Місце та зміст окремих термінів у сфері застосування техніки в оперативно-розшуковій діяльності

Місце та зміст окремих термінів у сфері застосування техніки в оперативно-розшуковій діяльності // Право і безпека. - 2015. - № 3 (58). - С. 83–87.Проаналізовано зміст поняття «оперативна техніка», а також понять, які є дотичними до нього, та встановлено їх сутнісне співвідношення одне з одним. Виділено два підходи, які використовуються для об’єднання цих термінів в єдину систему. Зроблено висновок, що на сьогодні не існує єдиної думки щодо змісту поняття «оперативна техніка», яка є класичним засобом оперативно-розшукової діяльності. Встановлено, що терміни «спеціальна техніка», «оперативна техніка», «оперативно-технічні засоби», «спеціальні технічні засоби для зняття інформації з каналів зв’язку, інші засоби негласного отримання інформації» не можна ототожнювати, натомість вони співвідносяться між собою, як єдине і частка.The content of the concept of «operative equipment» and also the concepts that are adjacent to it are analyzed; their essential relationship to each other is established. The relevance of the studied problem is grounded. It is emphasized that non-compliance of the corresponding terminological apparatus sometimes causes uncertainty and confusion in understanding the structure of the operative equipment as a mean of operative and search activities. Two approaches used to combine studied terms in a single system are singled out. Each of these approaches is briefly considered; appropriate interpretations of the concepts are provided. It is emphasized that the first approach has no term of «operative equipment» and derived from it. Instead, these concepts are found in the second approach, which includes a much deeper encapsulation of narrow terms by wider ones. It is established that the content of the concepts of «operative equipment» and «special equipment of operative and research purpose» is strongly correlated with each other in both approaches. With the use of a retrospective approach the author has analyzed the usage of all studied terms in Ukrainian legislation and legislations of the former Soviet Union countries. The definition, characteristics and classification of special technical means for the interception of information from channels of communication, other means of secret information getting are provided. The author has concluded that today there is no consensus on the content of the concept of «operative equipment», which is a classic tool of operative and search activities. It is established that the terms «special equipment», «operative equipment», «operative and technical means», «special technical means for interception of information from channels of communications, other means of secret information getting» can not be identified, in return they are correlated to each other as one and share. By the example of the scheme the appropriate link is explained.Проанализировано содержание понятия «оперативная техника», а также понятий, которые являются близкими к нему, установлено их сущностное соотношение друг с другом. Выделены два подхода, используемые для объединения этих терминов в единую систему. Сделан вывод, что в настоящее время не существует единого мнения относительно содержания понятия «оперативная техника», которая является классическим средством оперативно-розыскной деятельности. Сучасний стан наукової розробленості використання засобів оперативно-розшукової діяльності у протидії злочинності

Research papers from different areas of legal science, which are split by time criterion have been analyzed. Thus, the authors has considered the research conducted in the Soviet period, the subject of which were different aspects of using means of operative and search activities. In particular, having analyzed the research of the stated period, the author has highlighted two areas to study specified issues: those that were conducted within forensic science and the science of operative and search activities. At the same time it has been stressed that all Soviet textbooks, monographs, candidate dissertations and other types of works that were devoted to the study of general aspects of operative and search activities or combating different types of crime, considered in most cases the use of special means, including operative and search. Comparing the works of Soviet and modern Ukrainian experts, the author has made a similar conclusion in the part relating to the research of using means of operative and search activities. However, analyzing the domestic research devoted to the outlined problems, the author of the article states that the studies mostly use outdated regulatory base and does not take into account the latest technological achievements, although national experts in the field of operative and search activities consider the topic of using means of operative and search activities while studying general theoretical issues of operative and search activities. As the result of the study the author has stated that the use of special means of operative and search activities has basically been the subject of research of specialists in forensic and operative and search activities spheres. However, it has been summarized that nowadays there are no current fundamental scientific works, where the issue of using means of operative and search activities in combating crime would be considered in dissertations and monographs.Проаналізовано наукові праці з різних сфер юридичної науки, які умовно розподілено за часовим критерієм. У результаті проведеного дослідження констатовано, що питання використання спеціальних засобів ОРД в основному було предметом дослідження фахівців у сфері криміналістики та ОРД. Водночас резюмовано, що сьогодні відсутні сучасні ґрунтовні наукові праці, в яких проблема використання засобів ОРД у протидії злочинності розглядалась би на дисертаційно-монографічному рівні

Homological algebra for osp(1/2n)

We discuss several topics of homological algebra for the Lie superalgebra osp(1|2n). First we focus on Bott-Kostant cohomology, which yields classical results although the cohomology is not given by the kernel of the Kostant quabla operator. Based on this cohomology we can derive strong Bernstein-Gelfand-Gelfand resolutions for finite dimensional osp(1|2n)-modules. Then we state the Bott-Borel-Weil theorem which follows immediately from the Bott-Kostant cohomology by using the Peter-Weyl theorem for osp(1|2n). INTRODUCTION OF INTERNET TECHNOLOGIES IN THE ACTIVITIES OF THE NATIONAL POLICE OF UKRAINE TO OBTAIN OPERATIONAL-SEARCH INFORMATION

Розглянуто сутність і перспективи використання сучасних інтернет-технологій в оперативно-розшуковій діяльності під час пошуку та використання інформації в інтересах правоохоронних органів. Охарактеризовано способи здобуття інформації в мережі Інтернет та застосування технологій обробки інформації за допомогою Big Data. Окреслено низку проблем, які мають бути вирішені для ефективного використання інформації, здобутою із глобальної мережі для вирішення завдань оперативно-розшукової діяльності.The article considers the essence and prospects of using modern Internet technologies in operational search activities when searching for information in the interests of law enforcement agencies. Attention is paid to the ways of obtaining information in the Internet and the application of information processing technologies with the help of Big Data. Today in the world there is an intensive transfer of almost all available information in digital format. According to some expert estimates, “the figure” does not cover about 4–5 % of the information. And the vast majority of such information is stored on magnetic storage media in computer systems that have a connection to the global network. Of course, this opens up unlimited possibilities for prompt information retrieval. However, the analysis of non-structured data generated by various sources remains a difficult task for which modern day conceptual approaches in the form of Big Data are formed. A number of problems have been identified that need to be solved for the effective use of information obtained from the global network to solve the tasks of operational-search activity

АНАЛІЗ ОРГАНІЗАЦІЇ ІНФОРМАЦІЙНО-АНАЛІТИЧНОГО ЗАБЕЗПЕЧЕННЯ ДІЯЛЬНОСТІ НАЦІОНАЛЬНОЇ ПОЛІЦІЇ УКРАЇНИ

The state of the organization of information and analytical support of the activity of the National Police of Ukraine is analyzed. The author pays attention to the issues of a systematic approach to the main elements of the organization and management of information and analytical support, the characteristics and characteristics of planned and managed and targeted information and analytical support systems. The obligatory elements influencing the efficiency of the created information and analytical support systems for police activities are determined, the need for creating information subsystems aimed at improving the work of the organizational information and analytical support system is outlined.
