On the Concept of an Organ of State
The paper is an English translation of O pojęciu organu państwowego by Karol Marian Pospieszalski, published originally in “Ruch Prawniczy Ekonomiczny i Socjologiczny” in 1972. Maps of the Cosmos: The Cosmic Microwave Background
Since the IAU XXIV meeting in 2000, the CMB anisotropy has matured from being
one of a number of cosmological probes to forming the bedrock foundation for
what is now the standard model of cosmology. The large advances over the past
three years have come from making better and better maps of the cosmos. We
review the state of measurements of the anisotropy and outline some of what we
have learned since 2000. The recent advancements may be placed roughly into
three categories: 1) What we learn from the CMB with minimal input from other
cosmic measurements such as the Hubble constant; 2) What we learn from the CMB
in combination with other probes of large scale structure; and 3) What we learn
by using the CMB as a back light. Future directions are also discussed. It is

Offset balancing in pseudo-correlation radiometers for CMB measurements
Radiometeric CMB measurements need to be highly stable and this stability is
best obtained with differential receivers. The residual 1/f noise in the
differential output is strongly dependent on the radiometer input offset which
can be cancelled using various balancing strategies. In this paper we discuss a
software method implemented in the Planck-LFI pseudo-correlation receivers
which uses a tunable "gain modulation factor, r, in the sky-load difference.
Numerical simulations and experimental data show how proper tuning of the
parameter r ensures a very stable differential output with knee frequencies of
the order of few mHz. Various approaches to calculate r using the radiometer
total power data are discussed with some examples relevant to Planck-LFI.
Although the paper focuses on pseudo-correlation receivers and the examples are
relative to Planck-LFI, the proposed method and its analysis is general and can
be applied to a large class of differential radiometric receivers.Comment: 12 pages, 8 figures, accepted for publication in A&A (updated version

O sposobach pojmowania „zasad prawa" w prawie państwowym
Le point de départ des considérations de l'auteur est sa définition du droit
constitutionnel: cette branche du système juridique contient des règles qui
déterminent d'une manière détaillée l'organisation des pouvoirs publics au niveau
suprême, autrement dit, l'organisation et la compétence des organes suprêmes,
de l'Etat et d'une manière générale (or seulement sous forme des principes) le
régime des organes territoriaux, le régime socio-économique et la position du
citoyen dans l'Etat. Il en résulte que les „principes du droit" jouent un grand rôle
dans le droit constitutionnel.
Dans la constitution et dans les lois ordinaires on emploie ce terme dans des
significations très différentes. Quand la constitution 1952 dit qu'elle contient des
principes juridiques du régime ou quand la loi électorale énumère dans son premier
chapitre ses principes généraux, il s'agit sans doute des dispositions de base.
Mais parfois on emploie le terme „principe" pour désigner la disposition d'une loi
ordinaire qui n'a pas de caractère fondamental et dans d'autres sens encore. La
collection des principes juridiques de la Cour Suprême comprend des décisions
de ce tribunal interprétant des règles de droit. On ne peut nommer un principe
du droit qu'une disposition ou un ensemble de dispositions ayant un caractère
fondamental. Dans cette acception le „principe du droit" a deux variantes:
Premièrement: on emploie ce terme pour désigner un certain modèle institutionnel
établi dans la doctrine du droit constitutionnel comparé, par exemple la
représentation proportionnelle ou la vérification des mandats par le parlement. Le système parlementaire ou le système présidentiel sont aussi des principes de ce
genre, quoique on emploie ici le plus souvent le mot „système".
Deuxièmement: on emploie le terme „principe juridique pour désigner les droits
de l'homme sous forme d'un postulat précis ou d'une directive générale. Ces principes
du droit ont été précisés dernièrement dans la Déclaration Universelle des
Droits de l'Homme 1948 et dans les conventions 1966.
Parfois un principe du droit compris en tant que modèle d'une institution juridique
embrasse plusieurs éléments auxquels on donne aussi le nom de principe.
Ainsi le principe de la démocratie en Pologne populaire renferme le principe du
rôle dirigeant du Parti, le principe concernant la déclaration des candidatures par
les comités du Front de l'Unité Nationale et d'autres encore qui constituent tous
des éléments du principe dirigeant. Il en est de même avec les droits fondamentaux
des citoyens. C'est ainsi que le droit à la vie et à la santé signifie d'abord (cest
le premier principe élément) que l'Etat est obligé à protéger l'individu non seulement)
qu'il n'est pals permis à l'Etat que dans des cas exceptionnels de prendre la
fluences nuisibles de l'environnement. En ce cas le droit à la vie et à la santé
est un reflet de l'obligation générale de l'Etat à créer au citoyen de conditions
de vie favorables. Ce principe générale signifie aussi (c'est le second principe élément)
qu'il n'est paspermis à l'Etat que dans des cas exceptionnels de prendre la
vie à l'homme pu de mettre sa vie ou sa santé en danger — le droit à la vie et
à la santé prend ici la forme d'une liberté. Ce droit signifie enfin (c'est le troisième
principe élément) que le citoyen peut demander à l'Etat certaines prestations pour
sauver sa vie ou sa santé. En ce cas le droit à la vie et à la santé prend la forme
d'un droit social.
En conclusion l'auteur revient à la définition du droit constitutionnel. Ce droit
est dans un plus ou moins grand degré lié a toutes les branches du système juridique
non seulement parce qu'il comprend des règles qui concernent la création des

Room Temperature, Quantum-Limited THz Heterodyne Detection? Not Yet
In their article, Wang et al. [1] report a new scheme for THz heterodyne detection using a laser-driven LTG-GaAs photomixer [2, 3] and make the impressive claim of achieving near quantum-limited sensitivity at room temperature. Unfortunately, their experimental methodology is incorrect, and furthermore the paper provides no information on the mixer conversion loss, an important quantity that could readily have been measured and reported as a consistency check. The paper thus offers no reliable experimental evidence that substantiates the claimed sensitivities. To the contrary, the very high value reported for their photomixer impedance strongly suggests that the conversion loss is quite poor and that the actual sensitivity is far worse than claimed
The Cosmic Background Imager
Design and performance details are given for the Cosmic Background Imager
(CBI), an interferometer array that is measuring the power spectrum of
fluctuations in the cosmic microwave background radiation (CMBR) for multipoles
in the range 400 < l < 3500. The CBI is located at an altitude of 5000 m in the
Atacama Desert in northern Chile. It is a planar synthesis array with 13 0.9-m
diameter antennas on a 6-m diameter tracking platform. Each antenna has a
cooled, low-noise receiver operating in the 26-36 GHz band. Signals are
cross-correlated in an analog filterbank correlator with ten 1 GHz bands. This
allows spectral index measurements which can be used to distinguish CMBR
signals from diffuse galactic foregrounds. A 1.2 kHz 180-deg phase switching
scheme is used to reject cross-talk and low-frequency pick-up in the signal
processing system. The CBI has a 3-axis mount which allows the tracking
platform to be rotated about the optical axis, providing improved (u,v)
coverage and a powerful discriminant against false signals generated in the
receiving electronics. Rotating the tracking platform also permits polarization
measurements when some of the antennas are configured for the orthogonal

Design, Implementation and Testing of the MAP Radiometers
The Microwave Anisotropy Probe (MAP) satellite, launched June 30, 2001, will
produce full sky maps of the cosmic microwave background radiation in 5
frequency bands spanning 20 - 106 GHz. MAP contains 20 differential radiometers
built with High Electron Mobility Transistor (HEMT) amplifiers with passively
cooled input stages. The design and test techniques used to evaluate and
minimize systematic errors and the pre-launch performance of the radiometers
