offender provisions embodied in the title. Should the defendant be judged guilty of the felony, he then will fall subject to an additional penalty beyond that received for the conviction if the judge finds that he qualifies as one of three types of special offenders: recidivists, professional offenders whose crimes involve special skill or expertise, and conspirators. In addition to establishing that the defendant fits within one of these categories, the prosecutor must also show that the defendant is so dangerous that a longer period of confinement than that provided by the sentence on the felony conviction is needed to protect the public
