IDENTIDADE CONSTITUCIONAL, HISTÓRIA EFEITUAL E TENSÃO EXISTENCIAL: ESCOTOSE E RESISTÊNCIA DO SUJEITO PRÉ-CONSTITUCIONAL

This article develops reflections about the formation of the constitutional identity and his endless (re)construction, highlighting the thought of Michel Rosenfeld related to critical categories of Hans-Georg Gadamer. The article also considers the permanent resistance of pre-constitutional subject to change and their preference for traditions whose preconceptions are sometimes refractory to constitutional ideals. This resistance often becomes escape from reality which reveals a tendency to transcendence and alienation from the values of constitutionalism. This reality leakage phenomenon will be treated according to the thought of Bernard Lonergan , which he called scotosis. The main objective of the article is to demonstrate how the pre-constitutional cultural resistance manifests itself to the development of the constitutional subject, explaining some forms of resistance. The article will be developed according to the dialectical method based on the use of critical-analytical categories developed by different authors, who will dialogue to form the critical premises that one wishes to construct.Este artigo desenvolve reflexões sobre a formação da identidade constitucional e sua infindável (re)construção, destacando o pensamento de Michel Rosenfeld em contato com categorias analíticas de Hans-Georg Gadamer. O artigo também tratará da permanente resistência do sujeito pré-constitucional às transformações e seu apego a tradições cujos preconceitos são por vezes refratários aos ideais constitucionais. Esta resistência muitas vezes se converte em fuga da realidade, revelada numa tendência à transcendência e alheamento dos valores objetivos do constitucionalismo contemporâneo. RETÓRICA E POLÍTICA DA FÉ:: O NONSENSE COMUM DOS JURISTAS SOBRE OS DIREITOS HUMANOS

This article analyzes the normative rhetoric of human rights and its decoupling of socio-economic and political-cultural assumptions, a characteristic that turns against its own pretension of effectiveness. For this purpose, it considers that the cultural transformation that gave the human being cognitive abilities is the same as that which leads to the inclination to escape to imagined realities, which conform to the ideal of perfectibility and relieve the existential tension. The text highlights an atavistic resistance to skepticism and a preference for sympathetic emancipatory promises, even if surrounded in conditions that deny its political feasibility. This kind of alienation has debilitating effects on human rights practices and makes it imperative to give that rhetoric greater sustainability. To underscore this need is the objective of this work, which proposes the use of a strategic rhetoric anchored in realistic perceptions of contemporary complexity.  O artigo analisa a retórica normativa dos direitos humanos e seu desacoplamento de certos pressupostos socioeconômicos e político-culturais, característica que se volta contra sua própria pretensão de efetividade. Para este fim, os autores consideram que a transformação cultural responsável por desenvolver no ser humano capacidades cognitivas é a mesma que enseja a inclinação à fuga para realidades imaginadas, as quais se amoldam aos ideais de perfectibilidade e aliviam a tensão existencial. O texto destaca uma resistência atávica ao ceticismo e uma preferência por relatos promissores, ainda que envoltos em condições que negam sua factibilidade. Alienações desse tipo provocam efeitos debilitadores nas práticas de implementação dos direitos humanos, tornando imperativo conferir àquela retórica maior sustentabilidade. Sublinhar tal necessidade é objetivo deste trabalho, que propõe o uso de uma retórica estratégica ancorada em percepções realistas da complexidade contemporânea

Uma Saga dos Herdeiros de Caim: ensaio sobre a construção do locus necessário à consumação do ideal aquisitivo

The article deals with the existence of a pragmatic spirit that has perpetuated since time immemorial and has materialized in the bourgeois class and too with its fight for the creation of own organized spaces has culminated in the constitution of the State. The reflection not only induces the theoretical recognition of these assertions and brings into question the paths that must be tread to free the State of the limitations of“The Heirs of Caim” imposed on it and to carry through the ideal which was in its origins.  In this new order that same man has been in the service of the exacerbation of the acquiring spirit suggested by the etymology of the first homicide, circumstances which have led humanity to an age that demands new reflections capable of retake the emancipatory routes of modern  initiatives.O artigo trata da existência de um espírito pragmático que se perpetuou e que se materializou na classe burguesa, e também de sua luta pela criação de espaços próprios que culminou na constituição do Estado. A reflexão pretende levar ao reconhecimento teórico das assertivas, suscitar questões acerca dos caminhos que se deve trilhar para libertar o Estado das limitações que os herdeiros de Caim  lhe impõem e realizar o ideal que esteve nas suas origens. Na nova ordem, aquele mesmo homem tornou-se servo da exacerbação do espírito aquisidor sugerido pela etimologia do primeiro homicida, circunstância que tem conduzido a humanidade a uma era que está a demandar novas reflexões capazes de retomar os rumos emancipatórios das iniciativas modernas
