    Climate Change and Dam Owner Liability in Rhode Island

    Increasing precipitation associated with climate change is affecting dam operation and hazards in Rhode Island. Flooding caused by increased precipitation or extreme weather events can cause dam failure or upstream or downstream flooding, resulting in loss of life and property. These losses can result in liability, which may vary based on the dam owner and its purpose. This study assists dam owners and the public in understanding the potential liabilities that may arise as a result of flooding from extreme weather events. Section one provides a background of dam hazards in Rhode Island in the context of climate change. Section two introduces the statutory, common law, and constitutional claims that may be brought against a dam owner after a flood. Section three applies these potential liabilities to illustrate how they may apply to different types of dams and dam owners. Section four evaluates Rhode Island law in the context of state laws from the northeast region, focusing on the application of statutory liability, strict liability and negligence standards, and liability for drawdown

    A Flight Evaluation and Analysis of the Effect of Icing Conditions on the ZPG-2 Airship

    A series of test flights was conducted by the U. S. Navy over a 3- year period to evaluate the effects of icing on the operation of the ZPG-2 airship. In supercooled. clouds, ice formed only on the forward edges of small protuberances and wires and presented no serious hazard to operation. Ice accretions of the glaze type which occurred in conditions described as freezing drizzle adversely affected various components to a somewhat greater extent. The results indicated, a need for protection of certain components such as antennas, propellers, and certain parts of the control system. The tests showed that icing of the large surface of the envelope occurred only in freezing rain or drizzle. Because of the infrequent occurrence of these conditions, the potential maximum severity could not be estimated from the test results. The increases in heaviness caused by icing in freezing rain and drizzle were substantial, but well within the operational capabilities of the airship. In order to estimate the potential operational significance of icing in freezing rain, theoretical calculations were used to estimate: (1) the rate of icing as a function of temperature and rainfall intensity, (2) the climatological probability of occurrence of various combinations of these variables, and (3) the significance of the warming influence of the ocean in alleviating freezing-rain conditions. The results of these calculations suggest that, although very heavy icing rates are possible in combinations of low temperature and high rainfall rate, the occurrence of such conditions is very infrequent in coastal areas and virtually impossible 200 or 300 miles offshore

    An Electric Thrust Meter Suitable for Flight Investigation of Propellers

    A lightweight instrument that utilizes resistance-wire electric strain gases to measure propeller-shaft thrust has been developed. A wind-tunnel investigation on a propeller installed, on a single-engine pursuit airplane showed that the instrument gave a reliable indication of propeller-shaft thrust to an accuracy of +/-2 percent within its calibrated range. No attempt was made to determine the relation of indicated shaft thrust to net propeller thrust

    In Gentile v. State Bar the Supreme Court voided an attorney disciplinary rule regulating trial publicity for vagueness. The Court, however, upheld the substantive standard employed by the rule to identify dangerous speech. This standard restricts more attorney comments to the media than the Court has allowed for the press or public. This Note argues that the standard upheld in Gentile fails First Amendment scrutiny and proposes a response for states reviewing their professional disciplinary rules in light of Gentile. Adoption of this proposal will mitigate the danger of prejudicial trial publicity while recognizing the benefits of attorney publicity
