    The California Coastal Commission’s Approach to Lower Cost Overnight Visitor-Serving Accommodations Mitigation: A Policy and Legal Analysis

    Section 30213 of California Coastal Act requires the California Coastal Commission (“CCC”) to protect, encourage, and, where feasible, provide for lower cost overnight visitor accommodations (“LCOVA”) along the State’s coast. As mitigation measure consistent with this charge, the CCC imposes a 30,000feefor25percentforroomsofnewhoteldevelopmentsdeterminedtobehighercost(the“30,000 fee for 25 percent for rooms of new hotel developments determined to be higher cost (the “30,000/25% fee”), in-lieu of LCOVA facility provision. Generally, the CCC applies this fee in two circumstances: (1) As an ad hoc fee for developers upon CCC review of coastal development permit (“CDP”) applications, and (2) as a legislatively imposed fee to be adopted by coastal jurisdictions upon CCC review of a local coastal program (“LCP”) or related policy. This paper explores the policy and legal implications of the 30,000/2530,000/25% fee. The findings of this paper show that the 30,000/25% fee likely fails the applicable Federal California legal tests governing monetary exactions

    Technique for Outdoor Test on Concentrating Photovoltaic Cells

    Outdoor experimentation of solar cells is essential to maximize their performance and to assess utilization requirements and limits. More generally tests with direct exposure to the sun are useful to understand the behavior of components and new materials for solar applications in real working conditions. Insolation and ambient factors are uncontrollable but can be monitored to know the environmental situation of the solar exposure experiment. A parallel characterization of the photocells can be performed in laboratory under controllable and reproducible conditions. A methodology to execute solar exposure tests is proposed and practically applied on photovoltaic cells for a solar cogeneration system. The cells are measured with concentrated solar light obtained utilizing a large Fresnel lens mounted on a sun tracker. Outdoor measurements monitor the effects of the exposure of two multijunction photovoltaic cells to focused sunlight. The main result is the continuous acquisition of the V-I (voltage-current) curve for the cells in different conditions of solar concentration and temperature of exercise to assess their behavior.     Deletion of the gabra2 gene results in hypersensitivity to the acute effects of ethanol but does not alter ethanol self administration

    Human genetic studies have suggested that polymorphisms of the GABRA2 gene encoding the GABA(A) α2-subunit are associated with ethanol dependence. Variations in this gene also convey sensitivity to the subjective effects of ethanol, indicating a role in mediating ethanol-related behaviours. We therefore investigated the consequences of deleting the α2-subunit on the ataxic and rewarding properties of ethanol in mice. Ataxic and sedative effects of ethanol were explored in GABA(A) α2-subunit wildtype (WT) and knockout (KO) mice using a Rotarod apparatus, wire hang and the duration of loss of righting reflex. Following training, KO mice showed shorter latencies to fall than WT littermates under ethanol (2 g/kg i.p.) in both Rotarod and wire hang tests. After administration of ethanol (3.5 g/kg i.p.), KO mice took longer to regain the righting reflex than WT mice. To ensure the acute effects are not due to the gabra2 deletion affecting pharmacokinetics, blood ethanol concentrations were measured at 20 minute intervals after acute administration (2 g/kg i.p.), and did not differ between genotypes. To investigate ethanol's rewarding properties, WT and KO mice were trained to lever press to receive increasing concentrations of ethanol on an FR4 schedule of reinforcement. Both WT and KO mice self-administered ethanol at similar rates, with no differences in the numbers of reinforcers earned. These data indicate a protective role for α2-subunits, against the acute sedative and ataxic effects of ethanol. However, no change was observed in ethanol self administration, suggesting the rewarding effects of ethanol remain unchange

    Hospital care for children and young adults in the last year of life: a population-based study

    BACKGROUND: To help design population-based pediatric palliative care services, we sought to describe the hospital care received in the last year of life by children and young adults who died. We also determined the proportion with complex chronic conditions (CCCs) and tested whether the use of hospital services increased as the date of death drew nearer. METHODS: For all deaths occurring under 25 years of age from 1990 to 1996 in Washington State, USA, we linked death certificate information to hospital utilization records and analyzed the timing and duration of hospitalizations and the nature of hospital procedures during the year prior to death. RESULTS: Of the 8 893 deaths, 25 % had CCCs. Among infants with CCCs, 84 % were hospitalized at the time of death and 50 % had been mechanically ventilated during their terminal admission. Among the 458 CCC neonates dying under a week of age, 92% of all days of life were spent in the hospital; among the 172 CCC neonates dying during the second to fourth weeks of life, 85 % of all days of life were spent hospitalized; among the 286 CCC infants dying during the second to twelfth month of life, 41 % of all days of life were spent hospitalized. Among children and young adults with CCCs, 55 % were hospitalized at the time of death, and 19 % had been mechanically ventilated during their terminal admission. For these older patients, the median number of days spent in the hospital during the year preceding death was 18, yet less than a third of this group was hospitalized at any point in time until the last week of their lives. The rate of hospital use increased as death drew near. For subjects who had received hospital care, 44 % had governmental insurance as the source of primary payment. CONCLUSIONS: Infants who died spent a substantial proportion of their lives in hospitals, whereas children and adolescents who died from CCCs predominantly lived outside of the hospital during the last year of life. To serve these patients, pediatric palliative and end-of-life care will have to be provided in an integrated, coordinated manner both in hospitals and home communities

    Symmetries and asymmetries associated with non-random segregation of sister DNA strands in Escherichia coli

    AbstractThe successful inheritance of genetic information across generations is a complex process requiring replication of the genome and its faithful segregation into two daughter cells. At each replication cycle there is a risk that new DNA strands incorporate genetic changes caused by miscopying of parental information. By contrast the parental strands retain the original information. This raises the intriguing possibility that specific cell lineages might inherit “immortal” parental DNA strands via non-random segregation. If so, this requires an understanding of the mechanisms of non-random segregation. Here, we review several aspects of asymmetry in the very symmetrical cell, Escherichia coli, in the interest of exploring the potential basis for non-random segregation of leading- and lagging-strand replicated chromosome arms. These considerations lead us to propose a model for DNA replication that integrates chromosome segregation and genomic localisation with non-random strand segregation
